Martin Sidor: Good evening and welcome to the April 13 meeting of the Southold Town
Planning Board. For our first order of business, I will entertain a motion to set Monday,
May 11, 2009 at 6:00 p.m. at the Southold Town Hall, Main Road, Southold, as the
time and place for the next regular Planning Board Meeting.

23,490 sq. ft. self-storage building on a 47,166 sq. ft. parcel in the Light Industrial
Zoning District located on the west side of Commerce Drive, approximately 475 feet
south from Corporate Road, in Cutchogue. SCTM#1000-96-1-1.2

WHEREAS, this site plan is for the construction of a 23,490 sq. ft. self-storage building on a
47,166 sq. ft. parcel in the Light Industrial Zoning District located on the w/s/o Commerce
Drive, approximately 475' s/o Corporate Road, in Cutchogue, SCTM#1000-96-1-1.2; and
WHEREAS, an application for a site plan was submitted on December 01,2008, including
the site plan prepared by David A. DiGiovanni R.A., dated November 17, 2008; and
WHEREAS, on January 05, 2009 the Southold Town Planning Board accepted the
application for review; be it therefore,
RESOLVED, that the Southold Town Planning Board, pursuant to Part 617, Article 6 of
the Environmental Conservation Law acting under the State Environmental Quality
Review Act, initiated the SEQR lead agency process for this unlisted action on January
6, 2009;

CONSERVATION SUBDIVISIONS, STANDARD SUBDIVISIONS, RE-
SUBDIVISIONS (Lot Line Changes)
Final Determinations:
Jacoby Family Limited Partnership - This proposal is for a conservation subdivision
of a 10.454-acre parcel into three lots where Lot 1 equals 46,790 sq. ft. and the
clustered subdivision open space of Lot 1 is equal to 34,777 sq. ft. and is located within
Conservation Easement Area (3); Lot 2 equals 64,687 sq. ft. and the clustered
subdivision open space of Lot 2 is equal to 35,306 sq. ft. of which 18,638 sq. ft. is
located within Conservation Easement Area (2); and Lot 3 is equal to 343,890 sq. ft. of
which 291,209 sq. ft. is subject to a Suffolk County Conservation Easement, and the
remaining area consists of subdivision open space. The property is located atthe

Conditional Final Plat Approval have been satisfied and that the requirements for
subdivision approval pursuant to Chapter 240 of the Town Code have been fulfilled by
the applicant; be it therefore
RESOLVED, that the Southold Town Planning Board hereby grants Final Plat
Approval upon the map entitled "Clustered Conservation Subdivision for the Property

31.0137 acres into four lots where Lot 1 equals 25.7355 acres, from which the
Development Rights are proposed to be sold to Suffolk County for the purpose of
farmland preservation; Lot 2 equals 2.379 acres; Lot 3 equals 2.6488 acres, and Lot 4
equals 1 acre, all in the R-80 Zoning District. The property is located on the north side
of NYS Route 25, approximately 831' west of Rocky Point Road in East Marion.

prepared by John T. Metzger, L.S. dated April 21,2005 and last revised on August 28,
2006; and
WHEREAS, on February 12, 2007, the Southold Town Planning Board acting under the
State Environmental Quality Review Act pursuant to 6 NYCRR Part 617, Section 617.7,
established itself as lead agency for this unlisted action and, as lead agency, granted a
Negative Declaration for the proposed action; and
WHEREAS, on February 12, 2007, the Southold Town Planning Board granted
Conditional Sketch Approval upon the map prepared by John T. Metzger, L.S., dated
April 21,2005 and last revised on August 28, 2006; and
WHEREAS, on October 11, 2007, a New York State Department of Environmental
Conservation (NYS DEC) Permit was issued for the proposed conservation subdivision;
and
WHEREAS, on August 12, 2008, the Southold Town Planning Board granted a retro-
'active extension of Conditional Sketch Approval upon the map prepared by John T.
Metzger, L.S., dated April 21,2005 and last revised on August 28, 2006, from August
13, 2007 to February 11, 2009; and
WHEREAS, on November 21,2008, Suffolk County Department of Health Services
issued a permit for the proposed conservation subdivision; and
WHEREAS, all the conditions of Conditional Sketch Approval have been met; and
WHEREAS, on December 3, 2008, an application for Final Approval was submitted;
and
WHEREAS, on February 9, 2009, a public hearing was held and closed on the Final
Map; and
WHEREAS, on March 5, 2009, the applicant submitted a final Declaration of Covenants
and Restrictions; be it therefore
RESOLVED, that the Southold Town Planning Board hereby grants Conditional Final
Approval upon the map prepared by John T. Metzger, L.S., dated April 21, 2005 and
last revised on August 28, 2006, subject to the following conditions:

