Tiebel Gentlemen: It has recently come to my attention that Mr. &Mrs. Tiebel have requested a variance from the Board of Appeals to sub- divide property which is adjacent to property I own on Peconic Bay Blvd. The Tiebels have been neighbors for a number of years and I have no desire to offend them in any way, however Board ap- proval of this variance will have a negative impact on the value of my property. A subdivision of the property will re- sult in housing congestion and destruction of the rural char- acter of the area. M~mother is presently out of town and I having power of attorney ~ responding in her be- half. The attorney representing Mr. &Mrs. Tiebel has been advised that my mother's property is not adjacent to the property described but is owned by John A. and Andrew J. Holfelder. My mother's property is in the general vicinity of this property being approximately 300 feet northeast of the subject property on the opposite side of Peconic Bay Blvd. I wish to advise that any attempt to subdivide the above property is of concern to my mother. While I can sympathize with the needs of the Tiebels I feel a subdivision of the property will lower property values in the area and for this reason I gm strongly opposed to this request and urge the Board of Appeals to deny the petition. STRICT APPLICATION OF THE ORDINANCE would produce practical difficultiesor unneces- soryHARDSHIP because Petitioners are owners of a parcel of land containing 51,600 square feet of area upon which there presently exists a 1-1/2 story frame dwelling and a barn which is utilized as a car garage and for storage purposes. The Peti- tioners would like to divide this property into two parcels,~ The first lot is presently vacant and would have 137.77 feet of road frontage on Peconic Bay Boulevard and contain 19,350 square feet in area. The second parcel to be created would front on Peconic Bay and would have 157.56 feet of waterfront and contain 32,250 square feet. Parcel No. 2 does~ contain the already existing dwelling and barn. These pro- posed lots are designated as Parcel 1 and 2 respectively on a m~p prepared by Roderick Van Tuyl, P.C,, which is attached hereto as Exhibit A. In addition Parcel 2 will require approval of a 20 foot right-of-way for access from Peconic Bay Boulevard as shown on Exhibit A. Your Petitioners wish to keep the existing barn on lot No. 2 for the continued use as a garage and storage area, which explains why the proposed division does not create two lots equal in area. The present parcel is too large for your Petitioners to main- tain and the granting of the variance is not that substantial taking into account the surrounding properties, many of the lots are narrow and some have already been divided or contain several dwellings upon them~ The variance will allow one additional resi- dence to be built in this area and therefore will not substantially change the character of the neighborhood nor place a burden upon available government facilities. The hardship created is UNIQUE and is not shared by all properties alike in the immediate vicinity of this property and in this use district because Most of the lots in this area were created and developed prior to the enactment of the present Zoning Ordinance of the Town of Southold and as a result are substantially small lots. To reqUire your Petitioners to retain this large parcel in this particular neighborhood will place an unnecessary burden upon them. 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because an inspection of the property~in this neighborhood reveals that they are devoted exclusively to a residential uSe. The surrounding par- cels are generally smaller than allowed by the present zoning ordinance. By allowing Petitioners to divide their parcel will be in conformity with the existing neighborhood and the interest of justice will be served by allowing the variance.
