Present Were: Absent Were: Peter Young, Acting-Chairman Jack McGreevy, Member Doug Hardy, Member James Eckert, Member Anne Trimble, Member Scott Worth, Student Member Lauren Standish, Secretary Dave Bergen, Trustee Don Wilder, Chairman CALL TO ORDER Acting Chairman Peter Young called the meeting to order at 4:45 PM. REPORTS Trustee Dave Bergen reported on a recent Town Board discussion on the issue of docks on the bay. The Town Board held a worksession on Tues., March 10tb. Mark Terry, Scott Hilary, and members of the Board of Trustees were in attendance. It was discussed that certain areas should be exempt from a ban of docks, such as M1 and M2 zones, the Orient Harbor shoreline, and yacht and boat clubs that have been established for educational purposes. These and the other areas would still have to apply for a permit and 2 meet the dock test. There was also a discussion on possibly limiting the lengths of docks to 80' from high tide and the dock would start 3' below mean high tide, to allow for public access. Where a bulkhead exists, the dock must have stairs. In addition, it will be required to reach a 4' depth at Iow tide and 15' dia. around. The height must be 3' above high-tide and constructed with open-grate decking. There was consideration for no longer allowing CCA on the pilings in the Bay, but the group agreed that is was an issue that could be addressed at a later date. Trustee Bergen provided the members of the CAC with an update on dredging. All dredging ended in January and will start up again in October. Member Jack McGreevy stated that Down's Creek was in need of dredging. It was suggested that he pursue the matter the Dredging Advisory Committee for consideration. Acting-Chairman Peter Young suggested he draft a memo and bring it back to the meeting next month for review by the other CAC members. NEW BUSINESS Acting-Chairman Peter Young introduced the members to a marine antifouling agent called Econa. It is a metal-free antifouling agent for use in antifouling coatings on the underwater part of a ship and boat hulls or static marine structures, and offers many environmental advantages. He recommends our local boating community utilize these paints and suggests the Town offer possible incentives. SPECIAL PRESENTATION Actihg-Chairman Peter Young hosted a power-point presentation on the use of a GPS, with a focus on marine use. APPROVAL OF MINUTES Moved by James Eckert, seconded by Jack McGreevy, to Approve the Minutes of February 11,2009. DISCUSSION AND RECOMMENDATION OF WETLAND PERMIT & COASTAL EROSION PERMIT APPLICATIONS Moved by Jack McGreevy, seconded by Peter Young, it was RESOLVED to SUPPORT the Wetland Permit application of JACK MAY to demolish the existing structures and construct a new 2,510 sq.ft, two-story dwelling, porch, deck, and sanitary system. Located: 1340 Cedar Point Drive East, Southold. SCTM#92-1-5 Inspected by: Peter Young, Jack McGreevy The CAC Supports the application with the Condition of a 10' non-turf buffer landward of the top of the bluff. Vote of Council: Ayes: All Motion Carried SHEILA KENNEDY to construct a 4'X 55' wood pile and timber pier including four (4) tie- off pilings and an 8'X 20' floating dock with associated hinged ramp and restraint pilings. Located: Equestrian Ave., Fishers Island. SCTM#9-9-22.1 The CAC did not make an inspection, therefore no recommendation was made. FISHERS ISLAND YACHT CLUB to dredge 13,000 cy. of sandy silt with a 1' over-dredge allowance of 6,000 cy. over 145,000 sf. by clamshell bucket for open water disposal at New London. Remove existing "A" dock with sailing program float, "B" dock with floating "T" end and dinghy dock, construct 36 If. of 7' wide main pier extension and seven 30'X 4' fixed fingers with associated support and tie-off/fender piles. Install 228 If. of 8' wide main float with eighteen 20'X 3' finger floats, 216 If. of 8' wide main float with thirteen 20'X 3' finger floats, two 20'X 4' finger floats, two 13'X 42' and one 19'X 42' sail floats all with associated ramps, restraint piles and tie-off/finger piles. Reconstruct or replace an existing 12'X 20' floating dinghy dock waterward of the apparent high water line, and install a small boat crane