III, ( ) 1980, the appeal Section 100-31 ~a~ed ( ) be denied pursuant to Article .................... ~ction .................... Subsection .................... para, apb .................... of the Zoning Ordinance and the ~c~n of the Budding I~pector ( ) be reversed ( ) be confkmed b~au~ Application of Joseph and Amelia Smulcheski, Carole Road, Southold, New York for a Variance to the Zonin.9 Ordinance, Article III, Section 100-31 for permission to con- struct addition with insufficient sideyard. Location of property:. .140 Carole Road, Southold, New York; bounded north by Hass, east by Arshamomaque Pond, south by Hrebok, west by Carole Road; County Tax Map Item No. 10'00-52-2-5. (SEE REVERSE SIDE) 2. VARIANCE. By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce hardship because practical difficulties or unnecessary (SEE REVERSE SIDE) (b) The hardship created (is) (is not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because (SEE REVERSE SIDE) (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) change the character of the district because (SEE REVERSE SIDE) (would not) and therefore, it was ft,rther determined that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. FORM ZB4 ZONING BOARD OFAPPEALS After investigation and inspection, the Board finds that apPlicant is requesting permission to construct a 12' x 24' addition in the southerly sideyard'area, leaving approximately three feet to the south sideyard line. Existing on the premises are a shed, approximately 30 square feet in area, and an one-story frame house with patio. In calculating the area of the existing and proposed structures in comparison with the lot area of 5,300 square feet, it has been found that the structures would exceed 20% coverage of the lot area. It is the feeling of the Board that either a smaller addition or temporary structure would be more reasonable under the circumstances. The Board finds the circumstances present in this case are not unique,' and strict application of the ordinance would not produce practical difficulties or unnecessary hardship. The Board believes that the granting of a variance in this case will change the character of the neighborhood and will not observe the spirit of the zoning ordinance. On motion by Mr. Grigonis, seconded by Mr. Tuthill, it was RESOLVED, that Joseph and Amelia Smulcheski, Carole Road, Southold, New York be denied without prejudice a Variance to the Zoning Ordinance, Article III, Section 100-31 as applied for.