1. Submission of a revised final map with the following changes:
a. Show building envelopes for each of the lots.
b. Provide amended drainage calculations which reflect a run-off coefficient
for stone blend roads as 0.6. Drainage designs must meet the minimum
requirements of Chapter 236 for Storm Water Management.
c. Provide six (6) copies of the Road and Drainage Plan.
d. Indicate the top of the bluff line on the map as approved by the Planning
Board.
e. Indicate adequate turn-around with a turning radius of at a minimum 44' in
front of Lots 2 and 3 to allow for efficient movement of emergency
vehicles.
f. Add a note which states that in the event that the Development Rights
Sale is not completed pursuant to the approved subdivision map and a
copy of the recorded Deed of Development Rights Easement is not
submitted to the Town of Southold Planning Department, the Planning
Board's approyal of the subdivision shall no longer be valid.
g. Add a note which states that the Town of Southold Building Department
shall not issue building permits for any of the lots on the approved
subdivision map until the Development Rights Sale is completed pursuant
to the approved subdivision map and a copy of the recorded Deed of
Development Rights Easement submitted to the Town of Southold
Planning Department.
Provide a Road Maintenance Agreement to the Planning Board.
Provide a performance bond estimate for the subdivision pursuant to Article IX,
§240-31 & §240-32 of the Southold Town Code.
Provide a copy of all utility easements and water main easements to the
Planning Board.
Provide a statement indicating that the Declaration of Covenants and
Restrictions have been filed in the County Clerk's Office showing liber and page
numbers and that such covenants and restrictions affect the subdivision and the
properties within it.
Ensure adequate permitting is in place prior to commencing any construction
from NYS Department of Environmental Conservation (DEC) under the Phase II
State Pollution Discharge Elimination System (SPDES) Program as the
proposed disturbance resulting from construction activities and grading of this
site will be greater than one (1) acre.
Ensure the Developer obtains coverage under the General Permit for Storm-
water Run-off from Construction Activity (GP-02-01) prior to the initiation of
construction activities.

Conditional Preliminary Determinations:
Adipietro~ Robert - This proposal is for a standard subdivision of a 2.038-acre parcel
into three lots where Lot 1 equals 20,229 sq. ft., Lot 2 equals 29,817 sq. ft., and Lot 3
equals 29,291 sq. ft. in the HB Zoning District. The property is located at 2980 Peconic
Lane on the east side of Peconic Lane, approximately 333 ft. south of County Road 48
in Peconic. SCTM#1000-74-3-16
William Cremers: WHEREAS, this proposed standard subdivision is to subdivide a
2.038-acre parcel into three lots, where Lot 1 equals 20,229 sq. ft., Lot 2 equals 29,817
sq. ft. and Lot 3 equals 29,291 sq. ft., in the HB Zoning District; and
WHEREAS, an application for sketch approval was submitted on February 28, 2007,
including the sketch plan prepared by John T. Metzger, L.S., dated June 24, 2005 and
last revised on April 16, 2007; and
WHEREAS, on February 15, 2007, the Suffolk County Water Authority issued a Letter
of Water Availability for the proposed action; and
WHEREAS, on August 13, 2007, the Southold Town Planning Board started the
SEQRA lead agency coordination process for this Unlisted Action; and
WHEREAS, on August 15, 2007, the applicant submitted a revised sketch plan
prepared by John T. Metzger, L.S., dated June 24, 2005 and last revised on May 8,
2007; and
WHEREAS, on November 15, 2007, the Southold Town Planning Board issued a
Negative Declaration for the action pursuant to 6 NYCRR Part 617, Section 617.7; and
WHEREAS, the Southold Town Planning Board reviewed the revised sketch plan at
their Work Session on September 4, 2007 and found that sufficient information had
been submitted to issue Conditional Sketch Approval; and
WHEREAS, the Southold Town Planning Board granted Conditional Sketch Approval
on the map prepared by John T. Metzger, L.S., dated June 24, 2005 and last revised on
May 8, 2007, subject to conditions and the conditions have been met; and

