The following action was taken by the Southold Town Board of Trustees at their Regular
Meeting held on Wed., July 22, 2009:
RESOLVED, that the Southold Town Board of Trustees DENIES the Amendment to
Permit #7038 to add a seasonal set of stairs to the beach, and,
BE IT FURTHER RESOLVED, that the Southold Town Board of Trustees APPROVES
the Amendment to Permit #7038 to enlarge the landward deck to 18'X 30' instead of
18'X 24', and as depicted on the revised plan received on July 1, 2009 and stamped
approved on July 22, 2009.
This is not a determination from any other agency.

AUTHORIZATION
Pursuant to the provisions of Chapter 275 and/or Chapter 111 of the Town Code of the Town of
Southold and in accordance with the Resolution of the Board of Trustees adopted at the meeting held on
February 18~ 2009, and in consideration of application fee in the sum of $500.00 paid by Sofia Amoniadis &
Maria Xefos and subject to the Terms and CB~ditions as stated in the Resolution, the Southold Town Board of
Trustees authorizes and permits the following:
Wetland Permit to replace approximately 200' of bulkhead and 30' return on
landward side; an 18'x24' deck and steps to the beach, and place toe armor along the
southwestern end of the new bulkhead and return, with the conditions of the use of
vinyl sheathing on the bulkhead, the deployment of a silt boom surrounding the
immediate project area prior to and during all intertidal operations, the installation of
an 18' non-turf buffer along the landward side of the bulkhead, the two pilings on the
beach areto be removed, the lights on the bulkhead are to be removed but lights on the
stairs are permitted, the area underneath the deck is to be kept pervious to allow for
water runnff and in accordance with Chapter 236 of the Town Code-Storm Water
Runoff, only one set of stairs to the beach, and as depicted on the site plan prepared by
Igor Gurevich, P.E. last dated March 12, 2009, and received on March 19, 2009.
1N WITNESS WHEREOF, the said Board of Trustees hereby causes its Corporate seal to be affixed,
and these presents tO be SUBscribed by a majority of the said Board as of this date.
TERMS AND CONDITIONS
The Permittee Sofia Antoniadis & Mafia Xefos, residing at 12500 Main Road, East Marion,
New York as part of the consideration for the issuance of the Permit does understand and
prescribe to the following:
That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
That there will be no unreasonable interference with navig~tion as a result of the work
herein authorized.
That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
That if future operations of the Town of Southold require the removal and/or alterations in~
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Department of Real Properties Office as a notice
covenant and deed restriction to the deed of the subject parcel. Such evidence shall be
provided within ninety (90) calendar days of issuance of this permit.
That the said Board will be notified by the Permittee of the completion of the work
authorized.
That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.

Dear Ms. Antoniadis & Ms. Xefos:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, February 18, 2009 regarding the above matter:
WHEREAS, SOFIA ANTONIADIS & MARIA XEFOS applied to the Southold Town
Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code,
the Wetland Ordinance of the Town of Southold, and Chapter 111 of the Southold Town
Code, Coastal Erosion Hazard Areas, application dated January 28, 2009, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, in accordance with Chapter 268, said application was found to be Exempt
from the Local Waterfront Revitalization Program policy standards, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on February 18, 2009, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,

WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application Of SOFIA
ANTONIADIS & MARIA XEFOS to replace approximately 200' of bulkhead and 30'
return on landward side, an 18'x24' deck and steps to the beach, and place toe armor
along the southwestem end of the new bulkhead and return, with the conditions of the
use of vinyl sheathing on the bulkhead, the deployment of a silt boom surrounding the
immediate project area prior to and dudng all intertidal operations, the installation of an
18' non-turf buffer along the landward side of the bulkhead, the two pilings on the beach

runoff and in accordance with Chapter 236 of the Town Code-Storm Water Runoff, only
one set of stairs to the beach, and as depicted on the site plan prepared by Igor
Gurevich P.E. last dated March 12, 2009, and received on March 19, 2009.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per ~nspection. See attached schedule.

SOFIA ANTONIADIS & MARIA XEFOS request a Wetland Permit & Coastal Erosion Permit to replace approx. 200' of
bulkhead and 30' return on landward side, an 18'X 24' deck and steps to the beach, and place toe armor along the
southwestern end of the new bulkhead and return. Located: 12500 Main Rd., East Marion. SCTM#31-14-7
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town
Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on
the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our
recommendation that the proposed action is EXEMPT pursuant to § 268-3 GG. Bulkhead to replace existing bulkhead
on the applicant's property in the same location with a silt curtain employed during construction.
The following BMP's are recommended:
l)
The deployment of silt boom surrounding the immediate project area prior to and during all intertidal
operations.
2) Establish a minimum 20' non-turf vegetative buffer landward of the bulkhead.
3)
The deck when replaced should be pitched away from the water, pervious to precipitation and constructed of
materials other than treated lumber.
4)
Install pervious materials beneath the entire ground area coverage of the deck to allow for any and all runoff
generated by the deck to percolate into the ground.
NOTE: That the exemption determination covers only the inkind-inplace replacement of the bulkhead & deck and not the
proposed new toe armoring along the southwestern end of bulkhead.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written
determination regarding the consistency of the proposed action.

All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. Tkis
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard ~Irea.
Before answering the questions in Section C, the preparer of th/s form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).

affect the achievement of the LWRP policy standards and conditions co~tained in the consistency

I respectfully request an permit for the replacement of approximately 200' bulkhead and 30'
return on the landward side, a 18 by 24 foot deck and steps to the beach and to additionally
place a toe armor along the southwestern end of the new bulkhead and return. The proposed
work is absolutely necessary due to damage from recent storms and will safeguard the property
from potential storm damages. All aforementioned work was permitted on November 20, 2008
by the NYS DEC.
