Reviewed Melissa’s staff report. Land purchase inquiry is not compatible for use of Community
Preservation Funds. Melissa to send written response to inquirer that project does not meet
requirements set forth by Community Preservation Fund legislation.

John Sepenoski recused and absented himself from discussions on this project due to family
relationship.
Appraisal reviewed and discussed.
MOTION made by Michelle Zaloon, seconded by Chris Baiz, to direction Melissa Spiro to present a
purchase offer to landowner for a development rights easement on a part of parcel identified as
SCTM #1000-18-4-7.1. No agricultural restrictions will apply to this easement. Landowners will
establish a reserve area of approximately ???? acres with road frontage along Route 25.

Discussed Reserve Area and easement terms.
Stephen Searl presented survey map of parcel with requested reserve areas that we discussed by
LPC members.
MOTION made by Michelle Zaloom, seconded by Lillian Ball, to remove stipulation of “no further
subdivision of the easement area” from previous motion, which would make option available for
parcel to be considered for possible TDR Program in the future. Reserve Area will be 2± acres
located directly behind residential home. Existing barn will be located within the PDR area. Easement
language will allow for future 40,000 square foot area with access from Hortons Lane to construct a
farmstand limited in size to a closed-in area of 2,000 square feet if Town Code adopts legislation to
allow for retail farmstands on PDR land, subject to LPC review with scenic viewshed considerations.

PUBLIC HEARING ON TRANFER OF DEVELOPMENT RIGHTS (TDR) –
DRAFT GENERIC ENVIRONMENTAL IMPACE STATEMENT (DGEIS)

Reviewed new application.
Melissa’s staff report reviewed. Landowner has offered fee title for sale to Town rather than
continuing forward with application for subdivision. Property is located within the designated East
Marion HALO zone. Property is also listed on PEP and The Nature Conservancy’s list of properties of
critical concern. Property has water frontage on Marion Lake.
LPC has interest in preservation of property but would like Melissa Spiro to obtain further information
regarding adjacent parcel. Further discussions will be held at next scheduled regular LPC meeting.
The members re-entered into EXECUTIVE SESSION.

Total Acreage: ±8.235 acres PDR Acreage: ±7.19 acres
Reviewed appraisal [executive session]
Reviewed latest updated appraisal and Melissa’s staff report.
MOTION made by Ray Huntington to direct Melissa Spiro to present a purchase offer to landowners.
Motion not seconded and Ray Huntington had to leave meeting after voicing his limitation of a
presentable purchase offer.
MOTION made by Chris Baiz, seconded by Eric Keil, to direct Melissa Spiro to present a purchase
offer to landowners for a development rights easement on agricultural land based upon per buildable
acre. LPC has approved landowners request for a Reserve Area around the existing residential
structure and barn. The Land Preservation Committee’s offer includes additional restrictions for the
placement of future agricultural structures within the easement area to the area behind the existing
residential home and barn (Reserve Area). A scenic viewshed will remain behind the existing
farmstand. The purpose of this acquisition is for farmland and scenic protection.
Motion carried: 6/1 (Ray Huntington voted by absentee)
