required title search.and surveys required for all acquisition of agriculturaJ righ[s.,_,
COUNCILMAN STOUTENBURGH: Wasn't their property surveyed before they---
TOWN ATTORNEY TASKER: No. A lot of those farms have never been surveyed.
COUNCILMAN STOUTENBURGH: I thought that was part of the--
COUNCILMAN SCHONDEBARE: Yes, I agree with Paul. I thought that was part of
the thing.
TOWN ATTORNEY TASKER: No, that comes afterwards. The option agreement
provides for a price of so much per acre. Depending upon the survey, an accurate
survey that will be made after the option agreement, and the price will be adjusted.
In other words, if you're saying it's 3~l acres and we have it surveyed and it's 32,
that's what we pay for.
COUNCILMAN TOWNSEND: Now, what we've done--we took surveys and put points
on surveys.
TOWN ATTORNEY TASKER: We didn't want to go through with all of the expense
of having all of these farms surveyed and then you,re only going to pick ten out
thirty.
COUNClL/~AN SCHONDEBARE: Right. I remember that. You're right.

Request for Agricultural Equipment Storage Building

Landowner: Briarcliff Nursery/Frank Cichanowicz
On January 30, 2004, Bill Kelly, agent for Bdamliff Nursery/Frank Cichan0wicz, sent
a letter to the Land Preservation Committee requesting permission to erect a 42' x 90'
agricultural equipment storage building within the existing Town Development Rights
Easement. The location of such is shown on a survey dated 9-9-03, of which your office
already has a copy; however, rye attached a copy of the proposed building location for
your convenience.
The Land Preservation Committee, in accordance with Section 25-50 C. (2) [3] of
the Town Code, reviewed the request at the February 10, 2004, Land Preservation
Committee meeting. The recorded easement for this property allows land within the
easement to be used for the purpose of agricultural production. The Committee
determined that the requested agricultural equipment storage building is allowed within the
easement ama. A motion was presented and unanimously adopted to recommend
approval and construction of the agricultural equipment storage building in the proposed
location, in accordance with all applicable Code requirements.

Request for Revised Location of Agricultural Equipment Storage Building

On March 2, 2004, Bill Kelly, agent for Briarcliff Nursery/Frank Cichanowicz, sent a letter to
the Land Preservation Committee together w~th a .revised site plan showing a revised location for a
proposed Agricultural Equipment Storage Building.
The building is shown as a 42' x 90' agricultural equipment storage building and is
proposed to be located within the existing Town Development Rights Easement. The location of
such is shown on a survey dated 3-01-04, of which your office already has a copy; however, I've
attached a copy of the proposed building location for your convenience.
The Land Preservation Committee, in accordance with Section 25-50 c. (2) [3] of the Town
Code, reviewed the request for the revised location at the March 9, 2004, Land Preservation
Committee meeting. The recorded easement for this property allows land within the easement to
be used for the purpose of agricultural production. The Committee determined that the requested
agricultural equipment storage building is allowed within the easement area. A motion was
presented and unanimously adopted to recommend approval and construction of the agricultural
equipment storage building in the proposed location, in accordance with all applicable Code
requirements.