landward of the apparent high water line. Located: Central Ave., Fishers Island. SCTM#10-1-9 The CAC did not make an inspection, therefore no recommendation was made. Moved by Jack McGreevy, seconded by Peter Young, it was RESOLVED to SUPPORT the Wetland Permit application of THOMAS & JOYCE MESSlNA to construct an in-ground gunite swimming pool at grade located 79' from the top of the bluff, pervious patio on grade, and pool mechanicals enclosed in sound- deadening cover landward of the proposed pool. Located: 1690 The Strand, East Marion. SCTM#30-2-61 Inspected by: Peter Young, Jack McGreevy The CAC Supports the application with the Condition a drywell is installed to contain the pool backwash. Vote of Council: Ayes: ALI Motion Carried Moved by Doug Hardy, seconded by James Eckert, it was RESOLVED to SUPPORT the Wetland Permit application of ROSE L. MI1.~770 REVOCABLE TRUST to construct approx. 52 linear ft. of vinyl bulkhead in place of existing timber bulkhead and backfill with approx. 5 cy. of clean sand to be planted with Spartina patens (18" on center) to re-establish approx. 189 sq.ft, of high marsh; and construct approx. 36 linear ft. of Iow-sill vinyl bulkhead between two bulkheads and backfill with approx. 5 cy. of clean sand to be planted with Spartina alterniflora (12" on center) to create approx. 137 sq.ft, of inter-tidal marsh. Demolish and partially reconstruct (in-place 4 'and raised to FEMA-conforming F.F. EL.10') existing one-story, one-family dwelling (footprint downsized by approx. 12 percent); construct 854 sq.ft, two-story addition onto landward side of reconstructed one-story dwelling; construct 214 sq.ft, attached deck; install drainage system of drywells, leaders, and gutters; remove existing sanitary system located +30 from the wetlands and install upgraded sanitary system whose leaching pools will be located more than 100' from the wetlands; install new pervious gravel driveway; and establish an 850 sq.ft, non-turf buffer adjacent to the wetlands. Located: 1165 Island View Lane, Southold. SCTM#57-2-20 Inspected by: Doug Hardy The CAC Supports the application with the Condition the proposed Iow-sill bulkhead meets the definition of Iow-sill. Vote of CounciL: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by James Eckert, it was RESOLVED to SUPPORT the Wetland Permit application of ROBERT & SUSAN TOMAN to construct a 4'X 40' dock 3.5' above grade, a seasonal 3'X 12' ramp and a 6'X 20' floating dock. Located: 3795 Main Bayview Rd., Southold. SCTM#78-2-15.2 The CAC Supports the application with the Condition docking facility, including the vessel, doesn't exceed 1/3 across the width of the creek. Vote of CounciL: Ayes: All Motion Carried DISCUSSION AND RECOMMENDATION OF APPLICATIONS TO AMEND WETLAND PERMITS & COASTAL EROSION PERMITS Moved by James Eckert, seconded by Peter Young it was RESOLVED to SUPPORT the application of PERI HINDEN to Amend Permit #6732 to install two 8" mooring pilings on the south side of the existing dock. Located: 1255 Woodcliff Dr., Mattituck. SCTM#107-6-18 Inspected by: James Eckert, Scott Worth The CAC Supports the application, however, observed the seasonal floating dock in the water. Located: 4075 Paradise Point Rd., Southold. SCTM#81-1-10 Inspected by: Peter Young, Jack McGreevy, Doug Hardy The CAC Supports the application with the condition of a 10' non,turf buffer landward of the bulkhead. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Peter Young, it was RESOLVED to SUPPORT the application of MARY ZUPA to Amend Permit #6214 to construct a 4'X 30' fiberglass grid dock 1.5' above grade with a seasonal 3'X 18' ramp and 6'X 20' floating dock secured by (2) 8" piles, in a "T" configuration. Located: 580 Basin Rd., Southold. SCTM#81-1-16.7 Inspected by: Peter Young, Jack McGreevy, Doug Hardy The CAC SupPorts the application using best management practices in the construction of the docking facilitY. Vote of Council: Ayes: All Motion Carried Member Jack McGreevy will attend the next regular meeting of the Board of Trustees scheduled for Wed., March 18, 2009. The next meeting of the Conservation Advisory Council has been set for Wed., April 15, 2009 at 4:30 PM at Down's Farm Preserve.
