AUTHORIZATION
Pursuant to the provisions of Chapter 275 and/or Chapter l I 1 of the Town Code of the Town of
Southold and in accordance with the Resolution of the Board of Trustees adopted at the meeting held on
Februa~ 18~ 2009, and in consideration of appl~catig,n fee in the sum of $250.00 paid by Gerald DiCunzolo and
subject to the Terms and Conditions as stated in the Resolution, the Southold Town Board of Trustees
authorizes and permits the following:
Wetland Permit to remove 76' of existing bulkhead and construct new bulkhead
in-place, provide a 10' wide non-turf buffer landward of the bulkhead, with the
conditions that the two drains in the bulkhead be removed, install and maintain a 10'
non-turf buffer landward of the bulkhead, and as depicted on the site plan prepared by
Costello Marine Contracting Corp., last dated February 26, 2009, and received on
March 3, 2009.
IN WITNESS WHEREOF, the said Board of Trustees hereby causes its Corporate Seal to be affixed,
and these presents to be subscribed by a majority of the said Board as of this date.
TERMS AND CONDITIONS

The Permittee Gerald DiCunzolo, residing at 1935 Westview Drive, Mattituck, New York as
part of the consideration for the issuance of the Permit does understand and prescribe to the
following:
That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third pa~ties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
That the work involved will be subject to tl~& inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
That there will be no unreasonable interference with navigation as a result of the Work
herein authorized.
That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upOn due notice, to remove or alter this work project herein stated without
expenses to .the Town of Southold. ·
The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Department of Real Properties Office as a notice
covenant and deed restriction to the deed of the subject parcel. Such evidence shall be
provided within ninety (90) calendar days of issuance of this permit.
That the said Board will be notified by the Permittee of the completion of the work
authorized.
That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.

Dear Ms. Costello:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, February 18, 2009 regarding the above matter:
WHEREAS, Costello Marine Contracting Corp. on behalf of GERALD DICUNZOLO
applied to the Southold Town Trustees for a permit under the provisions of Chapter 275
of the Southold Town Code, the Wetland Ordinance of the Town of Southold,
application dated January 28, 2009, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, in accordance with Chapter 268, said application was found to be Exempt
from the Local Waterfront Revitalization Program policy standards, and,
WHEREAS, a Public Headng was held by the Town Trustees with respect to said
application on February 18, 2009, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT;
RESOLVED, that the Board of Trustees approve the application of GERALD
DICUNZOLO to remove 76' of existing bulkhead and construct new bulkhead in-place,
provide a 10' wide non-turf buffer landward of the bulkhead, with the conditions that the
two drains in the bulkhead be removed, install and maintain a 10' non-turf buffer
landward of the bulkhead, and as depicted on the site plan prepared by Costello Marine
Contracting Corp., last dated February 26, 2009, and received on Mamh 3, 2009.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

At the meeting of the Southold Town Conservation Advisory Council held Wed., February
11, 2009, the following recommendation was made:
Moved by Don Wilder, seconded by Jack McGreevy, it was
RESOLVED to SUPPORT the Wetland Permit application of GERALD DICUNZOLO to
remove 76' of existing bulkhead and construct new bulkhead in-place. Provide 10' wide
non-turf buffer landward of bulkhead. Install two 12" X 30' long mooring pilings on north
side of existing floating dock.

The CAC Supports the application with the Condition the roof drains running through the
bulkhead are removed and a drainage plan is submitted, and no treated lumber is used.
The CAC questions whether the additional pilings would interfere with the dock on the
adjacent property.

existing bulkhead and construct new bulkhead in-place. Provide 10' wide non-turf buffer landward of bulkhead. Install
two 12" X 30' long mooring pilings on north side of existing floating dock. Located: 1935 Westview Dr., Mattituck.

THE FOLLOWING SECTION ADDRESSES THE PROPOSED IN-PLACE BULKHEAD REPLACEMENT:
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town
Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided
on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our
recommendation that the proposed action is EXEMPT pursuant to § 268-3 GG. Bulkhead to replace existing
bulkhead on the applicant's property in the same location with a silt curtain employed during construction.
The following BMP's are recommended:

The deployment of silt boom surrounding the immediate project area prior to and during all intertidal
operations.
2) Establish a 20' non-turf vegetative buffer landward of the bulkhead.
NOTE: That the exemption determination covers only the inkind-inplace replacement of the bulkhead and not the two
12' x 30' long mooring pilings.
THE FOLLOWING SECTION ADDRESSES THE MOORING PILINGS:
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town
Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided
on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our
recommendation that the propo~action is the proposed action is INCON~ii~TENT with LWRP policy standards
and therefore is INCONSIST~ with the LWRP.

Comply with statutory and regulatory requirements of the SouthoM Town Board of Trustees laws and
regulations for all Andros Patent and other lands under their jurisdiction

§ 275-11 Construction and operation standards.
(d)
Review and approval of dock applications. Before issuing a permit for a dock structure, the Trustees shall
consider whether the dock will have any of the following harmful effects:

Whether the dock will impair navigation or be located in areas of high vessel traffic or vessel congestion;
Whether the dock will unduly interfere with the public use of waterways for swimming, boating, fishing,
shellfishing, waterskiing and other water-dependant activities;
Whether the dock will unduly interfere with transit by the public along the public beaches or foreshore;
Whether the dock will significantly impair the use or value of waterfront property adjacent to or near the dock;
Whether the dock will cause degradation of surface water quality and natural resources;
Whether the dock will cause habitat fragmentation and loss of significant coastal fish and wildlife habitats;
Whether the dock will result in the destruction of or prevent the growth of vegetated wetlands, seagrasses
including eelgrass (Zostera marina) and widgeon grass (Ruppia maritima) or shellfish;
Whether the dock will unduly restrict tidal flow or water circulation;
Whether the dock will be safe when constructed;
Whether the dock will adversely affect views, viewsheds and vistas important to the community;
Whether the cumulative impacts of a residential and commercial dock will change the waterway or the
environment and whether alternate design, construction, and location of the dock will minimize cumulative
impacts; and
Whether adequate facilities are available to boat owners and/or operators for fueling, discharge of waste and
rubbish, electrical service and water service.
The following BMP is recommended as alternative to the proposed action (two 12" X 30' long mooring pilings):
1) The use of a mooring whip as alternative to pile mooring dolphins.
If the Agency~ Board of Trustees makes a contrary determination of consistency~ the Agency shall elaborate in
writing the basis for its disagreement with their recommendations Pursuant to Chapter 268 Waterfront
Consistency Review.
§ 268-5. Review of actions.
It In the event the LWRP Coordinator's recommendation is that the action is inconsistent with the LWRP, and the
agency makes a contrary determination of consistency, the agency shall elaborate in writing the basis for its
disagreement with the r~t~mmendation and state the manner and ext~ to which the action is consistent with the
L WRP policy standard~
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written
determination regarding the consistency of the proposed action.

The existing bulkhead on this property is beginning to fail. The property owner is attempting to
maintain his property by building a new bulkhead in its place.

Preserve historic resources of the Town of Southold.
This property has no significant historic resources.
Policy 3
Enhance visual quality and protect scenic resour~s throughout the Town of Southold.
The bulkhead at this location exists. The present condition of this bulkhead is becoming unstable
threatening the integrity of the upland property. A new bulkhead is just an attempt of the upland
property owner to maintain his property. There is an existing bulkhead and the surrounding area is
bulkheaded so the visual quality and scenic resources will remain the same.
