WITNESSETH,that the party of the first part, in consideration of Ten Dollars and other valuable consideration
paid by the party of thesecond part, does hereby grant and release unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being in the Town of Southold, County of Suffolk, State of New York, being
bounded and described as follows:
BEGINNING at a concrete monument set in the southerly side of a 30 foot
Right of Way where same is intersected by the division line between land now or
formerly of Arthur H. Axberg, Jr. and the premises herein described;
RUNNING THENCE North 70 degrees 00 minutes 00 seconds East along the
southerly side of the 30 feet Right of Way, 62.00 feet to the westerly side of a
25 foot Right of Way known as Camp Mineola Road;
THENCE South 4 degrees 46 minutes 50 seconds East along the westerly side
of Camp Mineola Road, 206.48 feet to the mean high water mark of Peconic Bay,
as of May, 11, 1996;
THENCE South 76 degrees 59 minutes 30 seconds West on a tie line along the
mean high water line of Peconic Bay, as of May 11, 1996, 60. 12 feet to lands now
or formerly of Arthur H. Axberg, Jr. ;
THENCE North 4 degrees 52 minutes 20 seconds West along said lands of
Axberg, 1.98.81 feet to the concrete monument set at the point or place of BEGINNING.
TOGETHER with the benefits of, but Subject to the burdens of two non-exclusive
right of ways to pass and repass a portion of Howell Avenue, a thirty foot wide
right of way over lands now or formerly West End Properties Association of Camp
Mineola, Inc. , immediately adjoining the premises above described on the north until
it meets Camp Mineola Avenue, a twenty-five foot wide right of way established by
Agreement dated 11/23/06 in Liber 629 cp 168 and modified by Agreement dated
6/2/65 in Liber 5828 cp 49, which extends from the northerly limits of the premises
above described to New Suffolk Avenue, a public road.
BEING AND INTENDED TO BE the same premises conveyed to the grantor herein
TAX MAP by Deed dated 4/1/75 recorded 4/2/75 in Liber 7818 cp 494.
DESIGNATION
Dist. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
1000 roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances

the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.

AMENDED June 21, 1996
TO BE INCLUDED IN CLOSING CONVEYANCE, BUT NOT INSURED
RIGHT OF FIRST REFUSAL
The Party of the Second Part is herein granted a "Right of First Refusal" by the Party of the
First Part to purchase premises known as 3580 Camp Mineola Road, Mattituck, New York,
1 1952, as shown on Suffolk County Tax Map as District 1000, Section 123.00, Block 05.00,
Lot 014.000, which is owned by said Party of the First Part.
The Party of the First Part shall notify the Party of the Second Part of a bona fide offer to
purchase the above premises has been made pursuant to and evidenced by an executed
Contract of Sale subject to this "Right of First Refusal" within ten (10) days of said Contract's
execution. The Party of the Second Part must notify the Party of the First Part of their election
to purchase within ten (10) days of the Party of the Second Part's receipt of the Party of the
First Part's notice to purchase. If the Party of the Second Part's acceptance is not received
within said ten (10) days of Party of the First Part's notice to purchase, then this "Right of
First Refusal" shall be deemed null and void. Notices for the purpose of this "Right of First
Refusal" provision shall be made by actual delivery in person or by overnight courier with
receipt acknowledged to the respective addresses of the parties.
The Party of the First Part hereby grants the Party of the Second Part the right to have this
deed indexed against the above described premises, District 1000, Section 123.00, Block
05.00, Lot 014.000 in order that the public record reflect the above granted "Right of First
Refusal".
