INSTRUCTIONS
a. This application MUST be completely filled in by typewriter or in ink and submitted to; the Building Inspector with 4
sets of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets or
areas, and waterways.
c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such a permit
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Thereafter, a nev~ permit shall be required.

FINDINGS, DELIBERATIONS AND DETERMINATION
MEETING OF AUGUST 16, 2007

Property Location: 1935 Pine Tree Road (at Little Creek), Cutchogue

SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under
consideration in this application and determines that this review falls under the Type II category of
the State's List of Actions, without further steps under SEQRA.
PROPERTY FACTS/DESCRIPTION: The applicants' property contains 1.054 acres with 180 feet
along Pine Tree Road, 248 feet along the south side lot line, and front along little Creek, portion of
which frontage contains a 56 ft. length of bulkhead, as shown on the March 29, 2002 survey
prepared by Nathan Taft Corwin III, L.S., updated July 17, 2007.
BASIS OF APPLICATION: Zoning Code Section 280-116B, based on the Building Inspector's May
24, 2007 Notice of Disapproval concerning new dwelling construction, after demolishing the existing
construction, disapproved for the reason that the new construction will be less than the code-
required 75 feet from the bulkhead.
SUFFOLK COUNTY ADMINISTRATIVE CODE: This application has been referred as required
under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County
Department of Planning reply dated July 25, 2007states that the application is considered a matter
for local determination as there appears to be no significant county-wide or inter-community impact.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on August 2, 2007, at which
time written and oral evidence were presented. Based upon all testimony, documentation, personal
inspection of the property, and other evidence, the Zoning Board finds the following facts to be true
and relevant:
LWRP: TOWN CODE CHAPTER 95: The Zoning Code requires 75 feet from the existing
bulkhead, and the applicant is proposing: 36 feet at its closest point (measured from the porch) to
bulkhead. This parcel is uniquely waterfront with a small cove (semi-circle). There is an extensive
non-turf buffer of overgrown, natural waterfront plants between the bulkhead and the upland area of
the raised deck attached to the existing home. The existing home has a gable roof, one-story with

log-cabin siding and has a shallow pitch of this parcel. As one of the conditions of this
determination, drywells are required to be installed landward of the proposed new home with its
additions or in the front yard (street side).
The record also indicates that no excavation of the entire foundation will occur because it would
disrupt the area closest to the established non-turf environmental buffer between the home/deck and
the existing bulkhead and dock construction. All new construction will be on the south side
(landward) of the existing nonconforming setback, father away from the non-turf environmental
buffer.
AREA VARIANCE RELIEF REQUESTED: Applicant is proposing substantial reconstruction and
enlargement of the existing 1~ story dwelling, while utilizing the existing basement under the old
storage rooms, maintaining a similar nonconformity for the setback to the dwelling, and reducing the
setback to allow for a small porch at 36 feet from the bulkhead. The deck areas are not the subject
of this application, although they are existing with nonconforming setbacks. The zoning code
requires 75 feet from the existing bulkhead for buildings and structures. The new construction is
shown on a Site Plan and Elevations Plans dated 5/24/07 prepared by Mark K. Schwartz, AIA
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and
personal inspections, the Board makes the following findings:
1. Grant of the variance will not produce an undesirable change in the character of the
neighborhood or a detriment to nearby properties. The applicant wishes to use the entire existing 8'
basement under the old storage rooms. The architect indicated that the proposed new construction
will be approximately 14.8' above grade to meet the FEMA and other code requirements. The
property contains an extensive non-turf buffer between the bulkhead and the existing rear deck. The
surrounding area consists of properties with homes at similar setbacks and similarly upgraded and
reconstructed.
2. The benefit sought by the applicant cannot be achieved by some method, feasible for the
applicant to pursue, other than an area variance. The existing smaller home is nonconforming at
41.4 feet from the bulkhead adjacent to Long Creek, and the applicant is proposing to utilize a
portion of the existing foundation, without excavation between the bulkhead and the wall of the
foundation that will remain. The applicant states that no excavation of the entire foundation will
occur because it would disrupt the area closest to the established non-tuff environmental buffer
between the home/deck and the existing bulkhead and dock construction. All new construction will
be on the south side (landward) of the existing nonconforming setback, father away from the non-turf
environmental buffer.
3. The variance granted herein is substantial. The existing 41.4 ft. bulkhead setback from the
dwelling construction is the maximum relief that the Board will allow, except for a small porch which
will be 36 feet at its closest point measured from the wood bulkhead.
4. The difficulty has not been self-created.
5. No evidence has been submitted to suggest that a variance in this residential community will
have an adverse impact on the physical or environmental conditions in the neighborhood. This is

walls closest to the bulkhead. It is also noted that he record shows the land is stabilized well, and
the applicant confirms the remaining foundation walls will support the 1~ story new portion of the
new home construction.
6. Grant of the requested relief is the minimum action necessary and adequate to enable the
applicant to enjoy substantial reconstruction of the existing single-family home utilizing the existing
basement under the old storage rooms, while preserving and protecting the character of the
neighborhood and the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing
test under New York Town Law 267-B, motion was offered by Member Goehringer, seconded by
Member Oliva, and duly carried, to
GRANT the variance as applied for, as shown on the survey prepared by Nathan Taft Corwin III,
L.S., updated July 17, 2007 and Site Plan and Elevations Plans dated 5/24/07 prepared by Mark
K. Schwartz AIA, subject to the following conditions:
As a buffer and to prevent water drainage, hay bales must be installed between the
construction site and the non-turf non-disturbance area between the house and the
wetlands.
2. All roof runoff must be placed into storm drains in the front yard (street side) of this
property.
3. That the accessory garage be used for accessory storage purposes only.
Any deviation from the variance given such as extensions, or demolitions which are not shown on the
applicant's diagrams or survey site maps, are not authorized under this application when involving
nonconformities under the zoning code. This action does not authorize or condone any current or future use,
setback or other feature of the subject property that may violate the Zoning Code, other than such uses,
setbacks and other features as are expressly addressed in this action.
The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that
does not increase the degree of nonconformity.

The portion of your property which is located landward of the ten foot (MSL) elevation contour
line as shown on the survey prepared by Joseph A, Ingegno last revised January 5, 2006, is
beyond the jurisdiction of Article 25 (Tide! Wetlands),
Therefore, in accordance with the current '~dal Wetlands Land Use Regulations (6NYCRR Part 661)
