INSTRUCTIONS LWRP CONSISTENCY ASSESSMENT FORM All applicants for permits* including Town of Southold agencies, shall complete this CCAF for proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law This assessment is intended to supplement other information used by a Town of Southold agency m making a determination of consistency. *Except minor exempt actions including Building Per3mts and other ministerial permits not located within the Coastal Erosion Hazard Area. Before answering the questions in Section C, the preparer of tllis form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Lc)cai Waterfront Revitalization Program. A proposed action, will be evaluated as to its significant beneficial and adverse effects upon the coastal area (which includes all of Southold Town) If any question in Section C on this form is answered "yes", then the proposed action may affect thc achievement of the LWRP policy standards, and conditions contained in the consistency review law Thus, the action should be analyzed in more detail and, if necessary, modified prior' to makine a determ~ation that it is consistent to the maximum extent practicable with the LWRP policy standards and conditions. If an action cannot be certified as consistent with the LWRP policy standards and conditions, itshall not be undertaken. Replace same imlike, in- place. Policy I DEVELOPED COAST POL~C/ES Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient uso of infrastructure, makes beneficial uso of a coastal lecaUon, and minimizes adverse effects of development. This is a waterfront piece of property that is presently bulkheaded. The bulkhead is failing and needs to be reconstructed. The boardwalk is a buffer area for the property to walk. All structures are existing. There will be no increased development and our proposal is an effort to maintain existing structures. Policy 2 Policy 3 Presorve historic resources of the Town of Southold. This property has no significant historic resources. Enhance visual quality and protect scenic resources throughout the Town of Southold, The bulkhead at this location is existing. The present condition of this bulkhead is showing its age by presenting holes in the sheathing and leaking of backfill. A new bulkhead is just an attempt of the upland property owner to maintain her property. All structures are existing so the visual quality and scenic resources will remain the same. NATURAL COAST POL/CZES Policy 4 Minimize loss of life, structures, and natural resources from flooding and erosion. The existing bulkhead is needed to protect the upland property. This shoreline is mostly reinforced with erosion control structures. The new bulkhead will not increase flooding or erosion in this area. Policy 5 Protect and improve water quality and supply in the Town of Southold. This proposal will not have any impact on the water quality and supply of the Town of $outhold. Policy 6 Protect and restore the quality and function of the Town of Southold's ecosystem. This proposa~ will not have any impact on the Town of Southold's ecosystem. Policy 7 Policy 8 Protect and improve air quality in the Town of $outhold. This proposal will not have any impact on the air quality of the Town of Southold. Minimize environmental degradation in the Town of Southold from solid waste and hazardous substances and wastes. This proposal will not degrade the environment with solid waste or hazardous substances. PUBLTC COAST POi/C/ES Policy 9 Provide for public access to, and recreational use of, coastal waters, public lands, and public resources of the Town of Southold. Our proposal will not limit public access to the coastal waters or public resources of the Town of Southold. There is a bulkhead presently existing and we are proposing for in-place construction. All structures are landward of the AHWM. WORIGNG COAST POLTC~ES Policy 10 Protect the Town of Southold's water-dependent usos and promote siting of new water- dependent uses in suitable locations. Our proposal is to reconstruct a failing bulkhead. The present condition of the bulkhead is poor and is unsafe. The construction of a new bulkhead in its place will allow the property owners to safely Policy 11 · approach this waterfront. All structures are in need of reconstruction to maintain the integrity of this property. Promote sustainable use of living marine resources in the Town of Southold.
