This site plan is for an alteration of an existing building into a new winery totaling 11,541 sq. ft. which
includes 813 sq. ft. of office, 837 sq. ft. of retail, 4,170 sq. ft. of tasting room, 3,306 sq. ft. of storage area
and 2,415 sq. ft. of production area on a 12.088-acre parcel in the A-C Zone located on the south side of
County Road 48, approximately 1,699 ft. west of Tucker Lane, known as 39750 County Road 48, in
Southold. SCTM#1000-59-10-1.
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold
Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the
information provided on the LWRP Consistency Assessment Form submitted to this department as well as the
records available to me, it is my determination that the proposed action is CONSISTENT with the Policy
Standards and therefore is CONSISTENT with the LWRP provided that the Planning Board consider the
following policy standards in site design:
Policy Standards
3.1
Enhance visual quality and protect scenic resources throughout the Town of
Southold.
Minimize introduction of structural design components (including utility lines,
lighting, signage and fencing) which would be discordant with existing natural
scenic components and character.
C. Screen components of development which detract from visual quality.
Use appropriate siting, scales, forms, and materials to ensure that structures
are compatible with and add interest to existing scenic components.
Preserve existing vegetation and establish new indigenous vegetation to enhance
scenic quality:
1. Preserve existing vegetation which contributes to the scenic quality of
the landscape.
2. Allow for selective clearing of vegetation to provide public views
without impairing values associated with the affected vegetation.
3. Restore historic or important designed landscapes to preserve intended
or designed aesthetic values.
4. Restore or add indigenous vegetative cover that presents a natural
appearance
It is further recommended that the following best management practice be applied to further Policy 5,
"Protect and improve water quality and supply in the Town of Southold" and protect and improve
the water quality and supply in the area:
1. The parking areas are constructed of pervious materials.
Pursuant to Chapter 268, the Planning Board shall consider this recommendation in preparing its written
determination regarding the consistency of the proposed action.

LWRP CONSISTENCY ASSESSMENT FORM

All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).

SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this
application and determines that this review falls under the Type II category of the State's List of Actions,
without an adverse effect on the environment if the project is implemented as planned.
PROPERTY FACTS/DESCRIPTION: The applicant's 12-acre lot has 564.88 feet along the south
side of County Road 48, a/k/a North Road, in Southold. The property is improved with agricultural
buildings as shown on the December 19, 2002 survey prepared by Stanley J. Isaksen, Jr.
BASIS OF APPLICATION: Building Department's March 17, 2004, Notice of Disapproval, citing
Code Section 100-31A.4 in its denial of a building permit application regarding applicant's plan to
convert the existing building use from agricultural-nursery to agricultural-winery for the reason that
the existing building is less than 100 feet from the front lot line along County Road 48.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on May 20, 2004, at which
time written and oral evidence were presented. Based upon all testimony, documentation, personal
inspection of the property, and other evidence, the Zoning Board finds the following facts to be true
and relevant:
AREA VARIANCE RELIEF REQUESTED: The applicant requests the continued agricultural use of
an existing building located 67 feet and 80.8 feet at its closest points to the front line along C.R. 48.
The building was built in 1999 and has been used as a nursery office and storage areas related to
the agricultural (nursery) use of the land. The applicant is proposing a winery within the building
which is a permitted agricultural use in this A/C Zone.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and
personal inspections, the Board makes the following findings:
1. Grant of the relief requested will not produce an undesirable change in the character of the
neighborhood or a detriment to nearby properties. The applicant is not proposing to increase the
structure in any way. The appearance of the current plantings that parallel County Road 48 create
a visual effect of a much larger setback than the 67 feet that exists. These plantings and the

existing building will remain, in place. The plantings will be continuously maintained as a landscape
buffer.
2. The benefit sought by the applicant cannot I~e achieved by some method, feasible for the
applicant to pursue, other than an area variance. The applicant is using the existing structure on this
agricultural site, and the structure has been used as an office and storage for the nursery's activities.
3. The variance granted herein is substantial, however, the building will remain in place. The
reduction of the current code requirement is 33 feet, for a 67 ft. setback instead of a 100 ft. setback
from the front property line.
4. The difficulty was self-created when the applicant acquired the building in a nonconforming
location.
5. No evidence has been submitted to suggest that a variance in this community of single-family
residences will have an adverse impact on the physical or environmental conditions in the
neighborhood.
6. Grant of this relief is the minimum action necessary and adequate to enable the applicant to
enjoy the benefit of a different agricultural use (winery), while preserving and protecting the
character of the neighborhood and the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing
test under New York Town Law 267-B, motion was offered by Member Orlando, seconded by
Member Dinizio, and duly carded, to
GRANT the variance as applied for, as shown on the December 19, 2002 survey prepared
by Stanley J. Isaksen, Jr., L.S., with the CONDITION that the existing trees and shrubs, be

maintained at a minimum average height of as a landscape buffer, as exists, between the
building and CR 48.
This action does not authorize or condone any current or future use, setback or other feature of the subject
pr0per~y that may violate the Zoning Code, other than s~Jch uses, setbacks and other features as are expressly
addressed in this action.
