The following action was taken by the Southold Town Board of Trustees at their Regular
Meeting held on Wednesday, November 18, 2009:
RESOLVED, that the Southold Town Board of Trustees APPROVE the Amendment to
Wetland Permit #7036 to authorize the in-place reconstruction (rather than the
renovation/roof restructuring) of most seaward 19.7'x20' one-story portion of dwelling so
as to raise it 2' to proposed elevation of rest of dwelling; and the in-place reconstruction
and raising of the existing attached 22.5'x24' wood deck, and as depicted on the revised
survey prepared by Nathan Taft Corwin III last dated July 20, 2009, and received on
October 27, 2009.
Any other activity within 100' of the wetland boundary requires a permit from this office.
This is not a determination from any other agency.

AUTHORIZATION
Pursuant to the provisions of Chapter 275 andior Chapter 111 of the Town Code of the Town of
Southold and in accordance with the Resolution of the Board of Trustees adopted at the meeting held on
February 18, 2009, and in consideration of application fee in the stun of $250.00 paid by Joseoh & Rita
Denicolo and subject to the Terms and Conditions as stated in the Resolution, the Southold Town Board of
Trustees authorizes and permits the 'following:
Wetland Permit to renovate the most seaward 20'x19.7' portion of the existing
one-story dwelling to remain (including roof restructuring and installation of new
windows and doors); replace portiOn of existing one-story dwelling (in-place) with two-
story dwelling constructed over existing foundation; construct two-story addition,
approximately 14 square feet of which will be located within Chapter 275 jurisdiction;
and construct a deck addition on the easterly side of the dwelling, with the condition of
a line of staked haY bales with.silt fencing is installed prior to construction, install and
maintain a 15' non-turf buffer adjacent to the bulkhead; and as depicted on the survey
prepared by Nathan Taft Corwin III, last dated February 22, 2009, and received on
February 25, 2009.
IN WITNESS WHEREOF, the said Board of Trustees hereby causes its Corporate Seal to be affixed,
and these presents to be subscribed by a majori~ bf the said Board as of this date.
TERMS AND CONDITIONS
The Pennittee Joseph & Rita Denicolo, residing at 3475 Wells Avenue, Southold, New York as
part of the consideration for the issuance of the Permit does understand and prescribe to the
following:
That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
That this Peru'fit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
That the work involved will be subject to the inspectiOn and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Department of Real Properties Office as a notice
covenant and deed restriction to the deed of the subject parcel. Such evidence shall be
provided-within ninety (90) calendar days of issuance of this permit.
That the said Board will be notified by the Permittee of the completion of the work
authorized.
That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.

Dear Mr. Herrmann:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, February 18, 2009 regarding the above matter:
WHEREAS, En-Consultants, Inc. on behalf of JOSEPH & RITA DENICOLO applied to
the Southold Town Trustees for a permit under the provisions of Chapter 275 of the
Southold Town Code, the Wetland Ordinance of the Town of Southold, application
dated January 28, 2009, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application be
found Consistent with the Local Waterfront Revitalization Program policy standards,
and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on February 18, 2009, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees have found the application to be Consistent
with the Local Waterfront Revitalization Program, and,
RESOLVED, that the Board of Trustees approve the application of JOSEPH & RITA
DENICOLO to renovate the most seaward 20'x19.7' portion of the existing one-story
dwelling to remain (including roof restructuring and installation of new windows and
doors); replace portion of existing one-story dwelling (in-place) with two-story dwelling
constructed over existing foundation; construct two-story addition, approximately 14
square feet of which will be located within Chapter 275 jurisdiction; and construct a deck

Permit to construct and complete project will expire two years from the date the permit

Dear Mr. Herrrnann:
The Southold Town Board of Trustees reviewed the survey prepared by Nathan Taft
Corwin III, last dated February 22, 2009, and received on February 25, 2009, and
determined that the construction of new pervious driveway and installation of upgraded
sanitary system and drainage system of drywells is out of the Wetland jurisdiction under
Chapter 275 of the Town Wetland Code and Chapter 111 of the Town Code.
Therefore, in accordance with the current Wetlands Code (Chapter 275) and the
Coastal Erosion Hazard Area (Chapter 111) no permit is required. Please be advised,
however, that no construction, sedimentation, or disturbance of any kind may take place
seaward of the tidal and/or freshwater wetlands jurisdictional boundary or seaward of
the coastal erosion hazard area as indicated above, or within 100' landward from the
top of the bluff, without further authorization from the Southold Town Board of Trustees
pursuant to Chapter 275 and/or Chapter 111 of the Town Code. It is your responsibility
to ensure that all necessary precautions are taken to prevent any sedimentation or other
alteration or disturbance to the ground surface or vegetation within Tidal Wetlands
jurisdiction and Coastal Erosion Hazard Area, which may result from your project. Such
precautions may include maintaining adequate work area between the tidal wetland
jurisdictional boundary and the coastal erosion hazard area and your project or erecting
a temporary fence, barrier, or hay bale berm.
This determination is not a determination from any other agency.

DENICOLO to renovate the most seaward 20'X 19.7' portion of the existing one-story
dwelling to remain (including roof restructuring and installation of new windows and
doors); replace portion of existing one-story dwelling (in-place) with two-story dwelling

Based on the information you have submitted, the New York State
Department of Environmental Conservation has determined that:
The property landward of the functional bulkhead greater than 100'
in length, constructed prior to 8/20/77 as shown on the aerial
photo by Aeroqraphics, Inc., dated April 6, 1976, is beyond the
jurisdiction of Article 25 (Tidal Wetlands).
Therefore, in accordance with the current Tidal Wetlands Land Use
Regulations (6NYCRR Part 661) no permit is required under the Tidal
Wetlands Act Please be advised, however, that no construction,
sedimentation, or disturbance of any kind may take place seaward of
the tidal wetlands jurisdictional boundary, as indicated above,
without a permit. It is your responsibility to ensure that all
necessary precautions are taken to prevent any sedimentation or
other alteration or disturbance to the ground surface or vegetation
within Tidal Wetlands jurisdiction which may result from your
project. Such precautions may include maintaining adequate work
area between the tidal wetland jurisdictional boundary and your
project (i.e. a 15' to 20' wide construction area) or erecting a
temporary fence, barrier, or hay bale berm.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town
Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided
on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our
recommendation that the proposed action is CONSISTENT with LWRP policy standards and therefore is
CONSISTENT with the LWRP.
The following BMP is recommended:
1)
Modify the existing 10' non-turf buffer to a 20' non-turf vegetative buffer landward of the
bulkhead.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written
determination regarding the consistency of the proposed action.

Statement of the effect, if any, on the wetlands and tidal waters of the town that may result by
reason of such proposed operations (use attachments if appropriate):
The project includes the partial reconstruction of an existing one-story dwelling into a 2-story dwelling no closer
than 85 feet from an existing bulkhead, and this reconstruction will occur landward ora +/-400 s.f. portion of 1-story
dwelling to remain. Nearly all of the proposed footprint expansion - with the exception of 13 s.fi of dwelling and a
131 s.f. deck addition also located no closer than 85 feet from the bulkhead - will occur more than 100 feet from the
bulkhead and therefore beyond Chapter 275 jurisdiction. As part of the proposed construction, the existing sanitary
system will be replaced with an upgraded septic system, and a drainage system consisting of leaders, gutters, and
drywells will be installed to capture and recharge roof runoff. As a nonturf buffer also already exists on the parcel
landward of the bulkhead, the project will have no significant adverse impacts on the adjacent wetlands.
