The proposed action has been revie~ved to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation
that the proposed action is INCONSISTENT with the denoted following Policy Standards
and therefore is INCONSISTENT with the LWRP.
Policy 6: Protect and restore the quality and function of the Town of Southold
ecosystem.
6.3 Protect and restore tidal and freshwater wetlands.
Comply with statutory and regulatory requirements of the Southold Town Board of
Trustees laws and regulations for all Andros Patent and other lands under their
jurisdiction
Comply with Trustee regulations and recommendations as set forth in
Trustee permit conditions.
The distance of the proposed alteration from the timber bulkhead is 27 feet[ a minimum
separation distance of 100' is required pursuant to Chapter § 275-3. Findings~ purpose;
iurisdiction; setbacks. In addition~ a minimum setback distance of 75 feet is required
pursuant to Chapter § 280-116 B. All buildings or structures located on lots upon which a
bulkhead~ concrete wall~ riprap or similar structure exists and which are ad[scent to tidal
water bodies other than sounds shall be set back not less than 75 feet from the bulkhead.
Please require that the applicant amend the application to meet the above policy.
Additionally, if the action is approved and to further Policy 5: Protect and Improve Water
quality in the Town of Southold
1. Require drywells to contain drainage for the residence.
2. Require a non-turf buffer landward of the bulkhead, to protect the bay.
3. Install a haybale line prior to construction.
Pursuant to Chapter 268, the Southold Town Zoning Board of Appeals shall consider this
recommendation in preparing its written determination regarding the consistency of the proposed
action.

... separate 600 sq. ft. two-car garage with an apartment above it built approximately four years ago. The
original small one-story cottage was totally demolished and a larger two-story house with an addition is
presently being constructed in the same location. The house has a new foundation with a full basement.
The setback to the bulkhead is 35 feet. The third house to the east was totally renovated in 2004 with a
second floor master bedroom and deck addition constructed towards the water. The setback is 38 feet.
All of the above additions and new construction are within the 75-foot setback zone. This arso includes
· the house to the west of my property, which presently has a second floor bedroom, bath and deck addi-
tion being constructed. The setback is 26 feet. It is in the AE-9 flood zone. My lot size is 28,500 sq. ft.,
which is approximately three times that of all of the other lots. The lot coverage will remain 7%, as I will
be staying within the existing footprint. The setback from the bulkhead to the house is 40 feet and the
closest corner of the existing porch is 28 feet. Due to the high elevation of the house, it is not in a flood
zone. Photos of my house in relation to the others to the east and those under construction are attached.

I respectfully request that my appeal application be scheduled for consideration on the Septem-
ber 11, 2007 docket.
In addition to creating a master bedroom and at least one full-sized bath in the house, one of the
main reasons for the second floor alteration work is to eliminate the fiat and Iow-sloping roofs. Due to the
house's exposure to the wind, the south roofs have always been problematic. Leaks have occurred in-
termittently, depending on the direction of the wind-driven rains or from melting snow. The roofs have
been re-shingled and the valleys re-flashed a number of times in attempts to alleviate the problems. This
to no avail. The water still travels laterally down and across the intersecting under-roofs. They were left
in place by the previous owner when the original cottage was renovated and expanded in 1982.
While the new building plans were being finalized in June in an attempt to start work in August,
pdor to the fall storms, a nor'easter tore many of the shingles, and some of the fiat roofing felts off the
south side of the house. The front bedroom, living and dining rooms at the first floor sustained extensive
water damage to the ceilings. A large hole was created in the living room ceiling where a portion of the
saturated sheetrock collapsed. It has been temporarily covered over with a raised panel for appearance.
Several pails of aluminized roofing cement were applied over the shingles in an attempt to temporarily al-
leviate the problem until the new peaked roofs can be constructed~ Some rain water still penetrates and
buckets need to be installed under the leaks in the living and dining rooms each time it rains.
