THIS INDENTURE, made the 20-'t4'day of January, 2009
BETWEEN
ELLEN L. HUFE, as Executrix of the Estate of Warren E. Hufe, a/k/a Warren E. Hufe, Jr., a/k/a
Warren Hufe, who died a resident of Suffolk County on April 14, 2007 and whose will was admitted
to probate by the Suffolk County Surrogate's Court under file #1438P07, residing at 3195 Wells
Avenue, Southold, New York 11971, party of the first part, and
ELLEN L. HUFE and MIRANDA WILSON, as co-Trustees of the Trust under Will of Warren E.
Hufe, Jr., as probated by the Suffolk County Surrogate's Court as file No. 143P2007, with an
address of 3195 Wells Avenue, Southold, New York 11971, party of the second part.
WITNESSETH, that the party of the first part, in consideration of TEN AND 00/100 ........ ($10.00) ................
Dollars, and other good and valuable consideration paid by the party of the second part, does hereby grant
and release unto the party of the second part, the heirs or successors and assigns of the party of the second
part forever, an undivided % interest in,
ALL that certain plot, piece or parcel of land, situate, lying and being at Southold, in the Town of
Southold, County of Suffolk and State of New York, being bounded and described as follows:
BEGINNING at a point at a monument on the southwesterly side of Kenney's Road, said point of
beginning being where the northerly line of the premises herein and the southerly line of the
premises now or formerly of Goldrich intersects the southwesterly side of Kenney's Road;
THENCE South 41 degrees 57 minutes 50 seconds East along the southwesterly side of Kenney's
Road 62.:15 feet;
THENCE South 8 degrees 49 minutes East 28.64 feet to the northwesterly side of Hiddle Road;
THENCE southwesterly along the northwesterly side of Hiddle Road a distance of 132.01 feet to land
now or formerly of Surozenski;
THENCE North 41 degrees 57 minutes 50 seconds West along said land 1:10.24 feet;
THENCE North zt6 degrees 48 minutes East along land now or formerly of Goldrich 144.84 feet to
the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to grantor by deed dated October 26,
2006 and recorded in Liber 12502 Page 731.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all
the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the
premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of
the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose. The word "party" shall be construed as if it read "parties" when ever the sense of this indenture so
requires.
