The proposed additions and alterations to non-conforming accessory building, on this 2.479 acre parcel
in the R-80 District, are not permitted pursuant to Article III, Section 100-33B, which states;
"On lots containing in excess of seventy-nine thousand nine hundred and ninety-nine (79,999)
square feet, such buildings shall be set back no less than twenty (20) feet from any yard line."
The accessory building has an existing side yard setback of 4.6 feet and a proposed side yard setback
of 5.2 feet.
In addition, the proposed additions/alterations to the existing nonconforming single family dwelling
are not permitted pursuant to Article XXIII, Section 100-239.4A. 1., which states,
"All buildings located on lots adjacent to sounds and upon which there exists a bluffor bank
landward of the shore or beach shall be set back not fewer than one hundred (100) feet from the
top of such bluff or bank."
The proposed additions/alterations note a setback of 14 feet from the top of bluff at its closest point.
Total lot coverage, following the proposed addition, would be +/- 2 percent.

FINDINGS, DELIBERATIONS AND DETERMINATION
MEETING OF JANUARY 23, 2003

Property Location: 30185 Cabot Woods Road, Peconic; 1000-73.-4-1.
SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under
consideration In this application and determines that this review falls under the Type II
category of the State's List of Actions, without an adverse effect on the environment if the
project is implemented as planned.
PRQPERTY FACTS/DESCRIPTION: The applicant's 2.479-acre parcel is located on a
private right-of-way referred to as Cabot Wood Road, off the north side of Middle Road
(C.R. 48), in Peconic. The prope~y is improved with an existing one-story frame house
with wood decks and four accessory buildings, as shown on the on the June 29, 2000
survey, amended August 17, 2000, prepared by Joseph A. Ingegno, L.S.
BASIS QF APPLICATION: Building Department's August 22, 2002 Notice of Disapproval,
and Sections 100-33 and 100-230.4, denying a permit for (a) new additions and
alterations to the existing dwelling at less than 100 feet from the closest bluff line and (b)
a new accessory building in an area other than a rear yard.
FINDINGS OF FAST
The Zoning Board of Appeals held s public hearing on this application on December 12,
2002 and January 16. 2003, which time written and oral evidence were presented. Based
upon alt testimony, documentation, personal inspection of the property, and other
evidence, the Zoning Board finds the following facts to be true and relevant:
AREA VARIAN_CE RI~LIEF. REQUESTED: The original plan prepared by Samuels &
Stselman revised 8/21/02 proposed: (1) new additions and alterations to the existing
dwelling at 14' north at the top of the bluff and 24'11" east to the top of the bluff, and (2) to
demolish and build a new accessory garage (20' x 24') building at 6'7" from the side
property line. At the December 12, 2002 heating, the applicant through his architect
offered increased setbacks for both structures, and on January 15, 2003, applicants'
architect su~fl~ a revised site plan proposing the following revisions: (a) a northerly
setback a)((40 f~t from the top of the bluff for a new two-story frame residence with
basement ~ wood porch, after demolislaing the existing residence and filling the
foundation, and (b) s new 20' x 24' accessory building at 8 fl, from the side property line.

ADDITIONAL INFORMATION: Information was submitted by letter on December 12, 2002
~'rom the Suffolk County Soil & Water Conservation District confirming the bluff face is very
heavily vegetated overall, and although there are some glacial erratics and cobbles at the
toe of the bluff, there is protection at the toe.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials
su~ bmitted and personal inspections, the Board makes the following findings:
1. Grant of alternative relief will not produce an undesirable change in the character of the
neighborhood or a detriment to nearby properties. The setbacks of the dwelling will be
increased from the present setback of 14' to a minimum of 40 feet. The garage setback is
also increased from its present nonconforming location to · new location at 20 ft. in
conformity with the code for a side yard setback line. Visually, the garage is in front of the
dwelling and not in e side yard.
2. The benefit sought by the applicant cannot be achieved by some method, feasible
for the applicant to pursue, other than an ama variance.
3. The relief requested is substantial, but the grant of alternative relief reduces the amount
of relief necessary to utilize the existing ground areas that have been disturbed due to
existence of the existing dwelling construction and established landscaped areas.
4. The difficulty has been self-created, since the applicants became aware of the
conditions of the buildings, site and codes when the property wes purchased.
5. No evidence has been submitted to suggest that the alternative relief noted below will
have an adverse impact on the physical or environmental conditions in the neighborhood.
Applicants are proposing several drywells for adequate containment of roof runoff, and will
maintain good ground cover necessary to prevent erOsion or drainage toward bluff areas.
The applicant has obtained TnJstaes Coastal Zone Management Permit #5602 dated July
24, 2002.
6. Grant of the alternative relief is the minimum necessary and adequate to enable the
applicant to enjoy the benefit of a new home and garage, while presen/Ing and prOtecting
the character of the neighborhood and the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the
balancing test under New York Town Law 267-B, motion was offered by Chairwoman
Tortore, seconded by Member Olive, and duly carried to

