The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation
that the proposed action is exempt from review pursuant to Chapter 268-3, F. Exempt
Minor Actions, item F which states:
F. Granting of individual setback, lot line and lot area variances, except in relation to a
regulated natural feature or a bulkhead or other shoreline defense structure or any activity
within the CEHA; [Amended 6-6-2006 by L.L. No. 7-2006]
Attached is the June 16, 2007 LWRP Inconsistent recommendation prepared for the Board of
Trustees. A permit was issued by the Board of Trustees for the action on June 21, 2006.
Therefore, the issuance of the permit for the action complies with Policy 6.3, A, 1.

En-Consultants, Inc. on behalf of DOROTHY DICKERSON PETERS requests a Wetland Permit to
construct a two-story, one-family dwelling with attached garage, deck, and steps; install a drainage
system of drywells; and establish a 50' non-disturbance/non-fertilization buffer adjacent to the wetlands
boundary. Located: 2280 Deep Hole Dr., Mattituck. SCTM#123-4-6
The proposed action has been reviewed to Chapter 95, Waterfront Consistency Review of the Town of
Soutbold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based
upon the information provided on the LWRP Consistency Assessment Form submitted to this department,
as well as the records available to me, it is my recommendation that the proposed action is
INCONSISTENT with the denoted following Policy Standards and therefore is INCONSISTENT
with the LWRP.
Policy 6 Protect and restore the quality and function of the Town of Southold ecosystem.
6.3 Protect and restore tidal and freshwater wetlands.
Comply with statutory and regulatory requirements of the SouthoM Town Board of Trustees
laws and regulations for all ,4ndros Patent and other lands under their jurisdiction

permit conditions.

Before answering the questions in Section C, the preparer of this fOrTh should review the exempt

beneficial and adverse effects upon the coastal area (wlfich iocludes all of Southold Town).
