NY 11971 RECEIVED OCT 3 1 2008 FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF OCTOBER 16, 2008 ZBA # 6188 - Richard Manfredi, Applicant Property Location: 240 Sunset Path, Southold CTM 54-1-19 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. PROPERTY FACTS/DESCRIPTION: The applicant's property has 60 feet along Hilltop Path (private road) and extends 184.39 linear feet to the rear lot line, 30 feet wide, by 163.66 linear feet along the remaining side lot line, as shown on the March 16, 2005 survey, updated July 10, 2008, by John T. Metzger L.S. BASIS OF APPLICATION: This is an appeal of the Building Inspector's June 10, 2008 amended Notice of Disapproval concerning an application for a building permit to construct additions and alterations to the existing single-family dwelling, which new construction will constitute an increase in the degree of nonconforming single side yard at less than 10 feet, less than 25 feet on total side yards, that is required under Zoning Code Sections 280-122 and 280- 124 (ZBA Interpretation #5039 - R. Walz, Applicant). LWRP: TOWN CODE CHAPTER 268: This application is exempt under Section 268-3, also confirmed in a memorandum to the Board of Appeals dated August 20, 2008 from the Town LWRP Coordinator. Page 2 - October 16, 2008 ZBA # 6188 - Richard Manfredi, Applicant CTM Parcel No. 1000-54-1-19 FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on August 21, 2008 and reopened for a hearing held on September 25, 2008, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicant's is requesting a variance for an addition and alterations to the existing dwelling as shown on the A-1 elevation drawing dated 6- 3-08 prepared by Architecnologies. AMENDED APPLICATION: During the August 21, 2008 hearing, the applicant's architect stated that his client agrees to clip the gable ends which reduces the overall height of the proposed addition by one foot. Following testimony, the August 21, 2008 public hearing was concluded, pending receipt from the applicant's architect of the modification as discussed during the hearing. ADDITIONAL INFORMATION: On August 22, 2008, the applicant's architect submitted the elevation drawing dated 8-22-08, as requested by the Board at the August 21, 2008 hearing. The map shows the elevation at 31'9" at its highest measurement and showing less height at the gable ends which were clipped with less volume. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Town Law §267-b(3)(b)(3)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties because the applicant is constructing a residence in a second-floor to the existing house at variable heights. The house is in a residential neighborhood with similar size homes. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance because any addition to this house will require a variance on this lot. 3. Town Law §267-b(3)(b)(3). The variance granted herein is substantial representing more than 50% increase in volume on the second floor of the existing building. That increase in volume will not cause additional impact on the neighborhood beyond what an addition not requiring a variance for volume would have. 4. Town Law §267-b(3)(b)(5). The difficulty has been self created. 5. Town Law §267-b(3)(b)(4). The Board has determined evidence that has been submitted to suggest that a variance in this residential community will have an adverse impact on the Page 3 - October 16, 2008 ZBA # 6188 - Richard Manfredi, Applicant CTM Parcel No. 1000-54-1-19 physical or environmental conditions in the neighborhood is insufficient to affect the outcome of the application. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an addition at their property, while preserving and protecting the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dinizio, seconded by Member Simon, and duly carried, to GRANT the variance as applied for, as shown on the A-4 Drawing prepared 8-22-08 by Architecnologies, and the surveyor's site map dated July 10, 2008, prepared by John T. Metzger, L.S. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. The address of my property is 415 Hilltop Path. I spoke at the hearing on August 21, objecting to the proposed height of the roof line that would exist in non-conforming areas. Mr. Manfredi and his architect agreed to make modifications that would reduce the height. On Friday, August 24th, I reviewed their proposed changes at the ZBA office and found they do not address my concerns. At that time, I also became aware for the first time of the ZBA's interpretation in Walz (#5039) of what constitutes an increase in the degree of non-compliance. The interpretation is based on the volume of the structure, and not the foot print or square footage which were the only things discussed and seemed to be of importance at the heating. No volume measurements were made available for public comment. Therefore the public was not made aware of the degree of increased non- compliance. Based upon a volume evaluation, I estimate that the proposed increase in non-compliance of the Manfredi residence is over 200%. The proposed changes by Manfredi following the hearing will drop the increase in non-compliance by less than 5%. Not a big change! Much of the increase in