Russell SUPERVISOR RUSSELL: Please rise and join me in the Pledge of Allegiance to the Flag. Thank you. I just want to speak on a couple of issues before we get the meeting underway. Moment of Silence for Patricia Finnigan Supervisor Russell A little over a week ago, this Town Board, this Town, lost our Town attorney, Patricia Finnegan. This is the first meeting we have had since her passing. I have to tell you from a personal point of view, this job will not be the same for me, it is still a profound honor serving as your Supervisor but I do so with a very heavy heart. Patricia was an exceptional attorney, an exceptional human being. She was one of those people who painted an example for us all to follow, not just in her legal skills and her sharp intellect but Pat was not only someone who showed us how you can enjoy your job and you can excel at it but you can also always keep family first. And that is something, an example, I know as a parent of young children, it is an example I will try to follow as best as I can. I would like to ask everybody to please rise for a moment of silence. Thank you. Special Presentation Supervisor Russell Also, to follow very, very bad news with good news, on to the brighter issues of the night. We formed an Alternative and Renewable Energy Committee, shortly after I became Supervisor, it is singularly my proudest achievement as Supervisor. I actually did so at the request and the mind from Marie Domenici, who had recommended to me that we do that, so that we can, as a Town, step forward and address the concerns of the energy and the environment before we saw spikes of gas and everything else. I would like to think we are ahead of our time, any success that group has had, it has been of the hardwork of themselves and Marie. I will gladly take credit for it but I can’t. the group themselves are an outstanding group of people committed to what is best for this community, what is best for this country, what is best for this world. Marie recently stepped down as its very active chairwoman, and I want to be able to call her up and present a proclamation to her tonight to thank her and to express the gratitude of this Town Board. I will certainly allow anyone to speak on Marie’s behalf because I ran out of things to say, Marie. I just think that you are the best and I want to thank you for everything you have done for us and all the guidance you have given me these past three years. Marie, will you come on up. I have also “ been making Marie’s last name Dominici not Domenici the last three years. Whereas Marie Page 3 April 7, 2009 Minutes Southold Town Board Board Meeting Domenici, a most valued charter member and Chairwoman of the Southold Town Renewable and Alternative Energy Committee has retired from this committee as of March 11, 2009 and whereas since the Energy Committee was established in 2006, Marie has supervised an extremely active committee and has organized a regular schedule of informative meetings and seminars in order to educate the public and to make energy recommendations to the Town Board. Her record of fine service to the Town of Southold and its people deserves the sincere gratitude of those with whom and for whom she worked; and whereas Marie has raised the consciousness of our citizens and our public officials on environmental issues such as wind and solar energy, Peak Oil awareness and survival, global warming, light pollution and clean air, bringing relevant ideas and new technologies to our attention in an effort to make Southold Town as energy efficient as possible; now, therefore, be it resolved that the Town Board of the Town of Southold hereby expresses its sincere appreciation to Marie Domenici for her unselfish and wholehearted cooperation and untiring efforts on behalf of the Town of Southold, and extends its best wishes for the years ahead; and be it further resolved that this resolutions be made a part of the permanent records of the Town of Southold and a copy be presented to Ms. Domenici.” It is dated today and of course, it is on behalf of myself and this entire Town Board and Town Clerk Betty Neville. MARIE DOMENICI: Thank you. I want to thank Scott and the Town Board for (inaudible) but I work with a fabulous committee and if it wasn’t for all of the hardworking committee members, Frank Wills being one of them, who is here and the others are not here but it was just a great committee and I couldn’t have done it without their help. Thank you, Frank and everyone on our Board and the committee. Thank you. SUPERVISOR RUSSELL: One other thing that many of you already know is that Joan Egan, our favorite friend up here, passed away Friday. I had an opportunity to discuss with her daughter, Joan’s activity here, her role in our town government, keeping us on our toes. I expressed condolences on behalf of this Town Board and of course, the employees of town government. Joan made these meetings very interesting and her presence here was astounding and certainly, probably a better attendance record than me. So I have to give Joan a credit deal of credit and thanks for her time with us. Now we can basically, oh, I am sorry, let’s go to public comment, oh, I am doing all the talking. Rescinded Closing Comments Supervisor Russell SUPERVISOR RUSSELL: Okay, I would like to ask anybody that would like to address the Town Board on any issue, please do so. Donald Wagoner, Southold DONALD WAGNER: My name is Donald Wagner from Southold and I am here to talk about taxes. As you know, the tax bill every year seems to go one way, up. And it, the way it looks now because of the economic conditions, next year it is going to be even worse because the New York State pension fund must be reimbursed. And that will affect this Town Board, this will affect the police budget, this will affect each individual school budget and therefore, we