GRANT the relief requested as applied for regarding the location of the new
dwelling construction as shown on the site plan prepared by Samuels & Steelman
revised 1/15103; and to
GRANT alternative relief to locate a new garage a minimum of 20 feet from the side
property line, and in the yard area shown on the site plan revised 1115/03.
This action does not authorize or condone any current or future use, setback or other
feature of the subject property that may violate the Zoning Code, other than such uses,
setbacks and other features as are expressly addressed in this action.

Based on the information you have submitted, the New York State Department of Environmental
Conservation has determined that:
The properly landward of the topographic crest of the bluff, labeled as the top of bluff on theplan
prepared by Thomas C. Samuels on 8/5/02 and based on the survey by Ingegno dated 6/29/00, is
beyond the jurisdiction of Article 25 (Tidal Wetlands).
Therefore, in accordance w th the current Tidal Wetlands Land Use Regulations (6 NYCRR Part
661) no perm t s requ red. Please be advised however that no construction, sedimentation, or
disturbance of any k nd may take p ace seaward of the tidal wetlands jurisdictional boundary, as
indicated above without a permit. It is your responsibility to ensure that all necessary precautions
are taken to I~revent any sedimentat on or other alteration or disturbance to the ground surface or
vegetation w~thin T da Wetlands jurisdiction which may result from your project. Such precautions
may include maintain!ng adequate work area between the tidal wetland jurisdictional boundary and
your project (i.e. a 15 to 20 wide construction area) or erecting a temporary fence, barrier, or hay
bale berm.

Recently you requested a Letter of Non-Jurisdiction or determination of No Permit Necessary from this
Depamnent. In many instances our lack of jurisdiction or permitting authority is clear. Your request
falls into this category.
Letters of Non-Jurisdiction never expire as long as the determining feature upon which the decision was
based, such as 300' distance from the tidal wetland, presence of a functional man-made structure, or
elevation contour still exists. Additionally, since the letter of Non-Jurisdiction is always issued for the
property and not to the owner, it is not necessary to transfer the letter to a new owner.
Certain activities are clearly not within our permitting authority such as interior renovations, installation of
alarm systems, new roof, windows, siding, painting, etc., and a permit for such activities is never
necessary from this Department.

-- a. This application MUST be completely filled in by typewhter or in ink and submitted to the Building Inspector with 3
sets of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets or
areas, and waterways.
c. The work covered by this application may not be commenced before issuance of Building Per,nit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such a permit
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. TherealSer, a new permit shall be required.

We have a Letter of Non-Jurisdiction for the above referenced project (enclosed). We
are currently in application for a building permit from the Town of Southold.
We have made a change in the project since the N JR was issued: we now intend (per
requirements of, and with permit from the Southold Trustees) to demolish the existing
house, and reconstruct it further back from the Long Island Sound. The new house will
still be constructed completely out of the DEC jurisdiction.
The town building permit administrator, Damon Ramon, has asked for a revised N JR
from your agency. Per my phone conversation with you today, I understand that you
will not issue another N JR, and that you will send a letter to Mr. Damon explaining why
it is unnecessary. Please make clear to him that, as a matter of general policy, letters of
non-jurisdiction are flexible enough to allow modifications to projects out of DEC
jurisdiction.

As per my meeting today with Mike, I understand that we must obtain a variance for the project,
as it supposedly increases the non-conformity of the sound-front bluff setback, by adding a
second floor, within the existing footprint, to an existing, non-conforming house with a valid pre-
CO.
Please write the disapproval for this application at your earliest convenience, that we may apply
to the ZBA for a variance.
