I have indicated that all policies are "Not Applicable," because pursuant to §95-5(A) and the corresponding defmifions of "action" and "minor action" by §95-3, the submission of a LWRP Consistency Assessment Form is not required for this application, as the proposed work entails only the in-kind, in-place replacement of an existing structure, i.e., "maintenance or repair involving no substantial changes in an existing structure or facility." I had forwarded a similar letter directly to the Trustees office but was advised that the LWRP form must still be submitted and directed to your attention so that you may make the formal determination that the application is exempt as indicated above. Please contact me if you have any questions or require any further information regarding this submission, Re~ly yours~.~ Robert E.