non-compliance volume is in unusable space in the attic. I think a significant reduction could be made to the non-compliant volume while maintaining or actually increasing the usable living space in the residence, simply by changing the roof line as shown on the enclosed sketches. This approach would provide Mr. Manfredi with all of the living space he has requested. It would eliminate unusable space that is in non-compliance. This change to the roof line would also decrease the height of the side walls which are four feet and seven feet from the property lines making them less onerous to the neighbors. This approach could also eliminate the need for the skirt roofs on the sides of the residence which stick out fxom the side of the house by 18 to 24 inches. With less then a four foot side yard, it's difficult to get a ladder 30 feet up with only two feet of horizontal space. These skirt roofs add to the volume of non-compliance with no useful function, while increasing safety issues during construction and maintenance. I would appreciate your consideration of these points. They provide Mr. Manfredi with the space and floor plan requested while significantly reducing the increase in non- compliance. The Standards used by the ZBA state that the Board "shall grant the minimum variance it shall deem necessary and adequate and at the same time preserve and protect the character of the neighborhood and health, safety and welfare of the community." I believe my recommendations support that Standard, and reflect proper evaluation of the five considerations used in making a variance determination. We enjoy the tranquility and savor each day here winter, summer, fall and spring. Unfortunately, our small compound has been less than tranquil the past several years due to the constant "home improvements" that have been taking place. We are a dismayed that we now find ourselves in the awkward position of having to go against our neighbor's wishes in order to try to preserve what's left of this serene spot and what's left of our view of the Long Island Sound that we have enjoyed over the years. We would like to preface our list of objections to this variance by stating that yes, we did expand our small house in the past as well. We went from a 2-story 24 x 24 foot house to a 2 stow 48 x 48 foot house. Our reasons for obje~g to this variance are not a c~ of "we got ours but we don't wa~l"you to get yours" as Mr. Mantl~i recently stated. Our small addition blocked no one's view and was built at a time when there were virtually no other year-round home owners residing in the neighborhood. Furthermore our entire remodeling process was completed in just four months start to finish. Since then, the Manfredis' have contributed mightily to a stretch of home alterations and construction that now approaches 5 full years of continuous construction work taking place on three sides of our lot. This on-going work has involved extensive remodeling, security camera installations, ever present port-a-potties, landscaping, months of stone cutting for wall construction, erection of fences, sprinkler systems, excavation, satellite dish installation and construction material delivery trucks arriving and departing. At one time there were literally 14 construction or remodeling related vehicles on the premises at one time. By way of offering some small background we would like to point out the monolith [pictured here] currently being erected next to the Manfredi house in question since its existence has precipitated our current situation. At the time of our addition we were instructed that new construction or additions were to be kept in proportion to existing homes in the vicinity. Our builder made sure that our addition did just that. Somehow, in their wisdom, the building department found Mr. Neafsy's McMansion to be an appropriate representation of good taste and in line with the surrounding neighborhood structures. We were as horrified as the Manfredis that this aberration had somehow been permitted to be constructed. We are all in complete agreement on that issue. As sometimes happens with neighbors, Mr. Manfredi and Mr. Neafsey, have shared a rather intense dislike of each other for at least as long as we have been here. About the only thing these gentlemen seem to agree upon is the desire to build large structures too close to wetlands. We don't know or care about the root causes of this conflict but have been witness to ongoing flare ups such as Mr. Neafsey plastering his property with "no trespassing" signs facing the Manfredi house and Mr. Manfredi erecting a very tall bright white plastic fence on the border shared with Mr. Neafsey. We believe Mr. Manfredi's motivation in wishing to substantially expand this particular residence is nothing more than an opportunity to win the "mine's bigger than yours" argument once and for all. Unfortunately for us, his winning the argument will unduly affect us, not Mr. Neafsey. Mr. Manfredi has stated that he needs more room in the house in question. The Manfredis have had ample opportunity during their years of construction to increase living space in one, two or all of the three houses they own within this tiny compound of seven homes. If this variance