THIS iNDENTURE, made the 4th day of February, Two Thousand Nine
BETWEEN
MARILYN P. NORKELUN, residing at 1825 Calebs Way, Greenport, New York 11944,
party of the first part, and
KIM W. NORKELUN, residing at 2200 Grand Avenue, Mattituck, New York 11952,
JILL LAUGHLiN; residing at 1495 Chaparral Way, Oceanside, California 92057,
WILLIAM J. NORKELUN, residing at 1495 Chaparral Way, Oceanside, California 92057,
KAREN L. LONG, residing at 832 Stewart Canyon Road, Fallbrook, Califomia 92028, and
KYLE P. BUSCHATZKE, residing at 6927 Mohawk Street, San Diego, California 92115,

WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party of
the second part, the heirs or successors and assigns of the party of the second part forever,
ALL THAT CERTAIN plot, piece or parcel of land, with the buildings and improvements
thereon erected, situate, lying and being in the Town of Southold, County of Suffolk and State of
New York, known and designated as Unit No. 7 on a certain Condominium Plan entitled, "Map
of Mooresland a/kJa Pheasant Run Estates Condominium I," filed in the Office of the Clerk of
the County of Suffolk on 12/22/94 as Map No. 257 and amended on 06/13/96, together with an
undivided 5% interest as tenant in common in the common elements of the Condominium
described in the Declaration of Condominium recorded in Liber 11707, Page 664, and amended
by Liber 11720, Page 628, and Liber 11778, Page 167, and by Liber 11843, cp 638, said
Condominium being bounded as follows:
BEGINNING at a monument set at the intersection formed by the southerly line of Middle Road
(C.R. 48) with the easterly line of Moore's Lane;
RUNNING THENCE from said monument and point of beginning in an easterly direction along
the southerly line of Middle Road (C.R. 48) the following two (2) courses and distances:
North 65 degrees 54 minutes 50 seconds East, a distance of 96.77 feet to a monument;
North 69 degrees 00 minutes 20 seconds East, a distance of 695.97 feet to a point and
lands now or formerly of John A. Costello;
THENCE along lands now or formerly of Costello, South 16 degrees 01 minutes 50 seconds
East, a distance of 1254.09 feet to a point;
THENCE South 58 degrees 15 minutes 00 seconds West, a distance of 32.98 feet to a point and
the beginning of a curve to the right;
THENCE along said curve bearing to the right, having a radius of 689.69 feet and a distance of
198.62 feet to a point;
THENCE still along the lands now or formerly of John A. Costello, South 75 degrees 45 minutes
00 seconds West, a distance of 496.29 feet to a point;
THENCE along a curve bearing to the right, having a radius of 40.00 feet and a distance of 61.44
feet to the easterly side of Moore's Lane;
THENCE northerly along the easterly line of Moore's Lane, North 17 degrees 15 minutes 00
seconds West, a distance of 1169.41 feet to the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed dated December 6, 2001, and recorded in the Suffolk County Clerk's Office on December
20, 2001, in Liber 12159, Page 385.
RESERVING, HOWEVER, a legal life estate in the above-described premises with the buildings
and improvements thereon erected, in and to the party of the first part.
THE PARTY OF THE FIRST PART HEREBY RESERVES A SPECIAL POWER OF
APPOINTMENT, exercisable as often as she may choose, to change her remainderman as
follows:
TO or among any one or more members of a class consisting of the party of the first part's
descendants, in any degree, whether presently living or bom hereafter, in such proportions/md
amounts, without regard to equality, outright or in trust, as the party of the first part may direct
and appoint during her lifetime by properly written and acknowledged instrument, and recorded
prior to death, making specific reference to this power of appointment. The party'of the first part
may not appoint herself, her estate, her creditors or the creditors of her estate, under any
circumstances.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the right
to receive such consideration as a trust fund to be applied first for the purpose of paying the cost
of the improvement and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
