FORM ZB4
ZONING BOARD OFAPPEALS
After investigation and inspection, the Board finds that
apPlicant is requesting permission to construct a 12' x 24'
addition in the southerly sideyard'area, leaving approximately
three feet to the south sideyard line. Existing on the premises
are a shed, approximately 30 square feet in area, and an
one-story frame house with patio. In calculating the area
of the existing and proposed structures in comparison with
the lot area of 5,300 square feet, it has been found that
the structures would exceed 20% coverage of the lot area.
It is the feeling of the Board that either a smaller addition
or temporary structure would be more reasonable under the
circumstances.
The Board finds the circumstances present in this case
are not unique,' and strict application of the ordinance
would not produce practical difficulties or unnecessary
hardship. The Board believes that the granting of a variance
in this case will change the character of the neighborhood
and will not observe the spirit of the zoning ordinance.
On motion by Mr. Grigonis, seconded by Mr. Tuthill, it
was
RESOLVED, that Joseph and Amelia Smulcheski, Carole Road,
Southold, New York be denied without prejudice a Variance to
the Zoning Ordinance, Article III, Section 100-31 as applied
for.
