Down's Farm Preserve
A meeting of the Southold Town Conservation Advisory Council was held Wed., April 15,
2009 at Down's Farm Preserve.

CALL TO ORDER
Chairman Don Wilder called the meeting to order at 4:40 PM.
REPORTS
Chairman Don Wilder asked for the status of the mooring inventory. Member Peter Young
reported that the Bay Constable and the vessel will not be available until June and
questioned whether the Council should pursue starting the inventory sooner or just wait
until June. The members agreed that the mooring and boats usually aren't in the water
until Memorial Day weekend, therefore starting the inventory in June would make sense.
Trustee Dave Bergen suggested the pulley and stake inventory be done now since a boat
isn't necessary. The inventory can also be done using binoculars, however, there won't be
any GPS coordinates. Member Jack McGreevy questioned whether or not they could use
a private boat with reimbursement of costs. Trustee Bergen said he would pursue the
reimbursement and liability issues with the Town Attorney.
There has been some confusion as to the CAC members serving on Town Committees.
Chairman Wilder said he would send a memo to the Town Board recommending the
appointment of James Eckert to the Stormwater Run-off Committee and Jack McGreevy
to the LWRP Committee.
NEW BUSINESS
Chairman Don Wilder reported that no applications were received for the recently
advertised CAC member vacancy.
Trustee Dave Bergen reported that the Town has selected a student intern, who is a
Senior in college studying environmental science, to assist the Town with mapping and
other work related to stormwater run-off. The internship is connected to grant funding.
Trustee Bergen stated that the Town recently received the report from the Dept. of State
regarding the delegation of authority from the Town Board to the Board of Trustees. The
letter stated that the Town Board did in fact have the authority to delegate authority to the
Board of Trustees. A copy of the report is available to the public.
Member Peter Young commented on the proposed amendments to' Chapter 275 set for
public hearing on Tues., April 21 st. He presented his changes, however Trustee Bergen
suggested he present them to the Town Board at the public hearing.
Member Jack McGreevy distributed two draft memos to the members for their review. The
first memo was concerning the need to dredge Down's Creek. The members suggested
revisions be made and Chairman Wilder agreed to make the changes and forward to the
Town Board. The second memo was concerning the NYS Licensing of Saltwater Fishing.
The majority of the members agreed to not send the memo as written, however, Chairman
Wilder offered to re-write the memo and forward to the Town Board.

Moved by James Eckert, seconded by Peter Young, to Approve the Minutes of March 11,
2009.
DISCUSSION AND RECOMMENDATION OF WETLAND PERMIT & COASTAL
EROSION PERMIT APPLICATIONS
Moved by Don Wilder, seconded by Peter Young, it was
RESOLVED to SUPPORT the Wetland Permit application of TIMOTHY & DEBORAH
BEAUMONT to construct a single-family dwelling and attached garage containing 7,565
sq.ft., proposed detached garage 506 sq.ft., entryway 260 sq~ft., covered terrace 585
sq.ft., rear terrace with retaining walls 4,500 sq.ft., four (4) pergolas, masonry retaining
wails 326 sq.ff., bluestone and cobble entry court 375 sq.ft., gravel court 3,500 sq.ft.,
asphalt court 2,400 sq.ft., a porte-cochere 200 sq.ft., gravel driveway 7,500 sq.ft., gate
house 225 sq.ft., and a wood bridge 760 sq.ft.

The CAC Supports the application with the Condition of a 100, non-disturbance buffer
from the top of the bluff, and the requirement of a detailed landscaping plan.

Moved by Doug Hardy, seconded by Jack McGreevy, it was
RESOLVED to SUPPORT the Wetland Permit application of KELLY MYERS to construct
a 633 sq.ft, deck at the rear of the dwelling.

The CAC Supports the application with the Condition non-treated lumber is used on the
deck. The CAC further recommends a clean-up of the hazardous dock that is grounded on
bottom and the impassable ramp.