have to start planning now for next year. The paper I gave you is regarding schools, which may come as a surprise, maybe not. I am recommending that we consolidate into one school district for the entire town and in order to get everyone on board, these figures have got to get out to everybody. I can speak for the Southold school board and they are looking into it but the other school boards, I am not familiar with. As you can see from this, the largest school districts up the island and I mention Shoreham-Wading River, Patchogue and Middle Country, their cost per student is $19,000 all the way down to $17,000 which is very interesting because the current budget here, the budgets in the Town of Southold, Greenport is running $22,000 per student; Mattituck - $22,000 per student; Oysterponds-$30,000 per student and Southold school district-$26,000 per student. The last school board meeting last week, their proposed budget which is not firm yet for st next year starting July 1, they plan to raise the budget 2.3% and the student population is going down. So the cost per student, if they stay the way it is the figures, in Southold will go from $26,000 per student to $27,800 per student. This is quite a big figure. And whereas the savings between consolidation, because you only need one superintendent, we have as an example in Oysterponds you have only got 200 students and you have a principal there in the one building and you have also got a superintendent. And in Greenport, you have 640 again and you have got principals and a superintendent. And the savings that I show on the bottom there for each one, that is not just a consolidation and elimination of three superintendents but it is also to control Page 25 April 7, 2009 Minutes Southold Town Board Board Meeting the spending. They just signed a contract for Southold last year which is effective right now, everybody got a 4% increase plus a longevity, they actually got over 7% and the cost of living last year for us seniors only went up 2.3%, so you can see my concern here. And I would ask that each and every Board member make an earnest effort to contact the schools, perhaps some of you live in Oysterponds school district or Mattituck-Cutchogue school district and let them know that hey, we can save a substantial amount of money if we consolidate. And as I said, up the island, I came from Smithtown originally where they had roughly 10,000 students and they had one superintendent, two high schools, three intermediate schools and six or seven elementary schools. And one superintendent. So you can see the savings here and by keeping one principal in each of these buildings, the argument that, oh, we will lose our home rule touch, it has no weight because most of the directives are mandates coming from the state or federal government and so I would ask that you, in your travels, try and contact these other school districts and see if you can’t convince them to consider consolidation because the taxpayer needs some relief. I am here to thank the Southold Town Board on behalf of the Southold Town Mothers Club for allowing us to use the Recreation Center for the first annual bunny breakfast. The center looked lovely, not quite finished yet but it looked really nice. I guess someone took a little extra time and cleaned it up very nice for us. I didn’t know how to light the oven but someone showed up in the morning and lit the oven for us. SUPERVISOR RUSSELL: Is the building still there? MS. GOLDSMITH: Unfortunately it rained and the Easter egg hunt was held inside, so no one left. Everyone came, it was the first year so we tried not to let it get too big, just to see how it was going to go, there were probably well over 160, well there was probably more than 160 because the little kids, you know, didn’t pay, so there was probably 175 people. Everybody stayed for the egg hunt at noon but the building was in good shape, it was perfect for what we wanted to do, I can’t tell you how much we appreciate using it and we hope that, you know, we left it truly in pristine condition. And we hope that we will be allowed to use it again next year, it was extremely successful and this way we can keep having activities for kids from Laurel to Orient and you know, do bike giveaways and Relay for Life and all of that. So I really want to thank you. You will get a formal note but I wanted to come here, it was really generous of the Town Board to let us just go to town in there and we did. And the other thing, I go want to correct Mr. Wagner, Oysterponds has one superintendent. It does not have a principal. And I know because I hired him. Thanks. SUPERVISOR RUSSELL: Thanks. Nancy Sawastynowich, Cutchogue NANCY SAWASTYNOWICZ: Good evening. Nancy Sawastynowicz of Cutchogue. At the Page 26 April 7, 2009 Minutes Southold Town Board Board Meeting Town Board work session this morning, the subject of discussion, item number 2, was the Southold Town water map. That map is at the heart of a legal regulation of public water supply on the north fork. We need a clear and well understood water map. We have a cloudy, misunderstood water map which is not serving development and is inviting environmental disaster. A notable issue raised at the work session was Suffolk County Water Authority CEO Steve Jones request to run a transmission main over land protected by a conservation easement. I thought that such land was protected from development. One Town Board member asked why should we keep amending the water map if we only have a limited supply of water. In June of 2000, Suffolk County Water Authority told the Town Board, we are at our limit now. Suffolk County Water Authority can provide water for only another 700 or so residents. Then in September 2002, Suffolk County Water Authority CEO Steve Jones that enough water was for any and all customers, would be available in a