SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property
under consideration in this application and determines that this review falls under the
Type II category of the State's List of Actions, without further steps under SEQRA.
SUFFOLK COUNTY ADMINISTRATIVE CODE' This application was referred as
required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the
Suffolk County Department of Planning issued its reply dated June 24, 2008 stating
that this application is considered a matter for local determination as there appears to
be no significant county-wide or inter-community impact.
FINDINGS OF FACT
PROPERTY FACTS/DESCRIPTION: The applicant's property contains 46,516 square
feet with 91.22 linear feet along Pine Neck Road, 476.99 feet in depth and 100+/- feet
along the wood bulkhead adjacent to Jockey Creek. The property is improved with
buildings as shown on the survey prepared by John C. Ehlers, L.S. dated April 1, 2008.
BASIS OF APPLICATION: This request for a Variance under Section 280-116B is
based on the Building Inspector's May 13, 2008 Notice of Disapproval concerning a deck
addition to the existing single-family dwelling at less than 75 feet from the existing
bulkhead.
LWRP: TOWN CODE CHAPTER 268: A July 21, 2008 letter from the Town LWRP
Coordinator was received, in reply to the Zoning Board of Appeals' request for
recommendations under this Code provision. The Coordinator confirmed the project to
be inconsistent for the deck addition to dwelling.

During the July 24, 2008 public hearing held on July 24, 2008, the applicant's architect
was requested to bring the plan into more conformity with the code requirements.
During the September 25, 2008 public hearing, the architect's amended 9/10/08 site
map submitted to the Zoning Board of Appeals was accepted and found to be consistent
with the LWRP standards and policies, with an increase of the setback for the open,
unroofed deck to a minimum of 45'6".
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials
submitted and personal inspections, the Board makes the following findings:
1. Town Law §267-b(3)(b)(3)(1). Grant of the variance will produce an undesirable
change in the character of the neighborhood or a detriment to nearby properties. The
deck is open to the sky with virtually no mass (no walls) and constructed on piers, and
will not be easily visible from adjacent properties. The design is proposed at the
northwest side of the structure which creates less loading of the structure at the water
(south) side of the property.
2. Town Law ~267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved
by some method, feasible for the applicant to pursue, other than an area variance. The
house is existing at 55'3" from the bulkhead; any additions to this nonconforming
building will require a variance from the 75 ft. minimum required setback to the
bulkhead.
3. Town Law §267-b(3)(b)(3). The variance requested herein is substantial. The deck is
proposed with an increase of the nonconformance of the setback by 13.3%, from the
existing setback of 55'3" to a proposed setback of 45'6".
4. Town Law ~267-b(3)(b)(5). The difficulty has not been self created. The house is
already nonconforming on the northerly setback to the bulkhead.
5. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a
variance in this residential community will have an adverse impact on the physical or
environmental conditions in the neighborhood.
6. Town Law §267-b. Grant of the relief requested is the minimum action necessary
and adequate to enable the applicant to enjoy the benefit enjoy the benefit, of an open
deck addition, while preserving and protecting the character of the neighborhood and
the health, safety and welfare of the community. The deck will not require extensive
excavation for an in-ground foundation since it will be elevated on footings at the base
of the deck construction.

RESOLUTION OF THE BOARD: In considering all of the above factors and applying
the balancing test under New York Town Law 267-B, motion was offered by Member
Oliva, seconded by Chairman Goehringer, and duly carried, to
GRANT the variance as amended, as shown on the site map (Sheet I dated
9/10/08) prepared by Thomas C. Samuels, Architect, subject to the following
Condition: The deck addition shall be open to the sky.
That the above condition be written into the Building Inspector's Certificate of
Occupancy, when issued.
Any deviation from the variance given such as extensions, or demolitions which are not
shown on the applicant's diagrams or survey site maps, are not authorized under this
application when involving nonconformities under the zoning code. This action does not
authorize or condone any current or future use, setback or other feature of the subject
property that may violate the Zoning Code, other than such uses, setbacks and other
features as are expressly addressed in this action.
The Board reserves the right to substitute a similar design that is de minimis in nature
for an alteration that does not increase the degree of nonconformity.

Questions - Pine Neck Holdings LLC
Due to the fact that the structure proposed is a deck that is going to be open
to the sky above, there is no mass or architectural elements to be
detrimental to the community.
Due to the location in the rear yard, and the existence of a previously
permitted structure there is no other alternate location for this structure. The
deck proposed is the minimum we need for the homeowner to enjoy the
water view on their property. We have also sited the proposed deck so that
it requires only one variance.
3.) The amount of relief is minor as this is a deck application, and not a
habitable structure.
4.) There will be no impact since there will be minor interference with the
ground, as only the piers will be in the ground.

The proposed action which has been reviewed to Chapter 268, Waterfront Consistency
Review of the Town of Southold Town Code and the Local Waterfront Revitalization
Program (LWRP) Policy Standards. Based upon the information provided on the LWRP
Consistency Assessment Form submitted to this department, as well as the records
available to me, it is my recommendation that the proposed action is INCONSISTENT
with the below listed policies and therefore is INCONSISTENT with the LWRP
pursuant to § 268 of the Southold Town Code.
Policy 6: Protect and restore the quality and function of the Town of Southold
ecosystem.
6.3 Protect and restore tidal and freshwater wetlands.
The setback from the proposed deck to the wood retaining wall (bulkhead) is 36.7 feet; a
minimum setback of 75 feet is required by Article XXIII. § 280-116. Building setback
requirements adjacent to water bodies and wetlands. [Added 3-14-1989 by L.L. No. 3-
1989; amended 11-24-1992 by L.L. No. 20-1992; 6-15-1993 by L.L. No. 8-1993]
"B. All buildings or structures located on lots upon which a bulkhead, concrete wall,
riprap or similar structure exists and which are adjacent to tidal water bodies other than
sounds shall be set back not less than 75 feet from the bulkhead...."

greatest extent practicable.

In the event that the action is approved~ to further Policy 5: Protect and Improve
Water quality in the Town of Southold and Policy 6 referenced above:
Require the establishment of a minimum 20 foot wide vegetated buffer
landward from the bulkhead. Require that the buffer is vegetated with
species native to Long Island.
Pursuant to Chapter 268, the Zoning Board of Appeals shall consider this
recommendation in preparing its written determination regarding the consistency of the

standards and conditions, it shall not be undertaken.
