Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department as well as the records available to me, it is my determination that the proposed action is generally CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP. Pursuant to Chapter 95, the Town Board shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Policy 1. Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. This proposal is for the redevelopment of the Town of Southold Animal Shelter on a 12.42 acre parcel in the R-80 Zone located on the northwest comer of State Road 25 and Peconic Lane in Peconic. The proposal is in conformance with the existing use of the parcel, which is comprised of several municipal support services (the Town of Southold Police Station is located to the south, The Town of Southold Highway Department is located to the east). A single-family residence is located to the west of the property, however, no structures are immediately adjacent to the current Animal Shelter building in this area. To the east the parcels are improved with single-family residences. Due to the current and projected use of the pamel there is no opportunity to preserve significant open space. No significant adverse impacts are expected to the above goals as a result of the development of the property. Policy 2. Protect and preserve historic and archaeological resources of the Town of Southold. No historical structures or known archeological resources exist on site. Policy 3. Enhance visual quality and protect scenic resources throughout the Town of $outhold. The use currently exists on-site, consequently, due to the location and orientation of the current improvements, no significant visual impacts will result from the redevelopment of the parcel. Policy 4. Minimize loss of human life, structures, and natural resources from flooding and erosion. No loss of human life, structures or impacts to natural resources from flooding and erosion will occur as a result of this action. Policy 5. Protect and improve water quality and supply in the Town of Southold. The property is served by public water. Waste is disposed of via an existing, functioning on site sanitary waste system. Potential surface- water runoff generated from the structure and parking area must be disposed of via sub-surface leaching pools (dry-wells) located throughout the property. To further protect ground water quality and conserve water supply to the greatest extent possible it is recommended that the Town Board encourage the following best management practices for landscaping, lawn establishment post construction. 1. Minimize lawn area by retaining existing natural vegetative buffers. 2. Where possible, require native, disease-resistant and drought-tolerant plant species within the landscape. Policy 6. Protect and restore the quality and function of the Town of Southold ecosystems including Significant Coastal Fish and Wildlife Habitats and wetlands. This policy does not apply to this action. Policy 7. Protect and improve air quality in the Town of Southold. No significant impact to air quality will occur as a result of the proposed action. Policy & Minimize environmental degradation in Town of Southold from solid waste and hazardous substances and wastes. Solid wastes will be properly disposed of at the Town of Southold Landfill and therefore no significant adverse impacts due to solid waste will occur as a result of this action. No hazardous substances have been identified on or incorporated within the proposed action. The Policy could be further supported by the following solid waste management initiatives: a. The use of the Town of Southold Compost Facility materials which contribute to the replenishment of organic matter in local soils and help reduce the reliance of chemical fertilizers and herbicides and minimize the reduction of chemical fertilizers and herbicides in the Town's ground and surface waters. b. Participating in the Town of Southold's STOP program. c. Eliminating or reducing the generation of hazardous wastes to the maximum extent practical. d. Recovering, reusing, or recycling remaining hazardous wastes to the maximum extent practical. Policy 9. Provide for public access to, and recreational use of, coastal waters, public lands, and public resources of the Town of Southold. The Animal Shelter serves the public through the management of domestic animals. The parcel is not located adjacent to a water body or recreational area, therefore, there is no opportunity to meet this policy. Policy 10. Protect Southold's water-dependent uses and promote siting of new water- dependent uses in suitable locations. There is no opportunity to meet this policy. Policy 11. Promote sustainable use of living marine resources in Long Island Sound, the Peconic Estuary and Town waters. There is no opportunity to meet this policy. Policy 1Z Protect agricultural lands in the Town of Southold. No agricultural lands occur on site. The use will not conflict with adjacent agricultural operations. There is no opportunity to meet this policy. Policy 13. Promote appropriate use and development of energy and mineral resources. To further this policy, it is recommended that the Town Board consider the implementation of Long Island Power Authority's Clean Energy Initiative Program for Commercial Buildings within the design and construction of the Animal Shelter to employ cost effective environmental friendly energy.