year or two. So which is it? Is our public water supply limited or unlimited? And I just feel it is a very crucial issue and you guys asked really good questions today and I thank you all for that and then when he just said about East Marion’s water, he goes, I just want to through this out there and it is just so nonchalant to him and I think that that should have a SEQRA report done if they are going to make a water main for East Marion to Brown’s Hills because he mentioned there is salt water under the water of Brown’s Hills already, so that will just become one big sewerage treatment plant of mother nature if they keep pumping water out of it. Thank you. SUPERVISOR RUSSELL: Thank you. COUNCILMAN WICKHAM: Can I just respond very briefly? There is a lack of clarity about the water map and one of the decisions we made this morning is to put it up on our website. The map with all of the definitions right on it. So that at least it would be clear to the public to see what the map is, what it means, where it goes and there would be one less item of confusion and unknown. SUPERVISOR RUSSELL: Okay. Benja. Councilman Thomas Wickham Benja Schwartz, Cutchogue BENJA SCHWARTZ: Good evening, Benja Schwartz, Cutchogue. I couldn’t resist when you were talking about the website, Tom. I wasn’t going to say anything tonight but I think it is a great idea to put it up on the website but I did look at the Suffolk County Water Authority website today and they have a water map up there. it says it, the water map was dated December 2008 but it says it was adopted by the Suffolk County Water Authority in 2006 and adopted by the Southold Town Board in 2007. How could it have been adopted two years before it was drawn? The map. It doesn’t, and along those lines, the resolution tonight, number 303, the first paragraph where it used the abbreviation, it explains that DGEIS is draft generic environmental impact statement. Then in the next paragraph it becomes the DSGEIS and throughout the resolution it is DSGEIS and the final SGEIS. What is an SGEIS? SUPERVISOR RUSSELL: Draft environmental impact statement. SUPERVISOR RUSSELL: We didn’t vote on an acronym, we voted on the text of the resolution, which was to accept the report with the public input of the TDR public hearing we had a few months ago. COUNCILMAN KRUPSKI: It does not stand for secret. It stands for supplemental. MR. SCHWARTZ: Supplemental. Okay. Thank you very much. SUPERVISOR RUSSELL: Peter. Peter Harris, Supt Highways PETER HARRIS: Good evening, Pete Harris, Superintendent of Highways. I am sorry I didn’t get here earlier but I am glad that I got here because I am happy to announce last Friday I had the chance to have a conversation with Legislator Fred Thiele from the south fork and he told me that our trip to Albany on advocacy day of the highways, it must have paid off because he said that the CHIPS money that Governor Patterson had wanted to take out of the budget was totally reinstated, so the 43% that Southold Town and every other town in Suffolk County was going to lose has been reinstated in this year’s budget. So that is like $140,000. SUPERVISOR RUSSELL: Thanks. Thank you very much, Peter. And thank you for going to Albany and fighting on our behalf. Would someone else like to address the Board on any issue? Ann Murray, East Marion ANN MURRAY: Ann Murray from East Marion. I wanted to find out, because I wasn’t here this morning. Was there any update on the Bombara litigation? SUPERVISOR RUSSELL: Not yet. The Town Board hasn’t rendered a decision on that particular application. MS. MURRAY: Is there a court date? I understand he is suing the Trustees, correct? SUPERVISOR RUSSELL: He has filed two motions, I will defer to the Town Attorney on this. ASSISTANT TOWN ATTORNEY ANDALORO: Presently the return date on his article 78, I believe, is April 22. MS. MURRAY: Okay. ASSISTANT TOWN ATTORNEY ANDALORO: I do think we are going to be getting an adjournment on that. There is also another portion of his action, a declaratory judgment, which will go through the normal course of litigation. MS. MURRAY: Right. Okay. And I notice there is other litigation in here, Corso vs., what is that litigation about? Does anybody know? Page 28 April 7, 2009 Minutes Southold Town Board Board Meeting ASSISTANT TOWN ATTORNEY ANDALORO: I can tell you what it is about. Corso is an adjacent property owner to Mr. Steele and the Planning Board issued a letter to the Building Department saying it didn’t think site plan was required and Mr. Corso is challenging the issuance of that letter and he is also trying to prevent the Building Department from issuing a building permit to Mr. Steele. SUPERVISOR RUSSELL: Mr. Steele has a structure which is accessory to the principal dwelling there. He also has an agricultural operation. I believe the Planning Board determined that as an agricultural building, accessory to the structure, it didn’t need site plan. The Building Department ruled that everything had been complied with to issue site plan NCO. He is challenging those decisions. MS. MURRAY: Okay. Thanks. SUPERVISOR RUSSELL: Would anyone else like to address the Town Board? COUNCILMAN WICKHAM: Do you want to announce the meeting at 6:00? SUPERVISOR RUSSELL: Yeah, we do have a meeting at 6:00. it is on the Arshamomaque pond watershed management plan. We have actually received grant money and this basically involves the Hashamomuck pond side, it is integrated plan that involves all levels of government including the town, county and others. Homeowners, to raise the quality, the water quality of that body of water and protect it for the future. We actually have a public informational hearing coming up at 6:00. Laurel Stevenson, I believe, is making the presentation this evening. If you have any questions about that, we can either answer them now or answer them at 6:00.