is granted it will be the second time in two years that this same house would be under renovation. If this variance is granted, Mr. Manfredi might very well have the last word in his possibly decades long disagreement with his neighbor. However it is we who will suffer the collateral damage measured in still higher property taxes, considerable loss of view, depreciation of our house's value and months more of unceasing hubbub. This small group of houses is serviced by a single lane unpaved road which contains two blind curves which run parallel to the wetlands. When one car enters, an oncoming car needs to back up to allow passage. (This factor was also apparently ignored by the building department when approval was given to the Neafsey's monster house). Navigating the treacherous curves takes a leap of blind faith. The enormous number of trade vehicles and even some of our neighbors, drive on these roads at unsafe speeds. Avoidance of a large construction vehicle did eventually cause one accident which cost us approximately $2000. It is inevitable that this will soon happen again. Increased house expansion can only increase the number of cars and the amount of daily and hourly traffic. We would also like to point out that one side of the house targeted for Mr. Manfredi's expansion is precisely 47 inches from our property line. Work on this face of the proposed addition would seemingly require placing ladders on our lawn. This will provide a strong possibility of accumulated construction debris, cigarette butts, coffee cups and damage to lawn and shrubs in addition to the general lack of privacy. We also fear for our dog's safety since he is confined to the same area where the building would occur. Each of the Manfredi's two other houses in the immediate vicinity could be substantially expanded without affecting anyone's view. All of the above difficulties could easily be avoided if the Manfredis' would simply expand one or both of their two other houses. Though we would again be subjected to months more of hubbub next door, we would withhold any objection to such a plan. We would do so with regret because of still more months of chaos it would bring in the neighborhood but it would be a suggested compromise. We do not begrudge the Manfredis' their plethora of houses (one for sale in Syosset, three next door to us and a fifth in East Marion presently planned) but wish to suggest that a need for space is not so severe as to require blocking our view to achieve. We have enjoyed a wonderful friendship with Mary (Mrs.) Manfredi. Short of not objecting strenuously to this proposal there is nothing we wouldn't do for her. Indeed in the past months Mr. Manfredi has been particularly friendly as well. We are greatly saddened at the thought that our objecting to this variance will end a pleasant relationship and 4 do so with regret. However, at long last it's time to say let's please, please stop the madness here. We thoroughly object to this proposal and do not believe placing another oversized structure next to us is for the sake of anyone's advantage except Mr. Manfredi's. It is unfortunate for both the Manfredis and us that we were not allowed the opportunity to voice our feelings regarding the Neafsy's motel size mansion on a postage size piece of land. Two wrongs, however, do not make a right. In asking that you grant this variance Mr. Manfredi has, in essence, asked you, the ZBA, to take things of value from us, i.e., a significant portion of our view of LI Sound, a corresponding lessoning of the value of our home while causing another property tax increase, as well as some at long last tranquility, without providing us the slightest corresponding trade off Or compensation. He gains the view that he takes from us and we lose a significant portion of our views of the sunset and water that we have treasured so much over the years. It is our understanding that zoning laws exist to set standards for the public good. The laws governing variances were designed to allow a private citizen, when unduly impacted by zoning laws, to avoid the application of certain aspects of zoning regulations in cases in which the variance would not harm the public good. This is not the case here. You are being asked to go outside the capacity dictated for the zoning board and allow Mr. Manfredi to take things of value from us and add things of value to himself. We respectfully ask that you vote no to Mr. Manfredi's application for a variance for any one or all of the reasons stated above. Those reasons are once more: 1] The proposed addition will be too close to wetlands as is the Neafsey house. 2] Mr. Manfredi has clear options in the immediate area as to where he can add living space (we have agreed to endure still more months construction on either of the other two homes as a compromise). 3] We very strongly suspect, and there are clear indications, that this proposed expansion is based more on vanity than need. 4] The proposed expansion will detract from our home value, cause an increase in our taxes and significantly lesson our enjoyment of our only residence. 5] We are fully and completely tired of the continuous and ongoing construction projects on either side of our lot.
