PROPERTY FACTS/DESCRIPTION: The applicants' property has 244.90 feet along tho south side of Carrlngton Road and 90.36 feet along Haywaters Road, Cutchogue, and Is shown as Lot 364 on the Map of Nassau Point club Properties Inc., Section D, filed May 7, 1926 In the Suffolk County Clerk's Office. The premises Is Improved with a single-story, one-family residence. BASIS OF APPLICATION: Zoning Code Sections 100-242A (Walz Interpretation No. 5039) and 100-244, based on the Building Inspector's March 3, 2006 Notice of Disapproval, which determined that the proposed additions to the existing single-family dwelling will be an Increase In the degree of the nonconformity when located less than less than 50 feet from the rear yard line, and that the existing conforming front yard will be reduced from the code required 40 feet from the front yard lot line. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on April 27, 2006, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal Inspection of the property, and other evldence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REOUESTFn: The applicants wish to construct additions to an existing single-family dwelling over the existing foundation, adding a covered porch which. The front covered porch will be 35.8 feet from the southerly lot line (or 33 feet from the new step area), and the new second-story addition and new side covered porch will be 28.4 feet from the rear lot line, at Its closest point, as shown on the map revised 5-1-06 by Angelo F. Corva, Architect. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal Inspections, the Board makes the following findings: 1. Grant of tho variance will not produce an undesirable change In the character of the neighborhood or a detriment to nearby properties. The applicant's property Is a corner lot with frontage along two town streets and improved with a single-family dwelling, all shown on the November 19, 2005 survey prepared by AK Associates. The applicants propose a new second floor addition at 30 feet to the top of the ridge from natural grade, and over the existing first floor, which has existed In a nonconforming location slnoe Its construction In 1962 at 28.4 feet from the rear lot line. The new front yard setback would be a 1.7 ft. reduction to allow for a Pa~e 2 - May 25, 2006 ZB File No. 5881 - J. and J. Bendick CTM No. 111-6-11 four-ft deep, one-story front porch facing Carrlngton Road. The front setback from Haywaters Road substantially exceeds the code's minimum requirement. 2. The benefit sought by the applicants cannot be achieved by some method, feasible for the applicants to pursue, other than an area variance. The existing nonconformity of the dwelling has been 28.4 feet from the rear lot llne, when built In 1962. 3. The variance granted herein Is substantial. The rear yard reduction for the second-story addition and porch addition is 56% less than the code required 50 ft. minimum setback. 4. The difficulty has not been self-created because the nonconforming foundation with one-story construction will remain to support a new second-story, with the same angle to the property lines that has existed for many years. 5. No evidence has been submitted to suggest that a variance In this residential community will have an adverse Impact on the physical or environmental conditions in the neighborhood. 6. Grant of the requested relief Is the minimum action necessary and adequate to enable the applicants to enjoy the benefit of additions, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Simon, seconded by Member Welsman, and duly carried, to GRANT the variance as applied for, as shown on the site and floor map revised 5-1-06, and and elevation diagrams prepared 2-6-02, by Angelo F. Corva, Architect, subject to the CONDITION that an engineer report be obtained to confirm that the integrity of the existing structure Is solid and sufficient to hold the new second floor addition. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when Involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject propen~y that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. During the hearing we informed the Board that the existing one story house would require demolition of first floor and new construction of both the first and second floor. At the time, the foundation appeared to be adequate. However, because the Board properly anticipated that the foundation may need to be demolished, as well as the first floor, they placed a condition on the variance that Kan engineer's report be obtained to confirm that the integrity of the existing structure [foundation] is solid and sufficient to hold the new second floor addition". The owner's architect passed away, Angel Chorno is the new architect. The house will remain a one story dwelling rather than two stories, reducing the overall request made to the Zoning Board. A building permit # 73683 was issued for a new one story dwelling. In accordance with the ZBA condition, Angel Chorno, Architect, has submitted the enclosed letter which states that the foundation is not capable of supporting the intended new structure. We have complied with the condition. The original plans prepared by Mr. Corva's office was for a two story dwelling. The associate with Mr. Corva passed away and Angel Chorr~o was retained for a new ranch house.
