IN WITNESS WHEREOF, the said Board of Trustees hereby causes its Corporate Seal to be affixed, and these presents to be subscribed by a majority of the said Board as of this date. TERMS AND CONDITIONS The Permittee Cleaves Point POA, residing at 345 Osprey Nest Road, Greenport, New York as part of the consideration for the issuance of the Permit does understand and prescribe to the following: That the said Board of Trustees and the Town of Southold are released from any and alt damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or'her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto, to the complete exclusion of the Board of Tmstees of the Town of Southold. That this Permit is valid for a period of 24 months, which is considered to be the estimated time required to complete the work involved, but should circumstances warrant, request for an extension may be made to the Board at a later date. That this Permit should be retained indefinitely, or as long as the said Permitiee wishes to maintain the structure or project involved, to provide evidence to anyone concerned that authorization was originally obtained. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. That there will be no unreasOnable interference With navigation as a result of the work herein authorized. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Boa/'d of Trustees, the work shall cause unreasonable obstruction to free navigation, the said Permittee will be required, upon due notice, to remove or alter this work project herein stated without expenses to the Town of Southold. Box 617 Cutchogue, NY 11935 RE: CLEAVES POINT POA 345 OSPREY NEST ROAD, GREENPORT SCTM# 35-6-36 Dear Mr. Fitzgerald: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, April 16, 2008 regarding the above matter: WHEREAS, Proper-T Permit Services on behalf of CLEAVES POINT POA applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, and Chapter 111 of the Southoid Town Code, Coastal Erosion Hazard Areas, application dated February 25, 2008, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application be found Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on April 16, 2008, at which time ail interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 and Chapter 111 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees have found the application to be Consistent with the Local Waterfront Revitalization Program, and, RESOLVED, that the Board of Trustees approve the application of CLEAVES POINT POA to re-sheath sections, totaling up to 32+/- linear feet maximum of the landward side of existing bulkhead using vinyl, T&G plank sheathing with filter fabdc liner, and backfill with 20+/- cubic yards of clean sand from an upland source, and as depicted on the project plan prepared by Proper-T Permit Services, last dated JanuarY 28, 2008, and received on FebruarY 25, 2008. However, the permit, while approved, was withheld from us as a result of independent action taken by William Cooper of cutting trees on Association property. Since that time, Mr. Cooper has pled guilty, paid a fine, and is in the process of submitting a re-vegetation plan to the Board of Trustees. PROBLEM The problem is that Mr. Cooper's violation still exists on Association property. REQUEST The Cleaves Property Owners Association humbly requests that the permit be released at this time since Mr. Cooper has pled guilty, paid his violation and demonstrated his willingness to proceed with the remaining responsibilities imposed upon him. To us, time and weather are of the essence. The job has been given out to a local contractor who is ready to proc, ccd. However, until such time, the washed out area in back of the damaged bulkhead continues to erode the shoreline and grow in size. The hole gets larger and Gull Pond becomes the recipient of the soil and shoaling. We are obviously aware of this and are concerned about our liability. It remains today an oddity and an attractive nuisance to our children who love to fish and explore at that location. I have discussed the above with Town Attorney, Ms. Laura Hulse, who appeared to be in agreement that the permit could be released. Encapsulated pilings or native nonchemically treated (untreated) lumber only should be used itt sensitive areas. 2. Require the installation of a silt boom (where feasible) pursuant to § 275-I 1. (2) Construction and operation standards below. 2) Erosion control. Installation of an erosion control structure is necessary during any building, grading, landscaping or site work activity within Trustee jurisdiction. This structure may include, but is not limited to, installation ora silt fence, hay bales, wood chip berm and silt booms. The placement of the erosion control structure(s) shall be determined by the Trustees or their designee. All intertidal construction and excavation requires the installation ora silt boom that will retain all suspended sediments within the immediate project area. It is recommended that a non-turf buffer be required landward o f the bulkhead. [] YES ~4~O [] NOT APPLICABLE The repair and strengthening of an existing bulkhead is not inconsistent with the character of the waterfront community, and because of the relatively small foot- print of the existing bulkhead it is felt that there is no adverse impact on the desired preservation of open space. Infrastructure use is not a factor since the project is ac- cessory to and accessed from private property. The maintenance of the erosion control purpose of the bulkhead is certainly a beneficial use of the coastal location, and there is no incremen~tl increase in development in the area since the bulkhead already exists in the same form as it will have after completion of the project. Policy 3 [] YEs Enhance visual quality and protect scenic resources throughout the Town of Southold. ~NO [] NOT APPLICABLE The bulkhead repair and strengthening will be done in such a manner that upon completion of the project there will be no apparent change in the project site, since the added construction members will be mainly underground. The existing bulk- head, which will retain its current form, is compatible with other existing shoreline structures in the area, and will not adversely affect dynamic landscape elements (tidal fluctuations, seasonal vegetation changes; seasonal/diurnal changes in ambi- ent light) which might contribute to ephemeral visual qualities. Policy 4 Minimize loss of life, structures, and natural resources from flooding and ero- sion. [] YES ~0 [] NOT APPLICABLE It is intuitively obvious that the likelihood of the proposed activity contributing to increased hazards which could result in the loss of life 15om flooding or erosion is probably minimal to non-existent. The proposed bulkhead repair and strengthen- ing will have a significant positive effect on the protection of structures and natural resources from flooding and erosion in that the existing bulkhead, which currently provides those features, is tending toward failure and its repair is required in order that these protective features continue in effect. Policy 5 Protect and improve water quality and supply in the Town of Southold. In the meantime, the project of itself will have no direct effect upon the Town's ecosystem, however that may be de- freed. The project will have no adverse effect upon existing tidal patterns and there will be no degradation of water quality. All statutory and regulatory requirements, at all levels of government, will be strictly complied with. No dredging, excavating, or filling in wetlands is included in the project.
