BARGAIN & SALE DEED WITH COVENANT AGAINST GRANTOR'S ACTS
THIS INDENTURE, made the 25th day of November, 1996,
between JOHN B�HAYES� residing at 12 Fairway Drive, Fairway Farms,
Cutchogue- N.Y. 11935, Individually as to an Undivided One-Half
Interest and JOHN B. HAYES and BRIAN HAYES, as Co-Trustees of a
Testamentary Trust under the Last Will and Testament of MURIEL M.
HAYES as to the remaining 50% Undivided Interest, residing at 12
Fairway Drive, Fairway Farms, Cutchogue, N.Y. 11935, and 355
Lattingtown Road, Lattingtown, VY. 11560, respectively
("Grantor") , and STEVEN E. HARTMANN)'& NANCY $'- HARTMANN, His
Wife, both residing at 5270 Nassau Point Road, Cutchogue, N.Y.
11935 ("Grantee") .
WITNESSETH, that Grantor, in consideration of THREE
HUNDRED FIFTY THOUSAND and 00/100 ($350, 000. 00) DOLLARS paid by the
second part, does hereby grant and release unto Grantee and the
heirs, executors, administrators, legal representatives, successors
and assigns of Grantee forever,
ALL that certain plot, piece or parcel of land, with the
buildings and improvements thereon erected, situate, ly-
ing and being the Town of Southold, County of Suffolk and
the State of New York, being more particularly described
in Exhibit A attached hereto and made a part hereof,
TOGETHER with all right, title and interest, if any, of
Grantor in and to any streets and roads abutting the
above described premises to the center lines thereof,
TOGETHER with the appurtenances and all the estate and
rights of Grantor in and to said premises,
TO HAVE AND TO HOLD the premises herein granted unto
Grantee and the heirs, executors, administrators, legal representa-
tives, successors and assigns of, Grantee forever.
Grantors acquired title to the subject premises by Deed
dated March 15, 1995 and recorded May 23 , 1995 in Liber 11726, Page
384 .
Said premises is not located in an agricultural district.
Grantor covenants that Grantor has not done or suffered
anything whereby said premises have been encumbered in any way
whatever, except as set forth herein.
EXHIBIT A
ALL THAT CERTAIN PLOT, PIECE OR PARCEL OF LAND SITUATE, LYING AND BEING IN THE
TOWN OF SOUTHOLD, COUNTY OF SUFFOLK AND STATE OF NEW YORK KNOWN AND DESIGNATED
AS PART OF LOT 12 ON A CERTAIN MAP ENTITLED "MAP OF FAIRWAY FARMS", AND FILED IN
THE OFFICE OF THE CLERK OF THE COUNTY OF SUFFOLK ON 2/15/74 AS MAP NO. 6066,
SAID PART OF LOT BEING MORE PARTICULARLY BOUNDED AND DESCRIBED ACCORDING TO SAID
MAP AS FOLLOWS:
BEGINNING AT A POINT ON THE WESTERLY SIDE OF FAIRWAY DRIVE, AS WIDENED, WHERE
THE SAME IS INTERSECTED BY THE DIVISION LINE BETWEEN LOTS 11 AND 12 ON THE
AFORESAID MAP;
RUNNING THENCE FROM SAID POINT OR PLACE OF BEGINNING ALONG THE WESTERLY SIDE OF
FAIRWAY DRIVE, AS WIDENED, SOUTH 0 DEGREES 47 MINUTES 50 SECONDS WEST, 180.00
FEET TO THE DIVISION LINE BETWEEN LOTS 12 AND 13;
THENCE ALONG SAID LAST MENTIONED DIVISION LINE NORTH 89 DEGREES 12 MINUTES 10
SECONDS WEST, 220.59 FEET TO THE EASTERLY SIDE OF LAND NOW OR FORMERLY OF NORTH
FORK COMPANY;
THENCE ALONG THE EASTERLY SIDE OF SAID LAST MENTIONED LAND NORTH 0 DEGREES 47
MINUTES 50 SECONDS EAST, 180.00 FEET TO THE DIVISION LINE BETWEEN LOTS 11 AND 12
1ST ABOVE MENTIONED; AND
THENCE ALONG SAID LAST MENTIONED DIVISION LINE SOUTH 89 DEGREES 12 MINUTES 10