RESOVLED to SUPPORT the Wetland Permit application of MADELINE DROEGE to
construct exterior stairs from the second floor deck to grade.

The CAC Supports the application with the Condition the existing gravel non-turf buffer is
continued across the top of the bluff, set back from the grass line, non-treated lumber is
used, and drywells are installed to contain the pool backwash and the roof run-off.

RESOLVED to SUPPORT the Wetland Permit application of JOHN & KATHLEEN
BERKERY to remove the existing sunroom, create a porch area on the south side, add an
entry roof on the east side and an outside shower on the west side, interior alterations,
new windows, doors, siding and roofing.

RESOLVED to SUPPORT the Wetland Permit application of ISKENDER EREY &
ANGELICA BENGOLEA to construct a first-floor addition on the landward side of the
existing dwelling and expand the second-floor within the existing footprint, create deck
over the existing sun porch, and install new windows, exterior doors, siding and roofing.

RESOLVED to SUPPORT the Wetland Permit application of NEW SUFFOLK SHIPYARD,
LLC to remove the existing (1) 4K gallon single wall fiberglass storage tank; install (1) 4K
gallon double wall steel above ground storage tank; and install (2) 2' deep drywells and +/-
153 If. roof gutters with downspouts to redirect roof run-off from draining into water beyond
bulkhead into drywells.

RESOLVED to SUPPORT the Wetland Permit application of SILVANA CADEDDU to
construct approx. 70 linear ft. of vinyl bulkhead in place of existing timber bulkhead;
temporarily remove existing ramp and float and reconstruct (in-kind/in-place) existing 4'X
4.5' cantilevered deck; incidentally dredge to a maximum depth of -5 ALW an area up to 8'
off the bulkhead; and remove existing patio over abandoned boat ramp to be filled with
approx. 18 cy. resultant sand/silt spoil and approx. 7 cy. clean sand to be trucked in from
an upland source.

RESOLVED to SUPPORT the Wetland Permit application of WILLIAM & MARY STEELE
to remove a portion of the existing rear deck and construct a 16'X 18' addition to the
dwelling.

A vicious dog prevented the CAC members from entering the property, therefore no
recommendation was made.

RESOLVED to SUPPORT the Wetland Permit application of PHILIP STANTON to remove
the existing dock and construct approx. 35' to the east a new fixed timber dock consisting
of a 4'X 53' fixed catwalk, 3'X 14' hinged ramp, and a 6'X 20' "L" shaped float secured by
(2) 8" dia. pilings.

The CAC Supports the application with the Condition the discharge pipes are addressed,
and the proposed dock alignment doesn't exceed 1/3 across the width of the creek.

DISCUSSION AND RECOMMENDATIONS OF APPLICATIONS TO AMEND PERMITS
Moved by Doug Hardy, seconded by James Eckert, it was
RESOLVED to NOT SUPPORT the application of DON JAYAMAHA to Amend Permit
#6437 to increase the length of the fixed open walkway from 55' to 83'.

The CAC does Not Support the application and recommends a mooring and a small
dinghy dock, or use of the marina across the creek.

Moved by Don Wilder, seconded by Peter Young it was
RESOLVED to SUPPORT the application of JAY MANDELBAUM/1690 BAYVlEW
ASSOCIATES, LLC to Transfer Permit #-620 from Roger and Dorothy Lamour to Jay
Mandelbaum/1690 Bayview Associates, LLC, as issued on May 27, 1988, and to Amend
Permit #620 to increase the length of the dock from one 6'X 20' floating dock to two 6'X
20' floating docks.

The CAC Supports the revised plan to move pilings and one floating dock an additional 6'
from the bulkhead, with the Condition non-treated lumber is used and a 10' non-turf buffer

Member James Eckert will attend the next regular meeting of the Board of Trustees
scheduled for Wed., April 22, 2009.
The next meeting of the Conservation Advisory Council has been set for Wed., May 13,
2009 at 4:30 PM at Down's Farm Preserve.
There being no further business to come before the Council, the meeting was adjourned
at 6:30 PM.
