This site plan is fer new construction of a 100' monopole cellular communicatim~ tower with Cingular locating
antennas at 97'-0" and 87'-0" internally mounted m the tower, tile site includes all existing boat marina and
restaurant on 4.7 acres parcel m tbe MII Zoning District located approximately 537' e/o Cedar Birch Lane on tbe

Tile proposed action has been reviewed to Chapter 268, Waterfl'out Consistency Review of the Town of Southold
Town Code and tile Local Waterfront Revilalizalien Program (LWRP) Policy Standards. Based upon the
information provided on file LWRP Consistency Assessment Fox'm submitted to this deparm~ent as well as the
records available to me, it is my determination that tile proposed actiou is INCONSISTENT with the following
Policy Standards aud therefore is INCONSISTENT with tbe LWRP.
Policy 3. Enbauce visual qualily aud protect scenic resources throughout the Town of Southold.
Policy Staudards
3.1 Enhance visual quality and protecl sceuic resources tllroughout the Town of Southold.
A. Minimize introduction of structural desigu componeets (iucluding utility lines, lighting, signage
aed fenciug) which would be discordant with existing natural scenic components and character.
J. Protect visual quality associate( with public laeds, iucludieg public trausportatioe routes, public
parks and public trust hinds and waters.
2. Limil alteration of shorelioe elements wlfich contribute to scenic quality.
The proposal also revolves tile oe~ construction of a 400 sq ft. commuuication compound with a 100' flag
pole type monopole. A 12' chain link feoce woold enclose file communication compound. Twenty-two,
14' high, .]unz~;eru~ virginiana ale proposed lo hc inslalled to screen tile compound. The property is
located south of a designated New Yo~k S ate Scenic Byway The property is also located w/o and
adiacent to Orient Point State Park.
The flag type monopole cell tower will impact the scenic quality of the area. The height of the flagpole in
relation to surrounding structures and the "natural scenic components" is discordant with the area.
Mitigation proposed by the applicant to reduce visual impacts include installing a flag pole type ~nonopole,
painting the monopole white and the installation of twenty-two, 14' Juniperus virginiana. If the action is
approved by the reviewing Boards the following is reconm~ended to further Policy 3.
1. Require that the cmrnnunication compound and monopole be relocated north and adjacent to existinp~
buildings on site. The relocation of the compound would filrther cluster the development on the parcel
and use existing development to screen portions of the proposed conununication compouod and
monopole~
2. Require a five ,/ear survival reqnirement and a replacement protocol for all planted veeetation osed to
screen the communicatiou compound..
Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem.
6.3 Protect and restore tidal and freshwater wetlands.
A £?omply with statutory and regulatory requirements of the Southold To*en Board of Trustees la~vs' arid
regulations for all Andros' Patent and other lands under their jurisdiction.
Comply with T~x:stee regulations and reconmmndations as set forth in Trustee permit
conditions.
Tile proposed setback from the monopole to the bulkhead (south of the proposed monopole) is 65.10 feet; a
minimom setback of 100 feet is required pursuant to Chapter 275 of the Toxvn of Southold Toxxm Code. Please
require that the aAsplicant amend tile application to meet the above policy to the greatest extent possible~
Policy 10. Protect Southold's water-dependent uses and promote siting of new water-dependent uses in
suitable locations.

10.1 (a) Protect existing water-dependent uses.
The term ~$:ater dependent use means a business or other activity which can only be condocted in, on,
over, or adjacent to a water body because such activity requires direct access to that water body, and
which involves, as ail integral part of such activity, the use of the xvater. Existing uses shonld be
lnaintained and enhanced where possible and appropriate.
10.1 (b) Improve the economic viability of water-dependent uses by allowing for non-water
dependent accessory and multiple uses, particularly water enhanced and marifime support
services where sufficient upland exists.
The term n,ater-enhanced use nreans a use or activity which does not require a location adjacent to
coastal waters, bot whose location on the waterfront adds to the public use and enjoyment of the
water's edge. Water-enhanced uses are primarily recreational, cultural, retail, or entelntaimnent in
natme. These uses may be necessary for the snccessfid financial operation and viability of water-
dcT~'ndent uses.
_Tile proposal located in the Marine 1I zoning district. The proposed use is neither a water dependent
usc or a water enEanccd use and therefore is inconsistent with the above Policy 10 and Sub-policies.

INSTRUCTIONS
All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town Of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
andother ministerial permits not located within the Coastal Erosion Hazard Area.
Before answering the questions in Section C,the preparer of this form should review the exempt
min0racti0nlist, p01iciesand explanations of each policy contained in the Town 0fS0uth01d Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes" or no" then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus~ each answer must be explained in detail listing both supporting and non-
supporting facts. If an action cannot be certified as consistent with the LWRP policy standards and
conditions, it shall not be undertaken.
A copy of the LWRP is available in the following places: online at the Town of Southold's website
(southoldtown.northfork.net), the Board of Trustees Office, the Planning Department, all local
libraries and the Town Clerk's office.

preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and
minimizes adverse effects of development. See LWRP Section III - Policies; Page 2 for evaluation
criteria.

The proposed flagpole would be situated on previously disturbed land and would be constructed on a portion of the property that is
currently unvegetated. Moreover, the flagpole would occupy minimal space and would conceal the antennas within the pole.

Although the subject property is located in an archaeologically sensitive zone, the proposed action consists of the disturbance of 0.009±
acre which is part of a parcel of land that has already been developed to accomodate a restaurant and marina. Moreover, the design of
the proposed facility, such that the antennas would be concealed within a flagpole, would help mitigate any potential visual impacts.
Furthermore, review of all available data did not identify any historic resources proximate to the proposed facility location.
