JAMES R. WELLS JR. residing at 4455 Westphalia Ave, Mattituck, New York 11952
party of the second part,
WITNESSETH,that the party of the first part, in consideration of Ten Dollars and other valuable consideration paid
by the party of the second part,does hereby grant and release unto the party of the second part,the heirs or successors
and assigns of the party of the second part forever,
ALL that certain plot,piece or parcel of land,with the buildings and improvements thereon erected,situate,lying and
beinginshm at Mattituck, Town of Southold, Suffolk County, New York, known and
designated as parts of lots 36 and 37 on a certain map entitled, "Map of Lots
Located at Mattituck, Long Island, Property of William B. Codling, Surveyed
April, 1921, J.W. Wells, C.E. ," and filed in the Suffolk County Clerk's Office
on May 10, 1921 as Map Number 745, said parts of lots being more particularly
bounded and described as follows:
BEGINNING at a point on the westerly side of Howard Avenue, distant 120 feet
southerly from the corned formed by the intersection of the westerly side of
Tax Map Howard Avenue with the southerly side of Meday Avenue;
Designation THENCE South 76 degrees 31 minutes 10 seconds West 106.44 feet to the division
Dist.1000 line of lots 37 and 38 on said map;
THENCE along said division line South 6 degrees 23 minutes 00 seconds West
Sec. 113.00 120.29 feet;
THENCE North 73 degrees 23 minutes 50 seconds East 108. 16 feet to a point
Blk. 11.00 on the westerly side of Howard avenue, distant 114 feet southerly from the point
of beginning;
Lot(s) 007 THENCE North 06 degrees 23 minutes 00 seconds West along Howard Avenue, 114
feet to the point or place of BEGINNING.
Being and intended to be the same premises conveyed to the grantors herein
by deed dated 8/25/88 recorded 9/7/88 in Liber 10685 page 490.
TOGETHER with all right, title and interest, if any, of the party of the first part of, in and to any streets and roads
abutting the above-described premises to the center lines thereof; TOGETHER with the a6urtenances and all the
estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein
granted unto the party of the second part,the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the
said premises have been encumbered in any way whatever,except as aforesaid.
AND the party of the fust part,in compliance with Section 13 of the Lien Law,covenants that the party of the first part
will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund
to be applied first for the purpose of paying the cost of the improvement and will apply the slune first to the payment
of the cost of the improvement before using any part of the total of the same for any other purpose.
The word"party"shall be construed as if it read "parties"whenever the sense of this indenture so requires.
