The meeting began at 7:12 p.m. with four LPC members present. Adoption of Meeting Minutes: ?? Acceptance of meeting minutes from March 31, 2009 HOLD for next meeting. Applications and Inquiries: ?? DROSKOSKI (Estate) PROPERTY SCTM #: 1000-18-4-7.1 Zoned: R-80 Location: 28105 Rt 25, Orient CPF: Yes Total Acreage: 21.25 acres (22.04 GIS) Subdividable: Yes Reviewed appraisal [executive session]. John Sepenoski was not present for a discussion of this project due to a family relationship. Melissa, Melanie, Ray, Monica and Maureen walked this farm parcel with Larry Indimine, Appraiser. It was determined that this farm has waterview to the bay and Mr. Indimine’s appraisal would reflect same. All present were favorable to recommending that this farm be preserved if agreement on price could be reached. The members entered into EXECUTIVE SESSION. Appraisal was reviewed by committee. Ray Huntington’s e-mails on this matter were read to committee members by Melissa Spiro. MOTION made by Eric Keil, seconded by Lillian Ball, to direct Melissa Spiro to present a purchase offer to Patricia Sepenoski, Executrix of the Estate of Anna Droskoski, for the purchase of a development rights easement on agricultural land owned by the Droskoski Estate. The Land Preservation Committee’s offer is based on landowner’s offer to sell a development rights easement to the Town on all but a 2± acre Reserve Area to be located on the south side of the property that will include all but approximately 50 feet of the Main Road (Rt 25) road frontage. The exact area of the easement area will be approximately 19± acres. The LPC’s had decided that no restrictions will be placed on the easement for the location or allowance for any agricultural structures in the future except those subject to Town Code. LPC has agreed to allow for future agricultural subdivision into no more than two farms with no one farm to be less than 10 acres of preserved farmland area. The purpose of this easement is for farmland protection. The parcel is located within the R-80 zoning district. Landowner will have thirty (30) days from date of certified mail offer letter to respond to this offer which is subject to the approval by the Town Board. Reviewed inquiry from Broker. Melissa, Melanie and the court-appointed broker for this property visited the site that is a neglected planted vineyard. There is a year-round cottage and several barns and outbuildings on the property. The farmhouse that used to be on the parcel has been torn down. Access is gained by a right-of-way that crosses LIRR tracks and a second right-of-way to Main Road from property to the south. Without sufficient access to an existing established road, subdivision is limited and it is understood that there are only two development rights available (one from each right-of-way). Fee title to both parcels is for sale. After lengthy discussions on ways to preserve this farm, it was decided to invite the broker to an LPC meeting. Members encouraged to do a site inspection of these parcels provided they contact the broker prior to their visit for permission to access the properties. ?? BAXTER PROPERTY SCTM #: 1000-78-7-5.6 Zoned: NZ Location: 5805 Main Bayview Rd, Southold CPF: Yes Total Acreage: 2.1 acres (GIS); 2.35 acres (RPS) MWet: 1.87 acres Status update. John, Ray, and Melissa met with Town Board at their work session on April 7, 2009, to discuss a potential purchase of this small lot for open space purposes. Town Board members willing to consider a purchase if it is a significant bargain sale that is cost effective and in the best interest of the Town. The Town Board’s suggested offer is substantially lower than the owner’s asking price. Melissa’s draft letter to Mr. Baxter was reviewed and accepted by LPC and remains subject to review by Jennifer Andaloro, Assistant Town Attorney. ?? SAWICKI (Estate) PROPERTY SCTM #: 1000-125-3-4.1 Zoned: A-C Location: 2700 Rt 25, Laurel CPF: Yes Total Acreage: 13.04 acre (12.95 GIS acres) Subdividable: Yes FWet: 1.06 acres Status update. Landowner wants to preserve yield and reserve the right for a possible future 2 lot subdivision as there are two (2) existing residential dwellings on the property. This would reduce the easement area offered from ±11 acres to ±9 acres, subject to survey. LPC agreeable to reduction in easement acreage provided a legal restriction is placed on the remaining ±4 acres requiring that any future subdivision be clustered so that the Subdivision Open Space becomes part of the 9± acre easement area. Melissa will instruct LPC’s attorney to prepare contracts. ?? BIGGANE PROPERTY SCTM #: 1000-95-1-11.2 PDR Acreage: ±17.7acres Location: 8865 Oregon Rd, Cutchogue Zoned: A-C Total Acreage: ± 19.7 Subdividable: Yes CPF: Yes Status update. Melissa met with Jack Biggane and his appraiser to review landowner’s appraisal of the parcel. Landowner’s appraisal did not accurately reflect standard subdivision requirements. Landowner’s appraiser will be revising appraisal. LPC’s thirty (30) day offer letter for this easement purchase has expired. Applicant is aware that he would need to reapply to LPC and that an updated Town appraisal would be required if the LPC is still favorable to preservation of this parcel. ?? SUFFOLK COUNTY (Playground) SCTM #: 1000-113-2-24 Zoned: R-40 Location: 1300 Rosewood Dr, Mattituck CPF: No Total Acreage: RPS 1.16; GIS 1.06 Subdividable: NP FWet/MWet: 0 Inquiry from County. Melissa inspected this parcel that is located on a private road. Parcel is a deep swale. County took title to this former park & playground area for non-payment of taxes and has offered the lot to the Town in exchange for minimal expenses incurred. LPC did not see the benefit of acquiring property; however, Melissa was asked to discuss this property with Jamie Richter, Town Engineer, to see if property had any drainage benefits. Melissa was also asked to discuss this possible purchase with the Town Board at their work session scheduled for April 21, 2009. Applications & Inquiries for Uses or Structures on Preserved Property: ?? LAUREL LAKE (McFeely) - Update re: SCWA Town Board appointment. Steve Jones, CEO of Suffolk County Water Authority (SCWA), met with Town Board at their work session on April 7, 2009, and requested change to existing easement area to allow for shorter distance for water main installation. He would prefer; however, to run the pipe line through an area that would be the shortest point from SCWA property to Rt 25, disturbing only a 10 ft wide section that would be replanted, or made into a wood-chipped trail (if Town wanted trail), rather than disturbing the established roadway to which SCWA has an easement. Jim McMahon, Director of Public Works, believes that disturbance to the established easement area will cause future erosion issues. SCWA would keep existing easement for vehicles (surface easement) and new area would be for water pipe installation (sub-surface). LPC discussed a condition whereby change in area would be allowed with SCWA restricting future development on its holdings within Laurel Lake Area. Melissa to discuss with Assistant Town Attorney and Town Board. ?? LAUREL LAKE - Reviewed info from Jim McMahon re: grant. Jim McMahon’s proposed budget plan for grant allocation at Laurel Lake Preserve that LPC had requested from him at last LPC meeting, was reviewed by committee members. It was suggested that further review is needed for improvements listed. Eric Keil suggested that the Town consider hiring a landscape artist for a professional rendition of a future Laurel Lake Preserve. This subject was not thoroughly reviewed due to time constraints. ??
