Box 1758 Southold, NY 11971 RE: CLEAVES POINT CONDOMINIUMS 2820 SHIPYARD LANE, EAST MARION SCTM# 38-7-15, 38.2-l-Bldgs. 3 & 4 & 38-7-14, 38.2-2-Bldgs. 5 & 6 Dear Mr. Williamson: The Southold Town Board of Trustees reviewed the site plan prepared by Nigel Robert Williamson, Architect, last dated March 18, 2009, and received on March 30, 2009, and determined that the replacement of the existing decks and stairs with new in equal dimensions on the buildings is out of the Wetland jurisdiction under Chapter 275 of the Town Wetland Code and Chapter 111 of the Town Code. Therefore, in accordance with the current Wetlands Code (Chapter 275) and the Coastal Erosion Hazard Area (Chapter 111 ) no permit is required. Please be advised, however, that no construction, sedimentation, or disturbance of any kind may take place seaward of the tidal and/or freshwater wetlands jurisdictional boundary or seaward of the coastal erosion hazard area as indicated above, or within 100' landward from the top of the bluff, without further authorization from the Southold Town Board of Trustees pursuant to Chapter 275 and/or Chapter 111 of the Town Code. It is your responsibility to ensure that all necessary precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction and Coastal Erosion Hazard Area, which may result from your project. Such precautions may include maintaining adequate work area between the tidal wetland jurisdictional boundary and the coastal erosion hazard area and your project or erecting a temporary fence, barrier, or hay bale berm. This determination is not a determination from any other agency. If you have any further questions, please do not hesitate to call. Box 1758 Southold, NY 11971 631.765.4156 March 30, 2009 Board of Town Trustees Town of Southold 53095 Main Road Southold, NY 11971 Re: Proposed decks & stairs replacement to Cleaves Point Condominiums at 2820 Shipyard Lane, East Marion, NY 11939 Dear Board Members: We are in receipt of a letter t~om your board with regards to buildings 1 & 2 which you have determined to be out of the Wetland jurisdiction under chapter 275 of the Town Wetland Code and Chapter 111 of the Town Code. As with buildings 1 & 2, buildings 3 through 6 are going to have their existing decks which have become unsafe and the existing stairs replaced with new decks and stairs of equal dimensions. The replacement is for the safety of the occupants and visitors. It is also to bring the structures into conformance with the present code. We are submitting the following documentation for a determination from the Board as to jurisdiction for buildings 3 through 6 together with the administration building and garages. 1.
