BETWEEN MARION E. SMITH, residing at 103 East Caroline Street,
TavaRes, Florida 32778
party of the first part, and
MARION ELIZABETH SMITH, residing at 103 East Caroline
Street, TavaRes, Florida 32778, as Trustee of the MARION
ELIZABETH SMITH FAMILY TRUST, dated May 16, 1995
party of the second part,
WITNESSETH, that the party of the first part, in. consideration
of ten dollars and other valuable consideration paid by the second
part, does hereby grant and release uncu Lhe party of the second
part, the heirs or successors and assigns of the party of the
second part forever,
ALL that certain plot, piece or parcel of land situate in the
Village of Mattituck, County of Suffolk and State of New York, and
Town of Southold.
BEGINNING at a stake set on the southwesterly line of a certain
private road known as Laurel Way, at a point on said line 65 feet
southeasterly from the northeasterly corner of land of William
Hamilton;

Way, South 50 degrees OOE. -72.0 feet to a stake and other land of

BEGINNING.
Together with a right of way over said private road southeasterly,
then northeasterly, then northerly to Sound Avenue.
SUBJECT to any state of facts which an accurate survey might show.
SUBJECT to covenants, restrictions, reservations, easements, and
agreements of record affecting the foregoing described premises.
SUBJECT to zoning restrictions and ordinances adopted by any
municipality, town, village or other governmental authority.
BEING AND INTENDED TO BE the same premises conveyed to the grantor
by deed dated May 1, 1940 and recorded in the Suffolk County
Clerk's Office on August 16, 1940 in Liber 2116, page 212.
The above premises is not encumbered by a credit line mortgage.
TOGETHER with all right, title and interest, if any, of the party
