WITNESSETH, that whereas letters testamentary were issued to the party of the first part by the Surrogate's
Court, SUFFOLK County, New York, on JUNE 24, 1996 and by virtue
of the power and authority given in and by said last will and testament, and/or by Article 11 of the Estates,
Powers and Trusts Law, and in consideration of TWO HUNDRED TWENTY THOUSAND AND 00/100

TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances,
and also all the estate which the said decedent had at the time of decedent's death in said premises, and also
the estate therein, which the party of the first part has or has power to convey or dispose of, whether individ-
ually, or by virtue of said will or otherwise; TO HAVE AND TO HOLD the premises herein granted unto
the party of the second part, the distributees or successors and assigns of the party of the second part forever, each
owning'-an undivided one-half• (1/2) interest as tenants in common.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been incumbered in any way whatever, except as aforesaid.
Subject tdthe trust fund provisions of section thirteen of the Lien Law.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.

SCHEDULE A
All that certain plot, piece or parcel of land with the buildings and improvements thereon
erected, situate, lying and being at Mattituck, Town of Southold, County of Suffolk and State
of New York, and bounded and described as follows:
COMMENCING at a point formed by the intersection of the easterly line of Bungalow Lane and
the northerly line of Park Avenue;
RUNNING THENCE north 52 degrees 20 minutes 40 seconds west along the easterly line of
Bungalow Lane a distance of 117.32 feet to a monument and land of Doctor Gerken;
THENCE north 62 degree 33 minutes 30 seconds east and passing the rough a concrete
monument a distance of about 247.25 feet to ordinary high water mark on Deep Hole Creek;
THENCE southerly along the ordinary high water mark of Deep Hale Creek to a point measured
along a tie line south 75 degrees 28 minutes 10 seconds east from the last mentioned course,
146.36 feet;
THENCE south 38 degrees 02 minutes 50 seconds west, 110.97 feet, to the northerly side of
Park Avenue;
THENCE south 72 degrees 52 minutes 50 seconds west, along the northerly side of Park Avenue
209.10 feet to the point or place of BEGINNING.
