HomeMy WebLinkAboutConroy, MichaelRESOLUTION 2009-293 ADOPTED DOC ID: 4905 THIS IS TO CERTIFY THAT THE FOLLOWING RESOLUTION NO. 2009-293 WAS ADOPTED AT THE REGULAR MEETING OF THE SOUTHOLD TOWN BOARD ON APRIL 7, 2009: RESOLVED that the Town Board of thc Town of Southold hereby appoints Michael Com,oy as a full-time Fishers Island Bay Patrol, and hereby authorizes and directs Supervisor Scott A. Russell to execute an agreement between the Town of Southold and Michael Conroy, Fishers Island, to perform services as a Fishers Island Bay Patrol for the purpose of patrolling the waters in and around the Town of Southold at Fishers Island, at a compensation of $2,500.00 per annum, effective January 1, 2008' through December 31,2008, and $2,593.75 per annum, effective January 1,2009 through December 31, 2009, the Town to pay all expenses for fuel required for the operation of Mr. Conroy's boat while he is performing services for the Town, and up to $250.00 per annum for the servicing of the motor of Mr. Conroy's boat, and shall reimburse Mr. Conroy for expenses for dock space, not to exceed $1400.00 per annum; and be it further RESOLVED that the Town Board of the Town of Southold hereby appoints John Evans and George Peabody as part-time Fishers Island Bay Patrol. and hereby authorizes and directs Supervisor Scott A. Russell to execute agreements between the Town of Southold and John Evans, Fishers Island, and George Peabody, Fishers I~land, to perform services as Fishers Island Bay Patrols tbr the purpose of patrolling the waters in and around the Town of Southold at Fishers Island, at a compensation of $1,250.00 per annum, effective January 1,2008 through December 31, 2008, and $1,296.87 per annum, effective January I, 2009 through December 31, 2009, the Town to pay all expenses for fuel requited for the operation of Mr. Evans' boat and Mr. Peabody's boat while they are performing services for the Town, and up to $250.00 per annum tbr the servicing of the motor of Mr. Evans' boat and Mr. Peabody's boat, all in accordance with the approval of the Town Attorney. Box 232 Fishers Island, NY 06390 Re: Agreement of Employment Dear Mr. Peabody: This Agreement for Employment is made by and between the Town of Southold, hereinafter "Employer", and George Peabody, hereinafter "Employee", pursuant to Southold Town Board Resolution No. 2009-293 dated April 7, 2009. The Employer shall employ Employee subject to the following terms and conditions: 1. Employment for Employee shall be effective on January 1, 2008, until and through December 31, 2009. 2. The duties of Bay Patrol shall be completely performed by the Employee to the satisfaction of the Town Board of the Town of Southold. Employee shall be assigned specifically to the area in and around the Town of Southold at Fishers Island. 3. The Employee shall work a regularly scheduled eight (8) hour day and be compensated at the prorated amount of $1,250.00 per annum effective January 1, 2008 through December 31, 2008 and $1,296.87 per annum effective January 1, 2009 through December 31, 2009. 4. The Town of Southold agrees to pay all reasonable expenses for fuel required for the operation of Employee's boat while performing services for the Town, and up to $250.00 per annum for the servicing of the motor of Employee's watercraft. 5. The Employee shall NOT be reimbursed for expenses for dock space, or any other expense not specifically addressed herein. Mr. George Peabody April 8, 2009 Page 2 6. The Employee agrees to comply with all stated standards of performance, policies, rules and regulations of Employer. 7. This Agreement for Employment may terminate upon the occurrence of any of the following events: (1) failure of Employee to perform his duties satisfactorily after notice thereof; (2) for just cause based upon nonperformance of duties by Employee; and (3) upon four (4) weeks written notice by either party. Box 1179, Southold, New York 11971-0959 (hereinafter the "Town") and GEORGE PEABODY, Fishers Island Bay Patrol, with an address at P.O. Box 232, Fishers Island, New York 06390 (hereinafter "Peabody"). WHEREAS, pursuant to Town Board Resolution No. 2009-293, adopted on April 7, 2009, the Town agrees to contract for Peabody's services as a Fishers Island Bay Patrolman; and · WHEREAS, the term of such service shall be effective on January 1, 2008 through December 31, 2009; and WHEREAS, the duties of Bay Patrol shall be completely performed by Peabody to the satisfaction of the Fishers Island Harbor Committee and the Town Board of the Town of Southold and Peabody shall be assigned specifically to the areas in and around the Town at Fishers Island; and WHEREAS, these duties include patrolling the waters in and around Fishers Island, making reports as necessary, assisting law enforcement personnel in a civilian capacity, assisting the residents and visitors of Fishers Island in maintaining the peace and safety of the waters and contiguous areas in and around Fishers Island. -]- NOW, THEREFORE, IT IS AGREED AS FOLLOWS: 1. The Town will pay Peabody at the prorated amount of $1,250.00 per annum effective January 1, 2008 through December 31, 2008 and $1,296.87 per annum effective January 1, 2009 through December 31, 2009. 2. Peabody will provide a boat for the purpose of performing the duties of Bay Patrolman. 3. The Town will pay for fuel required for the operation of the boat while performing services for the Town, provided proof of mileage for fuel usage is submitted for the Town's review and is deemed reasonable. 4. The Town will pay reasonable costs for servicing the motor of the boat actually used while performing services for the Town. In no event shall the Town pay more than $250.00 per annum. 5. The Town will NOT reimburse Peabody the cost of dock space, dockage fees, registration, insurance, or any other expense not specifically addressed herein. 6. Peabody agrees to comply with all stated standards of performance, policies, rules and regulations of Bay Patrolman, as specified by the Fishers Island Harbor Committee and the Town Board of the Town of Southold. -:2- 7. This Agreement may terminate upon the occurrence of any of the following events: (a) failure to perform duties satisfactorily to the Town Board after notice thereof; (b) for just cause based upon non-performance of duties by Peabody; or (c) upon four (4) weeks written notice by either party.
