CJ�-Gh Jt � +uy 1I�135- xi party of the second part, WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land..with the buildings and improvements thereon erected, situate, lying and being in the SEE SCHEDULE A ATTACHED ; TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center tines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part. the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires. TOGETHER with all the right, title and interest of the party of the first part of, in and to the lands under water of Haywaters Cove in front of and adjacent to the above described premises. TOGETHER with all the right, title and interst of the party of the first part of, in and to Haywaters Road in front of and adjacent to said premises to the center line thereof. Reserving unto the party of the first part, her heirs, distributees and assigns, the right to maintain a cesspool on the premises hereby conveyed for the use and benefit of other premises now owned by the party of the first part adjacent to the premises hereby conveyed, together with an easement of access over the premises hereby conveyed to said cesspool for the purpose of cleaning and maintaining the same, and to maintain an undergound pipe or waste line from said premises of the party of the first part to said cesspool. Being part of lot #32 Peconic Bay Properties Inc. , Map No. 786, on the 'N' map for the Town of Southold. Subject to covenants and restrictions in Liber 1443 of Conveyances at page 169 and Liber 1197 of Conveyances at page 199; reservation in Liber 2931 at page 202; and telephone agreement in Liber 1000 at page 431 and Liber 1968 at page 325 to the extent the same are in force and effect.
