The Planning Board has received your request for a determination regarding the necessity for site plan for the above referenced application. After careful review of this application and based upon the materials submitted, the Planning Board has determined that no site plan is required for the following reasons: 1) As per § 72-6: Farm stand permits issued without requirement of site plan approval. A farm stand permit shall be issued to applicants meeting the following requirements, and such farm stands shall not require site plan approval from the Planning Board, notwithstanding the provisions of Chapter 280, Article XXIV: (1) The farm stand is located on lands used in bona fide agricultural production by the owner or lessee of the property. (2) The total floor area, as defined in Chapter 280, of the farm stand structure(s) does not exceed 3, 000 square feet. (3) The permanent farm stand structure is set back at least 50 feet from the road. (4) The farm stand parcel provides at least four off-street parking spaces and also provides adequate space that may be used for unimproved on-site parking equivalent to one parking space for each 200 square feet of retail sales area. Based upon the materials submitted the applicant does not meet the Southold Town Code requirements outlined above for the following reasons: · The information submitted by Beds and Borders shows only a proposed 12 x 8 foot structure, totaling 96 square feet, well under the 3000 square foot requirement for site plan as outlined above in §72-6 (A)(2). · The proposed stand/structure appears t be setback more than 50 feet from S.R. 25 as per § 72-6 (A)(3). · The proposed farm stand/structure shows 10 off-street parking spaces, which is in excess of the four off-street parking spaces required per § 72-6 (A)(4). In recent years, many states have employed access management as a major technique to address conflicts between through traffic and that generated by developments. The goals of access management are to limit the number of access points, separate conflict points and remove turning movements from through traffic. New York State is utilizing this technique to minimize impacts to State highways. We recommend, therefore, that cross access to this site be obtained from adjacent property(s). If this is not presently possible, it should be shown on the plans for implementation as part of future redevelopment. The submitted plans do not contain all of the information we normally require to commence our review. Additional items need to be included in the site plans for the work to be performed within State Right Of Way. The Right of Way features (curb, ramps etc.) appear to be missing or in need of improvement. We are particularly interested in the site's internal drainage, since we do not permit runoff from private property onto our State highways. A Work Zone Traffic Control (WZTC) plan must be provided for work on Route-25. The plans should also show all existing and proposed features, (along with the ones marked for demolition,) such as pavement markings, traffic signs (including text), curbs, sidewalks, utilities, trees, traffic signal equipment, property lines, easements and drainage structures in the vicinity of the site. Please consult our Policy Manual titled 'Policy and Standards for the Design of Entrances to State Highways' on our web site www.nysdot, gov for the required features to be included in the plans. All proposed road improvements detailed in the Site Plans must be designed in accordance with the latest versions of AASHTO, National Manual of Uniform Traffic Control Devices (MUTCD), along with NYS Supplement and NYSDOT Highway Design Manual. Road improvement plans must provide all appropriate NYSDOT Standard Details and NYSDOT Standard Item Numbers. Please submit four (4) sets of revised plans showing the changes. This permit application should be sensitive to the unique visual and historic setting of the Long Island North Shore Heritage Area, which runs from the Queens/Nassau County line to Orient Point, and from Route 25 or 1-495, (whichever is farther south), to Long Island Sound in the north. The proposed site plan needs to define the retail sales area & show the parking dimensions. In addition, the site plan needs to indicate that the driveway & parking area meet the minimum requirements of Town Code Storm Water Management. Also, the farm stand should maintain a 50' setback. This revised site plan indicates an "Entrance Only" Access from NY State Route 25. This access point was not allowed based on the last correspondence that I have received from the DOT. According to the applicant, the DOT has reconsidered there position and they have approved this access point subject to all exiting traffic leaving bywayof Laurel Lane. This item will require certification bythe DOT in wdting prior to issuance of any permits. 2. The shallow swale drainage system indicated/shown on this revised site plan is considered adequate to contain the runoff from the proposed roadway and parking area. However, this proposed read and parking area must be graded in a manner that will direct all surface flow into this swale. 3. The proposed selling space shown in the plan is a reasonably large area. Will the applicant be placing stone blend or other surfacing materials within this area? If storm-water run-off is generated by improvements made to this area this watershed area will also require drainage systems or a site design capable of containing all of the run-off on site. Grading the site to allow for surface water flow in the direction of the proposed drainage swales would be acceptable. 4. The applicant has begun assembly of what appears to be the construction of a trellis system fronting the proposed Farm Stand. This item needs to be reviewed and approved by the Building Department prior to construction. If you have any questions concerning this report, please contact my office. The construction of the Driveway and Parking area must provide drainage to meet the minimum requirements of Chapter 236 "Storm Water Management" in the Town Code. As proposed, the Gravel surface will be required to contain a two inch rainfall using a runoff coefficient of 60%. Drainage calculations should be indicated on the plan and the proposed drainage structures should be located on the map and noted with invert & top of grate elevations. All storm water runoff must be contained on site. 2. The location of the proposed farm stand appears to be in conflict with the NYS DOT determination (Case # 09-056P) that there will be no access to State Route 25 from this farm stand. Will the Building Department require the applicant to install No Parking/Standing signs along Route 25? 3. The location of the proposed farm stand will also need to be set back 50' from the Right of way or property line. Not the edge of pavement as indicated on the map.
