LWRP CONSISTENCY ASSESSMENT FORM
INSTRUCTIONS
D~C - 5 2005
All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
lfany question in Section C on this form is answered "yes", then thc proposed action may affect the
achievement of the LWRP policy standards and conditions contained in the consistency review law.
Thus, the action should be analyzed in more detail and, if necessary, modified prior to making a
determination that it is consistent to the maximum extent practicable with the LWRP policy
standards and conditions. If an action cannot be certified as consistent with the LWRP policy
standards and conditions, it shall not be undertaken.
A copy of the LWRP is available in the following places: online at the Town of Southold's website
(southoldtown.northfork.net), the Board of Trustees Office, the Planning Department, all local
libraries and the Town Clerk's office.

Nature and extent of action:
Owner proposes to construct a 36' x 60' four bedroom single family dwelling with 12' x 34' wood deck attached to the east side. Owner
also proposes to install a 20' x 40' pool to the north of the proposed dwelling. To the immediate east of the proposed oool. the owner
proposes to construct a 30' x 24' earaee. Owner also oroooses to install sanitary system with retaining wall~ 4 drywells which will
handle the runofffrom the proposed dwelling and garage~ and one drywell that will serve the pool. The owner proposes to erect a 70'±
wall northwest of the orooosed uool runnin~ north-south along the northern lot line. Owner also uroooses to brin~ in aooroximatelv
1400 yards3 of fill to raise the elevation of the area to be built to approximately 10'+ above mean sea level. Finally~ the owner proposes
to install a i 100 ft2± gravel driveway connectin~ the earaee with Kreh Road.

DEVELOPED COAST POLICY
Policy 1. Foster a pattern of development in the Town of Southold that enhances community character,
preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and
minimizes adverse effects of development. See LWRP Section m - Policies; Page 2 for evaluation
criteria.

As indicated within Policy 1, "Development that does not reinforce the traditional land use pattern of the
Town of $outhold would result in a loss of the community and landscape character of $outhold.", this
project is a proposal to improve an undeveloped lot with a dwellin.q and related appurtenances that are
common to the surroundincl area, which is higthly developed. The proposal, as desiqned, will not result in
adverse effects to the surroundinq environment in that it meets all required setbacks from situate wetlands.
In addition, all dwellinqs in the surrounding1 area have coexisted harmoniously with the environment for
years. Situatingl dwellinqs this close to a marina makes qaod use of infrastructure as it removes the need to
construct separate dockinq facilities for each dwelling1. Accordingjly, we believe that this project is
consistent with this policy.

Policy 3. Enhance visual quality and protect scenic resources throughout the Town of Southold. See

Subject proposal will not adversely impact the visual quality of the surroundin.q area in that the surroundin.q
area is currently comprised of properties improved with sinqle-family dwellinqs of similar, if not lar.qer, size. While
the area of the proposal is lackingl in scenic resources, the proposed dwellinq will not impede line of siglht
throuqh subject lot any more than it is impeded now as said lot is higlhly veqetated. Therefore, this proposal will
comply with Policy 3.

NATURAL COAST POLICIES
Policy 4. Minimize loss of life, structures, and natural resources from flooding and erosion. See LWRP
Section Ill - Policies Pages 8 through 16 for evaluation criteria

Subject proposal will fully comply with Policy 4 in that the construction will be completed after clean fill has
been imported to raise the built area to an elevation of approximately 10 ft above mean sea level. This
heiqht and the fact that the proposal is located inland off a sheltered branch of James Creek clreatly limit
the patential for loss af life, structures or natural resources from flooding. As the proposal is not directly
adjacent to any surface waters, the potential for damacle from erosion is neqliqible. Accordinqly, the
proposal is consistent with Policy 4.

Policy 5. Protect and improve water quality and supply in the Town of Southold. See LWRP Section III
- Policies Pages 16 through 21 for evaluation criteria

Subject proposal will comply with Policy 5 in that the property will utilize a pdvate well, as well as to utilize an
efficient sanitary system, which will be compliant with the requirements of the Suffolk County Department of
Health Services. As a substantial portion of Southold Town is now on public water, this proposed private well
will not adversely impact the quantity of potable water in the Town of Southold. As the proposed sanitary
system is compliant with Health Code, it will not adversely impact the quality of potable water in the Town
of Southold. Accordinclly, the proposal is consistent with Policy 5.

Policy 6. Protect and restore the quality and function of the Town of Southold ecosystems including
Significant Coastal Fish and Wildlife Habitats and wetlands. See LWRP Section III - Policies; Pages 22

Subject proposal wilt comply with Policy 6 in that the proposed improvements are, as closely as possible
desiqned to meet the environmental ~uidelines and requirements of both the Town of Southold Board of
Trustees and the New York State Department of Environmental Conservation, and consequently, will
maintain the nteglr ty of the surround nfl ecosystem. In addition, the raisinq of the construction site to a
hiqher elevation will further separate the proposal from situate wetlands.

Subject proposal is not applicable in that the proposal is simply to improve subject property with several
small additions to the dwellinq and a flaraqe which historically do not result in any form of adverse effects
to air quality. Accordinqly, this proposal is not applicable with this policy.
