Southwesterly corner of the premises herein described, adjoining land of
RFL Properties; running thence North 42' 15' West along said land of RFL
Properties and through a concrete monument placed one foot northerly of the
northerly line of said Main Road 99.06 feet; thence South 37' 47' West 50
feet along said land of RFL Properties to a concrete monument and land of
Abatelli; thence North 41' 57' 50" West along said land of Abatelli 207.92
feet to a concrete monument and land of Mattituck-Cutchogue Union Free
School District; thence North 46' 28' 40" East along said land 123.76 feet
to a concrete monument and land of Colgate Design Corporation; thence South
48' 45' 10" East along said land of Colgate Design Corporation 280.54 feet
to a concrete monument and the northerly line of the Main Road; thence
along the northerly line of the Main Road three (3) courses and distances
as follows: (1) South 30° 20' 40" West 33.47 feet; (2) South 36' 25' 31"
West 35.01 feet; and (3) South 37' 02' 10" West 60.89 feet to the point or
place of BEGINNING.
BEING AND INTENDED TO BE part of the same premises conveyed to the
party of the first part by deed dated December 29, 1977 and recorded in the
Suffolk County Clerk's Office on December 30, 1977 in Liber 8368 Page 369.
TOGETHER with all right, title and interest, if any. of the party of the first part, in and to any streets and roads
abutting the above-described premises lo the center lines thereof; TOGETHER with the appurtenances and all the
e~;tate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein
granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the firsl part has nol done or suffered anything whereby
thc said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of Ihe first part, in compliance with Section 1 3 of the Lien LaW. covenants that the parly of Ibc
first part will receive the consideration f'or this conveyance and will hold the right to ,receive such consider-
ation as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to Ihe payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "parly" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
