Woodhouse, Chair Town of Southold Plarming Board From: Mark Terry, Senior Environmental Planner LWRP Coordinator Date: April 9, 2007 Re: Proposed Standard Subdivision of John Scott SCTM# 1000-75-6-3 Zoning District R-80 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. This proposal is to subdivide a 6.5539-acre parcel into three lots where Lot I equals 80,000 s.f., Lot 2 equals 80,010 s.f. and Lot 3 equals 82,932 s.f. in the R-80 Zoning District The parcel is located within the watershed of Richmond Creek, a New York State Department of State Significant Fish and Wildlife Area (see narrative attached) and a New York State Department of Environmental Conservation Critical Environmental Area. In addition, the parcel is located south of New York State Route 25, a designated New York State Scenic Byway. To meet Policy 3.1 "Enhance visual quality and protect scenic resources throughout the Town of Southold". C. Screen components of development which detract from visual quality. It is recommended that if the action is approved, clustered vegetative buffers be established along Wells Road to "break up" the visual impact of any future structures. Protect visual quality associated with agricultural land, open space and natural resources. 2. Group or orient structures during site design to preserve open space and provide visual organization. To further the above sub policy, pursuant to Section 240-42C of the Town Code it is recommended that the Planning Board cluster the lots in consideration of the information contained on the Existing Resources and Site Analysis Plan (ERSAP). If that is determined not to be feasible, it is recommended that the building envelopes are reduced in size to the greatest extent practical to preserve the scenic view shed from New York State Route 25 to Richmond Creek water shed. Avoid structures or activities which introduce visual interruptions to natural landscapes including: a. introduction of intrusive artificial light sources b. fragmentation of and structural intrusion into open space areas To further Policy 4.1 "Minimize losses of human life and structures from flooding and erosion hazards." the following is recommended. The following management measures to minimize losses of human life and structures from flooding and erosion hazards are suggested: A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. Move existing development and structures as far away from flooding and erosion hazards as practical. Maintaining existing development and structures in hazard areas may be warranted for: a. structures which functionally require a location on the coast or in coastal waters. b. water-dependent uses which cannot avoid exposure to hazards. c. sites in areas with extensive public investment, public infrastructure, or major public facilities. Proposed lots 2 and 3 are located within Flood Zone AE8, a Special Flood Hazard Area. It is recommended that all structures be located outside of the flood zone to the greatest extent practical. To further Policy 5, "Protect and improve water quality and supply in the Town of Southold" and protect and improve the water quality and supply in the area, it is recommended that the following best management practices be required: 1. Require the use of gutters, leaders and subsurface dr?wells to retain surface runoff. 2. Require the use of native plants and encourage the use of disease-resistant and drought-tolerant plants in landscaping. 3. Prohibit the residential application and use of synthetic pesticides and fertilizers capable of entering the potable water supply or marine wetland. 4. Require tow flow faucets and toilets (SCWA). 5. Require pervious driveways to serve each lot. Additionally, where fertilization is proposed, the following best management practices are recommended for lawn areas: 6. Prohibit the application of any pesticides and fertilizers within 75 feet of the marine wetlands. As indicated above, the parcel is located adjacent to Richmond Creek; a New York State Department of State Significant Fish and Wildlife Area and a New York State Department of Environmental Conservation Critical Environmental Area. To further Policy 6 "Protect and restore the quality and function of the Town of Southold ecosystem", the following is recommended. 7. Require the establishment of a perpetual 100' setback from the building envelope/structural area to the marine wetland. 8. Require a perpetual, non-disturbance buffer adjacent to the marine wetland. Grading of soil, mowing, cutting or trimming of vegetation or any other activity that would cause the death of vegetation or affect the natural grade of the area should be strictly prohibited in the buffer area. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, the proposed action is CONSISTENT with the LWRP, provided that the above recommendations are required in the subdivision approval. · · To~:.n~,~l.,S outh old LWRP CONSISTENCY ASSESSMIgNT FORM mo INSTRUCTIONS 1. A proposed action will be evaluated as to its significant beneficial and adverse effects upon the coastal area (which includes all of Southold Town). If any question in Section C on this form is answered "yes", then the proposed action may affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus, the action should be analyzed in more detail and, if necessary, modified prior to making a determination that it is consistent to the maximum extent practicable with the LWRP policy standards and conditions. If an action cannot be certified as consistent with the LWRP policy standards and conditions, i_t shall not be undertaken.
