ALSO that certain lot, piece or parcel of land situate, lying and being in the Town of Southold, County of Suffolk and State of New York and known and Tax Map Designation designated as lots numbers three (3) and thirty-four (34) on a certain map entitled, "Subdivision Map, Property of Walter C. Grabie, situate on Nassau Dist. Point, Peconic, N.Y." made by Otto W. Van Tuyl, March 29th, 1938 and filed in '000 the Suffolk County Clerk's Office, April 29th, 1938 as Map No. 1257. Sec. TOGETHER with all the right, title and interest of the party of the first part in and to land lying in Harbor Road and Lowland Road in front of and adjoining 11 the above described premises to the center line thereof respectively. AND the party of the first part,in compliance with Section 13 of the Lien Law,covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied fust for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word"party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