WHEREAS, on June 4, 2008, the Suffolk County Planning Commission reviewed the
proposed action and responded with one comment; and
WHEREAS, the Southold Town Planning Board incorporated the Suffolk County
Planning Commission's comment in the subdivision design; and
WHEREAS, on November 12, 2008, the Southold Fire District determined that fire
protection for the proposed action is adequate; and
WHEREAS, the Southold Town Planning Board held a public hearing on Monday,
December 8, 2008 at 6:05 p.m. on the Preliminary Plat prepared by Peconic Surveyors,
P.C., dated September 8, 2007 and last revised July 8, 2008; and
WHEREAS, the Southold Town Planning Board received public comments on the
proposed action; and
WHEREAS, the preliminary public hearing was closed on January 12, 2009; be it
therefore
RESOLVED, that the Southold Town Planning Board hereby grant Conditional
Preliminary Plat Approval upon the map prepared by Peconic Surveyors, P.C. dated
June 24, 2005 and last revised on July 8, 2008, entitled "Standard Subdivision for the
Property of Robert and Patrick Adipietro", subject to the following conditions:
1. Submission of Final Plat Application materials and fees including:
A copy of the cost estimate required under Article IX, Bonds and Other
Security, of this chapter and the road and drainage plan required under
§ 240-21C shall be forwarded to the Town Engineering Office for review and
compliance with Chapter 161, Highway Specifications, and other relevant
provisions of the Town Code.
2. Please amend the Final Plat accordingly:
a. Show existing trees greater than 18" DBH to be retained and clearing
limits pursuant to Section 240-46(C) of the Town Code;
b. Omit the reference to "Maintain existing hedge along north line of 25'
right-of-way";

c. Amendments as required by the Office of the Town Engineer:
The Curb Cut Plan as prepared by the office of John T. Metzger,
dated 2/5/09 is considered satisfactory with one exception. The
contractor must install a trench drain along the property line to
contain all run-off coming from the new roadway. Grade and invert
elevations must be indicated to verify adequate capacity of the
leaching pool. If the grade elevations allow, this road trench drain
must be connected to the existing leaching pool or, if grade
elevations are too Iow at the property line, a new leaching pool
must be installed.
ii.
The run-off coefficient for a Stone Blend road surface in the Town
of Southold is 0.6. The drainage calculations and the drainage
system indicated on the preliminary plat must be amended
accordingly.
iii.
Lot # 3 indicates a 15' buffer area. It also indicates a 10' side yard.
This side yard should be increased, at a minimum, to align with the
proposed buffer or meet the required setback established by ~
Zoning.
iv. In addition, please state the following condition on the final plat:
The Contractor must notify the Town of Southold Highway
Department in writing at least 24 hours before commencing
any work. All work within the Town Right-of-Way must be
inspected and approved by the Town Highway
Department.
Submission of final draft of the Declaration of Covenants and Restrictions
containing the following additional clauses:
"The Contractor must notify the Highway Department in writing at
least 24 hours before commencing any work. All work within the Town
Right-of-Way must be inspected and approved by the Town Highway
Department."
Replace Clause 16 with: "The use of synthetic herbicides, pesticides
and fertilizers on Lots 1,2 and 3 is prohibited." In addition, group the
restriction clauses to improve readability of the document.

