The meeting began at 7:09 p.m. with six LPC members present. Adoption of Meeting Minutes: ?? Acceptance of meeting minutes from February 10, 2009 and February 17, 2009 MOTION made by John Sepenoski, seconded by Maureen Cullinane, to adopt the February 10, 2009 and February 17, 2009 Land Preservation Committee meeting minutes. Motion carried: 6/0 (Lillian Ball absent from vote) Applications and Inquiries: ?? SAWICKI (Estate) PROPERTY SCTM #: 1000-125-3-4.1 Zoned: A-C Location: 2700 Rt 25, Laurel CPF: Yes Total Acreage: 13.04 acre (12.95 GIS acres) Subdividable: Yes FWet: 1.06 acres Reviewed status of offer [executive session] The members entered into EXECUTIVE SESSION. Sawicki’s attorney requested an extension of the thirty (30) day purchase offer letter. MOTION made by John Sepenoski, seconded by Ray Huntington, based upon the information presented, the expiration date of LPC’s purchase offer on the Sawicki development rights easement will be extended until March 31, 2009. Motion carried: 7/0 ?? MOTION made by John Sepenoski, seconded by Ray Huntington, based upon the information presented, the expiration date of LPC’s purchase offer on the Biggane development rights easement will be extended until March 31, 2009. Motion carried: 7/0 END OF EXECUTIVE SESSION ?? DROSKOSKI PROPERTY SCTM #: 1000-18-4-7.1 Zoned: R-80 Location: 28105 Rt 25, Orient CPF: Yes Total Acreage: 21.25 acres (22.04 GIS) Subdividable: Yes Request to re-open PDR application John Sepenoski absented himself from the room due to a family relationship to property owners. Melissa Spiro gave background information on this application that had been submitted to the LPC on 2/15/08. A formal purchase offer was made for the Droskoski development rights easement on May 29, 2008. No action was taken by landowner and offer expired. Melissa met with landowner and explained that if there was a desire to re-activate this application, then landowner should be aware that any offer made at this time may be lower than the 2008 purchase offer. Landowner understood and returned a signed letter to this affect. MOTION made by Eric Keil, seconded by Chris Baiz, to direct Melissa Spiro to contact the appraiser to commission an update to report dated April 10, 2008. POLLOCK PROPERTY SCTM #: 1000-110-1-10 Zoned: R-40 Location: 2700 West Creek Dr, Cutchogue CPF: No Total Acreage: (RPS) 0.75 acre (GIS) 0.7 acre Subdividable: NZ MWet: 0.06 Inquiry to PLT and Town This property is located near Cutchogue Harbor Marina and has a waterfront boundary with Wickham Creek. Stephen Searl gave background information and Peconic Land Trust’s involvement with the Pollock Estate. LPC members may consider a significant bargain sale fee title purchase of this parcel and directed Stephen & Melissa to make inquiries for additional information. General Items: ?? AMENDMENTS TO SUFFOLK COUNTY LOCAL LAW CHAPTER 8 LPC to finalize comments Melissa Spiro prepared a document to submit to Tom Isles, Suffolk County Planning Director, as to LPC’s comments to Suffolk County Local Law Chapter 8. Written comments were approved by committee after comment revisions were made to “ensure that at least 50% of the Farmland Committee are farmers” and that a general comment be added that “Agri-tourism activities should be addressed and allowed on PDR properties if consistent with farm operation.” ?? APPLICATION FOR USE OF SOUTHOLD PARKS FACILITIES Discuss Procedure o The Recreation Department is now requiring that organizations desiring to use Town parklands or preserves for specific events must complete an application form for review and approval of committee. LPC has directed Melissa Spiro, as Land Preservation Coordinator, to approve any such application that is within the guidelines of a draft or adopted Management Plan for the Town Park or Preserve in which the event is to take place without Committee review. Any event not falling within said guidelines will be brought before the Committee for approval. PLT request to use Dam Pond on April 18, 2009 for Birding Walk o This is considered passive recreation and request was approved by Committee. ?? 2008 TOWN OF SOUTHOLD DEER MANAGEMENT PROGRAM SURVEY RESULTS Survey results were reviewed. It was felt that the Southold Deer Management Program was generally considered a success even though only 5 deer were eliminated. John Sepenoski had several comments. Melissa asked for comments to be held for discussion at next LPC meeting. ?? FRED LEE APPOINTMENT 8:15 P.M. Fred Lee was invited to speak to LPC members about his farmland proposal (8:37 p.m.) in which he asked that the Town consider purchasing fee title to farmland that could then be leased to farmers that are not financially able to purchase farmland but need to expand their farm businesses. He pointed out hardships that young farmers are and will be facing and the need to provide affordable farm opportunities to the next generation of farmers if the Town of Southold wants to keep their rural character. A round table discussion ensued. In keeping with Fred’s suggestion, John Sepenoski will revisit the issue with the Town Attorney the possibility of using Custer Preserve for farm purposes since LPC’s original hope for Custer was for it to be leased to a farmer or used as a community garden. Stephen Searl spoke of Peconic Land Trust’s efforts to promote affordable farming. There is a $4 million voter approved bond which allows Town to purchase and re-sell all or part of a farm. The Agricultural Advisory Committee is in the beginning stages of setting up a plan of action. Chris Baiz and John Sepenoski, both members of the Agricultural Advisory Committee, are working on forming a farmland registry that identifies farm parcels, farmland owners willing to lease farmland, farmers looking to lease farmlands, etc. ?? OUTREACH HOLD due to time constraints. Additions to Agenda: ?? INTERNAL POLICY – PURCHASE OFFER TIME LIMITATIONS MOTION made by Ray Huntington, seconded by Eric Keil, that all purchase offers will require a conclusive response within thirty (30) days from date of formal purchase offer letter which will be sent by certified mail/return receipt requested. Landowners may be granted, at Land Preservation Coordinator’s discretion, up to a thirty (30) day extension from offer deadline date. Any further extension requests from landowner or their representative for additional time needed, will be determined by the Land Preservation Committee after their review and re-evaluation of the project. Motion carried: 7/0 ?? LAND PRESERVATIION COMMITTEE MEMBERS TERMS EXPIRING 3/31/09 Al Krupski reminded John Sepenoski, Ray Huntington, Chris Baiz and Eric Keil, that their terms for serving on the Land Preservation Committee are due to terminate on March 31, 2009. He reminded these members that if they desire to continue their volunteer service to the Town as members of the Land Preservation Committee than they must submit a written letter of their intentions to the Town Clerk prior to the next Town Board meeting being held on Tuesday, March 24, 2009. Those members seeking reappointment to the Committee will be a topic for discussion at the next Town Board work session, which is prior to these terms expiration date. Next Regular Meeting: ?? The next regular meeting will be held on Tuesday, March 31, 2009, at 7:00 p.m., in the Town Hall Annex Executive Board Room. (March 17, 2009 meeting cancelled as Melissa Spiro will be away.) Ray Huntington will have difficulties attending Tuesday night’s meetings until June. Some meetings from now until June may be re-scheduled for Monday nights if other members are favorable to the change. Chris Baiz may not be able to attend 3/31/09 LPC meeting. Maureen Cullinane may not be in attendance for 4/14/09 LPC scheduled meeting. Eric Keil will not be able to attend any meetings held during May 2009. Adjournment: ??
