WITNESSETH, that the party opart, in consideration of ten dollars and other valuable consideration
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being in the Town of Southhold, Suffolk County, New York, known and designated as Lot 38 as
shown on a certain map entitled, "Map of Proposed Sub-Division, Section A, Nassau Point Club Properties,
Inc." filed in the Office of the Clerk of Suffolk County, New York, on October 4, 1919 as Map No. 745, and
"Amended Map A of Nassau Point" tiled in the Office of the Clerk of the Comity of Suffolk, New York, on
August 16, 1922, as Map No. 156,w hich said lot is more particularly bounded and described as follows:
BEGINNING at a monument set on the easterly side of Nassau Point Road where same is intersected by the
southerly side of Lot 37, said point also being distant 200.1 feet (more or less) southerly from the corner
formed by the southerly side of Peconic Bay Road with the easterly side of Nassau Point Road;
RUNNING THENCE along the southerly side of Lot 37, North 78 degrees 36 minutes 20 seconds East, 368.00
feet to the ordinary high water mark of Little Peconic Bay;
THENCE along the ordinary high water mark of Little Peconic Bay, South 10 degrees 15 minutes East, 99.92
feet to the northerly side of Lot 39 on the aforesaid map;
THENCE along the northerlsy side of Lot 39, South 78 degrees 36 minutes 20 seconds West, 363.00 feet to the
easterly sdie of Nassau Point Road;
THENCE along the easterly side of Nassau Point Road along a tie line course of North 13 degrees 06 minutes
50 seconds West, 99.95 feet to the point or place of BEGINNING.
BEING the same property acquired by the grantors by deed dated 1/4/89 recorded 2/8/89 in the Suffolk County
Clerk's office in Liber 10795 page 238.
Said premises is known as: 5655 Nassau Point Road, Cutchogue, NY 11935.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all
the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the
premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the
second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
