The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation
that the proposed action is INCONSISTENT with the denoted following Policy Standards
and therefore is INCONSISTENT with the LWRP.
Policy 6: Protect and restore the quality and function of the Town of Southold
ecosystem.
6.3 Protect and restore tidal and freshwater wetlands.
Comply with statutory and regulatory requirements of the Southold Town Board of
Trustees laws and regulations for all Andros Patent and other lands under their
jurisdiction
Comply with Trustee regulations and recommendations as set forth in
Trustee permit conditions.
The proposed distance of the covered porch from the timber bulkhead is proposed at 3.~
feeB a minimum separation distance of 100' is required pursuant to Chapter § 275-3.
Findinlls; I~uroose; iurisdiction~ setbacks. In addition~ a minimum setback distance of 75
feet is required pursuant to Chapter § 280-116 B. All buildings or structures located on lots
upon which a bulkhead~ concrete wall~ riprap or similar structure exists and which are
ad]acent to tidal water bodies other than sounds shall be set back not less than 75 feet from the
bulkhead. Please require that the applicant amend the application to meet the above policy.
Pursuant to Chapter 268, the Southold Town Zoning Board of Appeals shall consider this
recommendation in preparing its written determination regarding the consistency of the proposed
action.

The existing dwelling notes a single side yard setback ol- 11.25 feet. The proposed construction will
maintain that setback.
Therefore, thc proposed construction is not pem~itted pursuant to Article XXIII Section 200-124,
which states that non-confom~ing lots, .measuri~g between 20,000 and 39,999 square feet in total size,
require a minimmn single side yard setback of 15 feet.
In addition., the proposed construction is not pem~ittcd pursuant to Article XXII Section 280-116 B,
which states:
"All buildings located on lots uoon which a bulkhcad, concrete wall, tiptop or similar structure
exists and which arc adjacent to tidal water bodies other than sounds shall bc set back not
th~m seventy-five (75) feet from thc bulkhead."
Thc dwelling notes an existing setback of+/- 33 t'cct from the existing bulkhead. The vroposed
addition will maintain that setback.
In ad~lition~ the proposed accessory garage is not permitted pursuant to Article III. Section 280-
15, which states that such buildings shall be set buck at lea.~t 15 feet from thc side oronertv line.
The proposed construction notes a side yard setback of 5 feet.

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Water~ont Consistency Review Law.
This assessment is intended to supplement other information used by a Town of Southold agency
in making a determination of consistency. *Except minor exempt actions including Building
Permits and other ministerial permits not located within the Coastal Erosion Hazard Area.
Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold
Local Waterfi'ont Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes", then the proposed action may affect
the achievement of the LWRP policy standards and conditions contained in the consistency review
law. Thus, the action should be analyzed in more detail and, if necessary, modified prior to making
a determination that it is consistent to the maximum extent practicable with the LWRP policy
standards and conditions. If an action cannot be certified as consistent with the LWRP policy
standards and conditions, it shall not be undertaken.

Dear Mr. lavarone:
The Board of Town Trustees took the following action during its regular meeting held on
Wed., September 20, 2006 regarding the above matter:
WHEREAS, JOSEPH IAVARONE applied to the Southold Town Trustees for a permit
under the provisions of Chapter 275 of the Southold Town Code, the Wetland
Ordinance of the Town of Southold, application dated August 16, 2006, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator recommended that the proposed application be
found Inconsistent with the LWRP, and,
WHEREAS, the Board of Trustees has furthered Policy 6 of the Local Waterfront
Revitalization Program to the greatest extent practical through the imposition of the
following Best Management Practice requirements: a line of staked hay bales installed
during construction, the installation of drywells and gutters to contain the roof run-off,
and a 10' non-turf buffer area, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on September 20, 2006, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that for the mitigating factors and based upon the Best Management
Practice requirement imposed above, the Board of Trustees deems the action to be
Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5
of the Southold Town Code, and,
RESOLVED, that the Board of Trustees approve the application of JOSEPH
IAVARONE to renovate the existing one and a half stow wood frame dwelling, demolish
existing one-stow section of house and construct a new one and a half stow wood
frame addition; demolish existing detached garage and construct a new two-car garage,
with the condition a line of staked hay bales is in place during construction, gutters and
drywells are installed to contain the roof run-off, and a 10' non-turf buffer landward of
the bulkhead, and as depicted on the survey prepared by Haynes Land Surveyors last
dated April 3, 2007.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)
