'FOR CONSIDERATI HURS. , OCTOBER 27, 1983:
Per attached correspondence, Mr. Curran would like to
withdraw Appeal No. 2912, a conditional variance which
was granted for a shed in the sideyard area 11/5/81
provided shed is not larger than 200 sq. ft.
Mr. Curran would prefer to have existing porch rebuilt
and enlarged by 146 sq. ft. rather than the 200 sq. ft. shed.
He would still be under the 20% lot coverage requirement.
Mr. Hindermann asks WHETHER THE ZBA AGREES with him that
if the porch enlargement (of 146 sq. ft.) is permitted
by Building Department that Mr. Curran must return to
the ZBA for any future construction, shed or otherwise,
for lot coverage.

Dear Jerry:
?eter Stoutenburgh has submitted an application to extend
an existing porch on the main building for the above. This
proposed extension will increase lot coverage by 146+ sq. ft.
Appeal #2912 dated October 31, 1981 was for an accessory
structure in the side yard area. One of ~he conditions under
this appeal was that the structure was not to exceed 200 sq. ft.
to maintain lot coverage not to exceed 20%.
To date they have not gone ahead with the construction of
this shed, however, this appeal has granted permission for this
accessory structure.
Before I issue a building permit for porch extension, I
believe your Board should review this variance~ appeal # 2912,
and put Mr. C~rran on notice that should he in~end to construct
the accessory structure after enlargement of porch he will have
to go back to your Board for variance for excessive lot coverage,
if you are inclined~to consider such appeal.

Dear Members of the Board of Appeals,
I am writing this letter on behalf of Mr. Frank Curran, of Fisherman's
Beach, Cutchogue. I am requesting, that you accept his withdrawal of
the appeal granted him, for a storage shed ( #2912, granted on 11-5-
81 )
Mr. Curran, at this time, would appreciate your consideration in acc-
epting his building permit (currently before the Building Dept.), re-
garding the reconstruction of an existing porch (deck), and its en-
largement, along the south side of his home. It would then be enclosed,
with screens. This proposal, of an enlarged screened in porch, does not
encroach on any new side yard or rear yard set back.
This request, for adjustment between permits, came from Mr, Ed Hindermann,
of the Building Department. Please contact me, if there is any need for
additional information regarding this matter.

By this appeal, applicants seek permission to construct
an accessory building (proposed shed) containing a square foot-
age of 312 square feet, in the sideyard area with a setback from
the easterly sideyard line of not less than three feet and a
setback from the northwesterly end of the rear yard property
line of six feet. The premises in question contains an area of
15,470 square feet with road frontage along Haywaters Road of
120 feet. The premises is improved with a substantial one-
family dwelling and newly constructed addition, containing a
total area of approximately 3,130 square feet. The applicant's
agent has submitted for the ~record the percentage of lot cover-
age which has been provided by Roderick VanTuyl, P.C., licensed
surveyor, of which the existing dwelling with new addition covers
20% of the lot, and together with the proposed shed covers 22%.
The board does find that the premises contains no practicable
buildable rearyard area, and the location of the existing dwell-
ing lends itself to the practical difficulties in locating the
proposed shed in the sideyard area. The board agrees that the
proposed location of the shed is the most feasible and practical
under the circumstances; however, Section 100-31, Bulk Schedule,
of the code requires a maximum percentage of lot coverage to be
20%. Therefore, it is the determination of this board that the
size of the new accessory building be reduced to 200 square feet,
or, that 112 square feet of building area be eliminated from
either structure (the shed or the dwelling), which will be within
the spirit of the zoning ordinance.
In considering this appeal, the board determines that the
variance request is not substantial; that the circumstances
herein are unique; that by allowing the variance no substantial
detriment to adjoining properties would be created; that the
difficulty cannot be obviated by a method, feasible to appellant,
other than a variance; that no adverse effects will be produced
on available governmental facilities of any increased population;
that the relief requested will be in harmony with and promote the
general purposes of zoning; and that the interests of justice
will be served by allowing the variance.

On motion by Mr. Goehringer, seconded by Mr. Grigonis, it
RESOLVED, that the application of Frank Curran and wife,
Appeal No. 2912 be GRANTED,. SUBJECT TO THE FOLLOWING CONDITIONS:
(1) That the shed shalI not exceed 200 square feet in area
when using Roderick VanTuyl, P.C.'s calculations as to lot coverage;
(2) That the setback of the shed will be a minimum of 10 feet
from the existing bulkhead and a minimum of five feet from the side
yard property line;
