The proposed action involves the construction of a 4' x 25' fixed dock, 3' x 12' ramp and a 6' x
20' float with dolphin poles at each end. The proposed action is located within REACH 1.
The proposed action has been reviewed to Chapter 95, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation
that the proposed action is generally CONSISTENT with the Policy Standards and
therefore is CONSISTENT with the LWRP provided that the following outstanding items
are submitted and standard best management practices are implemented to further the
intent of the LWRP Policies 5, 6, 10 and 11.
To further the intent of LWRP Policies 5, 6, and 8 and to protect water quality and
the health of marine organisms no CCA treated wood~ oil based preservatives
containing creosote (CRT) or pentachlorophenol (PCP)~ applied to the surface of
wood materials shall be permitted in the construction materials of the bulkhead~
walkway, dock or ramp. The applicant shall use a decay resistant alternative.
The proposed detailed construction practices and materials have not been identified
and should be outlined in writing to the Board.
Although the application states that the disturbed areas will be restored~ a
restoration plan outlining species~ timing and specifications has not been submitted
to the Board. Such a plan should be submitted to the Board.
4. During construction of the structure~ require the encirclement of the entire proiect
area with a floating turbiditw screen to remain in place a sufficient number of days
to allow the settling of the suspended solids.
Pursuant to Chapter 95, the Board of Trustees shall consider this recommendation in preparing
its written determination regarding the consistency of the proposed action.
