ZONING BOARD OF APPEALS
After investigation and inspection, the Board finds that
applicant is requesting permission to erect three franchise
signs at business (B-l) premises known as 42155 Main Road,
Peconic, New York. One module S-U-B-A-R-U sign approximately'
33' L by 4' on 20' columns; one "used-car" Subaru sign approx-
imately 10'L by 4' on a 14' columnar tube; one "parts and
service" sign approximately 5' by 3' on northwest side of
building. Upon researching, the Board has found that appli-
cant has been granted a special exception to erect a second
ground sign in Appeal No. 2075 on September 25, 1975; granted
permission to re-locate existing wall sign located at the
northeast corner of Main Road and Peconic Lane in Appeal
No. 1312 on January 8, 1970; granted permission to erect
a wall sign to replace present sign (84" by 96") in Appeal
No. 795 on September 16, 1965; granted permission to erect
ground sign exceeding maximum height requirements at the
northeast corner of Main Road and Peconic Lane in Appeal
No. 976 on October 6, 1966. It is the feeling of the
Board that the subject property has existing signs suf-
ficient for the advertising of on-premises business and
products. However, applicant has applied for a hanging/wall-
mounted directional sign (parts and service), and it is the
opinion of the Board that applicant's request for this sign
is reasonable under the circumstances.
On motion by Mr. Tuthill, seconded by'Mr. Douglass, it
was
RESOLVED, that Herbert W. Wells, Jr., Pine Neck Road,
Southold, New York be DENIED permission to erect the
module Subaru sign (33' by 4') and be DENIED permission
to erect the "used-car" subaru sign (10' by 4'); but be
GRANTED permission to erect one "parts and service"
directional sign (approximately 5' by 3') at the north-
west side of the building as applied for, and SUBJECT
TO THE FOLLOWING CONDITIONS:
(1) Said sign permit is terminable at once at the
direction of the Board of Appeals;
(2) The purpose of said sign must be directional
in the public interest, and accordingly, said sign shall
bear only the fOllowing wording: Parts & Service [as
shown on sketch submitted with appeal application];
(3) Said sign shall not exceed the size of four feet
by six feet;
(4) Referral to the Suffolk County planning Commission
pursuant to Section 1332 of the Suffolk County Charter.

RESOLVED, that Herbert W. Wells.~ Jr., Pine Neck Road,
Southold, New York be DENIED permission to erect the

to erect the-"used-car" subaru sign (10' by 4'); but be
GRANTED permission to erect one "parts and service"

clinic on property described as Lot 1 in Minor Subdivision
of Armaroy Acres, located on the south side of North Road,
Greenport, New York.
In reviewing the subject application filed on the 14th
day of August, 1980, it was the determination of the Board
that applicant obtain all necessary approvals before this
matter may be scheduled for public hearing, including site
plan approval of the Planning Board, Article III, Section
100-30B of the Southold Town Zoning Ordinance.
On motion by Mr. Grigonis, seconded by Mr. Tuthill,

Town Planning Board for its review and determination regard-

MR. CARL VAiLs Oeneral Motors has in&ugerated a nation wide
sign program, they are ~ry~ng to make every GM dealer, comply with.
The amazing thing about this whole progrmn is that they only sign
a five ~ contract for the dealer to sell the products and yet
they expe~ tho dealer to sign a 10 ~ear lease for the re~a~ o~
the signs. Zf we entered into this ~ro~ram a rental of the s~gne
~ould cost us apProXinatoly ~250.00 a month £or ten yea~e.
THB CHAIRMA~t General Motors runs into trouble on this
over the country, I read of a case Just a few weeks ago ~here
the Town limited tho area of the signs to 16 sqo ft.
HR. VAILs ! am sure that the dealers in that area were very
grateful. The ro~so~ we w~ut this permission to move this sign is
so that we ~ln move it without distrubing anyone, then they can't
make us Join this r~w rental plan.
MR. HULSB: All he iS asking for is to move the sign So that
it does ':nOt over hang the sidewalk.

THE CHA~P~N: Would this help you, by us allowing you to move
the sign. It seems ~ncredible that anybody in business should have
to pay ~250.00 a month for the rental of signs°
MR. VAIL: General Motors claims that no matter how many yearn
you have been in bus,ness your good will is $1o00~ simply because
they own the franchisee if you wanted to sell your business, they
~ould dictate the terms to you° All you own is the property. Their
main ~nterest would be to see that the succeeding dealer gets a good
enough dual so that he can buy their cars. My whole idea of ~this is
not too pleasanto They are trying to make every dealer look alike.
Xf for any reason you violate one of their 3Q reasons for cancellation,
contained in their contract~ by them owning the signs and havin~ a
uniform apl~earance of dealers throu~jh out ~e country~ it ~kes it
easier for them to change the ~nagement. Of course, they do give
you an alternative. Here is a list of the specifications you have
to meet if you have your own sign nmde up.

MR. HERBERT W. WELLS, JR.: I would like to have a second
ground sign as I do not care to deface the building. I
understand that you do'not allow second ground signs so I will
go along with your suggeztion that it could be put on.,the roof.
It would solve a p~oblem.
THE CHAIRMAN: We have had more than one sign on a post
but the over-all size can not be more than 81 sq. ft. The
problem is that Mr. Wells has purchased a 4' x 10' illuminated
Subaru sign and needs a place to locate it.
MR. WELLS: We have a franchise but if we don't erect a
sign we will not get the 1976 vehicles.
THE CHAIRMAN: We have'suggested that he put it three to four
feet above the mansard roof. If.you wanted a wall sign on Peconic
Lane or Route 25 in order to preserve the beauty of the mansard
roof you would surrender your right, to a sign on the roof.
MR. WELLS: I think a wall sign would deface the building
so if I could erect a sign on the roof I would like to do that,
and I am sure it would be okay with Subaru.
THE CHAIRMAN: Thais' is a 4' sign so if you have a Variance
for 2 1/2 more feet, it should suffice.
MR. WELLS: That would give me 6" above the roof. ""
THE CHAIRMAN: Is there anyone present who wishes to speak
against this application?
(There was no response.)
After investigation and inspection the Board finds that
applicant requests permission to erect second ground sign on
Route 25, Peconic, New York.' The Board has suggested that
in lieu of a ground sign (second ground signs are not permitted)
that applicant be permitted to erect a roof sign with a height
variance of 2 .1/2 feet. Applicant has agreed to this suggestion.
The Board also finds that applicant needs a sign in order to
obtain a franchise to sell Subarus.
The Board finds that the public convenience and welfare
and justice will be served and the legally established or
permitted use of neighborhood property or adjoining use
districts will not be permanently or substantially injured
and the spirit of the Ordinance will be observed.
