ERIC SCHLAEFER requests a Wetland Permit to remove and dispose of existing timber
bulkhead. Construct 169' of new bulkhead using C-Loc vinyl sheathing including the 6' return
on northwest end, installed in-place of existing. Located: 150 Knoll Circle, East Marion.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation
that the proposed action is EXEMPT from review pursuant to Chapter 268-3, Exempt
Minor Actions, item B which states.
"Replacement, rehabilitation or reconstruction of a structure or facility, in kind, on the same
site, including upgrading buildings to meet building or fire codes, except for structures in areas
designated by the Coastal Erosion Hazard Area (CEHA) law where structures may not be
replaced, rehabilitated or reconstructed without a permit ".
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing
its written determination regarding the consistency of the proposed action.

proposed actions that are. subject' to the Town of Southold Waterfront Consistency Review Law This
assessment is intended to supplement other information used by a Town of Southold agency ~n
making a determination of consistency. *Except minor exempt actions incl~ding Bt~ildD~g Pe~¥~ts
and other ministerial permits not located within the Coastal Erosion Hazard A rea.
Before answering the questions in Section C, t~he preparer of this form should review the e×cm?t
minor action list, policies and explanations of each policy contained in the Town of Southold
Waterfront Revitalization Program. A proposed ;~ction will be evaluated as to its signif~ca~ql
beneficial and adverse effects upon the coastal area (which includes all of Southold Town)
If any question in Section C bn this form i} answered "yes", then the proposed action may afl~ect thc
achievement of the LWRP POlicy standards and conditions contained in the consistency review I~
Thus, the action should be analyzed in more detail and, if necessary, modified prior to making
determination that it is consistent to the maximum extent practicable with the I..WRP policx
standards and conditions. If an action carmot be certified as consistent with the LWRP polici,
standards and conditions, it shall not be undertaken.

DEVELOPED COAST POliCIES
Policy I Foster a pattern of development in the Town of Southold that enhances community
character, preserves open space, makes efficient use of infrastructure, makes beneficial
use of a coastal location, and minimizes adverse effects of development.
This is a waterfront piece of property that is presently bulkheaded. The bulkhead is failing and needs
to be reconstructed. All structures are existing. There will be no increased development and our
proposal is an effort to maintain existing structures,

Preserve historic resources of the Town of Soutlmld.
This property has no significant historic resources,
Policy 3
Enhance visual quality and protect scenic resources throughout the Town of Southold.
The bulkhead at this location is existing. The present condition of this bulkhead is showing its age by
presenting holes in the sheathing and leaking of backfill. A new bulkhead is just an attempt of the
upland property owner to maintain his property. All structures are existing so the visual quality and
scenic resources will remain the same.
NATURAL COAST POliCIES
Policy 4 Minimize loss of life, structures, and natural resources from flooding and erosion.
The existing bulkhead is needed to protect the upland property. This shoreline is mostly reinforced
with erosion control structures. The new bulkhead will not increase flooding or erosion in this area.

This proposal will not have any impact on the water quality and supply of the Town of Southold.

Our proposal will not limit public access to the coastal waters or public resources of the Town of
Southold. There is a bulkhead presently existing and we are proposing for in-place construction,

Our proposal is to reconstruct a failing bulkhead, The present condition of the bulkhead is poor and
is unsafe. The construction of a new bulkhead in its place will allow the property owners to safely
approach this waterfront.

will be during the initial construction and it is anticipated that the area will re-establish itself within a
