By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce hardship because (SEE REVERSE SIDE) practical difficulties or unnecessary (b) The hardship created (is) (is not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because (SEE REVERSE SIDE) (e) The variance (does) (does not) observe the spirit of the Ordinance and (would) change the character of the district because (SEE REVERSE SIDE) (would not) and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. CG: lk FORM ZB4 ZONING BOARD OF APPEALS After investigation and personal inspection, the Board finds and determines as follows: By this appeal, appellant proposes to divide premises into three parcels, containing areas of approximately 12,000, .11,000 and 9,000 square feet. Existing on the southerly propose-d parcel (approx. 9,000 sq. ft.) is an existing one-family dwelling with garage. It is the opinion of the Board that the entire premises is not buildable, in effect, for three dwellings. The Board finds that the relief requested is substantial in relation to the Code requirements of 40,000 square feet; that - the relief requested is not unique; that the spirit of the zoning ordinance would not be observed if this relief were granted; that a hardship or practical difficulty has not been shown; and that the interests of justice would best be served by denying ~he variance requested herein. On motion by Mr. Goehringer, seconded by Mr. Grigonis, it was RESOLVED, that Anna L. Bertero be denied a variance to the zoning ordinance without prejudice for approval of insufficient area of three proposed parcels as applied for in Appeal No. 2827. She has received a notice from the Town of Southold with regard to the application you have submitted to the Zoning Board of Appeals. She is concerned that a future owner of the property might disturb the embankment and in turn her retaining wall between lot 73 and 74. In order to help us insure that her rights to lateral and subjacent support are maintained, we would like you to consider adding, as a condition for subdivision and development of the property, a requirement that the retaining wall not be disturbed and that any building or construction on lot 74 be located a minimum of 30 feet from the retaining wall.