SCTM#1000-78-9-78 will increase in size from 0.624 acres to 1.023 acres (44,587 sq.
ft.) in the R-40 Zoning District. The property is located at 1160 North Bayview Road,
111.56 feet northeast of Liberty Lane and Victoria Drive, Southold.

lots, where Lot 1 equals 29,869 sq. ft., Lot 2 equals 29,869 sq. ft., Lot 3 equals 29,869
sq. ft., Lot 4 equals 29,869 sq. ft. and the open space parcel equals 4.1 acres,
excluding the area of wetlands. This project includes the transferring of 37,882 sq. ft. of
buildable lands from SCTM#1000-53-4-44.3 onto the subject property for the purpose
of establishing yield. The property is located on the w/s/o Kerwin Boulevard,
approximately 575' w/o August Lane in Greenport. SCTM #'s 1000-53-4-44.1 & 44.3

area of wetlands. This project includes the transferring of 37,882 s.f. of buildable lands

WHEREAS, an application for sketch approval was submitted on October 24, 2008,
including a sketch plan prepared by Thomas K. Wicks, L.S and Thomas E. Murray, P.E.

WHEREAS, the Southold Town Planning Board reviewed the plans at their November
17, 2008 Work Session; and

11, 2008 last revised on January 26, 2009; be it therefore
RESOLVED, that the Southold Town Planning Board sets Monday, May 11, 2009 at
6:10 p.m. for a public hearing on the Preliminary Plat prepared by Thomas K. Wicks,
L.S. and Thomas E. Murray, P.E., dated January 26, 2009.

Peconic Land Trust (Ore~on Road) - This proposal is for a conservation subdivision
of a 12.5056-acre farm into two lots. Lot 1 will total 2.5056 acres with an existing
residence and the Development Rights will remain intact. Lot 2 will total 10 acres from
which the Town of Southold purchased the Development Rights in March 2007 for the
purpose of farmland preservation. The property is located at 3305 Oregon Road,
53' w/o Elijah's Lane on the n/s/o Oregon Road in Mattituck. SCTM#1000-94-3-1.3
William Cremers: WHEREAS, this proposed conservation subdivision is to subdivide a
12.5056 acre parcel into two lots. Lot 1 equals 2.5056 acres (with existing residence
and Development Rights intact). Lot 2 equals 10 acres from which The Town of
Southold purchased the Development Rights in March 2007 for the purpose of farmland
preservation; and
WHEREAS, an application for sketch approval was submitted on November 7, 2008,
including the sketch plan prepared by John C. Ehlers, L.S., dated October 6, 2008; and
WHEREAS, on December 8, 2008, the Southold Town Planning Board, acting under
the State Environmental Quality Review Act pursuant to 6 NYCRR Part 617, Section
617.7, determined that this is an Unlisted Action requiring an uncoordinated review; and
WHEREAS, on January 13, 2009 the Southold Town Planning Board established itself
as lead agency and, as lead agency, made a determination of non-significance and
granted a Negative Declaration; and
WHEREAS, Sketch Approval for this application was granted on January 13, 2009; and
WHEREAS, the Mattituck Fire District reviewed this application on January 15, 2009
and determined there was sufficient fire protection; and
WHEREAS, on February 20, 2009, an application for Final Plat Approval was
submitted, including the final plan prepared by John C. Ehlers, L.S., dated October 6,
2008 and last revised on February 17, 2009; be it therefore
RESOLVED, that the Southold Town Planning Board set Monday, May 11, 2009 at
6:15 p.m. for a public hearing on the Final Plat prepared by John C. Ehlers, L.S., dated
October 6, 2008 and last revised on February 17, 2009.
