Main Rd. & Youngs Ave.) Southold, NY Telephone: 631 765-1938 Fax: 631 765-3136 To: Town of Southold Board of Trustees From: Mark Terry, Senior Environmental Planner LWRP Coordinator Date: November 15, 2006 Proposed Wetland Permit for JONATHAN & ANDREA PARKS SCTM#111-9-5.1&5.2 Catherine Mesiano, Inc. on behalf of JONATHAN & ANDREA PARKS requests a Wetland Permit to repair the damage to bluff using approx. 200 cy. of fill; replace existing bulkhead to secure bluff; repair and replace (where needed) existing stairs to beach; re-grade yard and install plantings to prevent fmther erosion; install drywelis and catch basins in front yard to prevent water from reaching bluff; re-grade and install retaining walls (approx. 80' from bluff) to level portion of waterside yard; construct 32'X 50' addition to existing dwelling; install pool and patio; and re-vegetate bluff with beachgrass approx. 18" on center. Located: 3995 Nassau Point Rd., Cutchogue. SCTM# 111- 9-5.1&5.2 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the denoted following Policy Standards and therefore is INCONSISTENT with the LWRP. I Policy 6 Protect and restore the quality and function of the Town of Southold ecosystem. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. The proposed distance from the pool to the bluff (restored) is 80 feet~ a minimum setback distance of 100 feet is required pursuant to Chapter .~ 275-3. Findingsl purposel iurisdiction; setbacks. Please require that the applicant amend the application to meet the above policy to the greatest extent possible. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permit and other ministerial permits not located within the Coastal Erosion Hazard Area OCT 2 ~ 2006 2. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its significant beneficial and adverse effects upon the coastal area (which includes all of Southold Town). 3. If any question in Section C on this form is answered "yes", then the proposed action may affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus, the action should be analyzed in more detail and, if necessary, modified prior to making a determination that it is consistent to the maximum extent practicable with the LWRP policy standards and conditions. If an action cannot be certified as consistent with the LWRP policy standards and conditions, it shall not be undertaken. Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. See LWRP Section IH - Policies; Page 2 for evaluation criteria. Yes No Not Applicable In October 2006 s(qnificant damage to the Bluff occurred as a result of a 6" rainfall. There was/is an ongoing landscape and grading project, undertake, in part to correct a stormwater runoff condition. The Town Trustees issued an Emerqency Permit to temporarily retain the damaged bluff and install haybales as a temporary measure. All proposed site work is beinq undertaken primarily for the purpose of repairinq and restoring the Bluff and preventinq any further damage to the Bluff or structures Policy 2.
