Dear Mr. Neafsey:
The Southold Town Board of Trustees reviewed your foundation survey
prepared by John T. Metzger last dated November 21,2007 submitted to the
Building Dept. The updated survey reveals wetlands within 100' of your recent
demolition and reconstruction of a new dwelling.
Although you were issued a letter of No-Jurisdiction on January 26, 2007
by our Board, that determination was based on the survey you submitted to our
office prepared by John T. Metzger last dated January 8, 2006.
Please be advised that any future activities within 100' of the wetland
boundary will require permits from this office. At this time we are requiring that
you contact our office for a final inspection prior to issuance of a Certificate of
Occupancy by the Building Dept.

Dear Mr. Ludlow:
The Southold Town Board of Trustees reviewed the survey prepared by John T.
Metzger last dated January 8, 2006 and determined the proposed demolition of the
existing dwelling and construction of a new dwelling to be out of the Wetland jurisdiction
under Chapter 275 of the Town Wetland Code and Chapter 111 of the Town Code.
Therefore, in accordance with the current Wetlands Code (Chapter 275) and the
Coastal Erosion Hazard Area (Chapter 111 ) no permit is required. Please be advised,
however, that no construction, sedimentation, or disturbance of any kind may take place
seaward of the tidal and/or freshwater wetlands jurisdictional boundary or seaward of
the coastal erosion hazard area as indicated above, or within 100' landward from the
top of the bluff, without further authorization from the Southold Town Board of Trustees
pursuant to Chapter 275 and/or Chapter 111 of the Town Code. It is your responsibility
to ensure that all necessary precautions are taken to prevent any sedimentation or other
alteration or disturbance to the ground surface or vegetation within Tidal Wetlands
jurisdiction and Coastal Erosion Hazard Area, which may result from your project. Such
precautions may include maintaining adequate work area between the tidal wetland
jurisdictional boundary and the coastal erosion hazard area and your project or erecting
a temporary fence, barrier, or hay bale berm.
This determination is not a determination from any other agency.

My Name is Thomas Ludlow and I am acting on behalf of Mr. Tom Neafsey
concerning his residence located at 380 Sunset Path, Southold, NY 11971. The tax map
number for this property is #1000-54-01-18. I am requesting a letter of non jurisdiction
concerning the proposed tear down of an existing residence and construction of a new
single family residence. I believe this property is landward of the coastal erosion line and
more than 100' from any wetlands. The board has recently reviewed the neighbors
residence at 480 Sunset Path and found it to be beyond thief jurisdiction. Please find
enclosed a survey dated January 8, 2006, depicting the existing conditions of the property
and the proposed residence, along with a letter authorizing me to act on the owners behalf
